Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Title 31 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to Power and Heating be amended to read as follows: TITLE 31 MECHANICAL EQUIPMENT & MECHANICAL EQUIPMENT DEALERS Chapter 1 GENERAL PROVISIONS Sections: 31-1-1. Scope 31-1-2. Enforcement 31-1-3. Chief mechanical official. Sec. 317.1-1. Scope. This title establishes rules and regula- tions for operating engineers and boiler operators licenses, and mechanical equipment dealers. Sec. 31-1-2. Enforcement. It shall be the duty of the plumbing and mechanical division of the Department of Building & Housing Services to enforce the provisions of this title. Sec. 31-1-3. Chief mechanical official. The chief mechanical official is the officer or other designated authority charged with the administration and enforcement of this title and of the Uniform Mechanical Code, or his duly authorized representative. Chapter 2 OPERATING ENGINEERS AND BOILER OPERATORS LICENSES Sections: 31-2-1. Boiler operation without license unlawful. 31-2-2. Issuance of licenses. 31-2-3. Application for examination. 31-2-4. Classes of licenses. 31-2-5. Qualifications of a st..am engineer - unlimited. 31-2-6. Steam engineer - limited. 31-2-7. Boiler operator - high pressure. 31-2-8. Appeal to board of commissioners. Sec. 31-2-1. Boiler operation without license unlawful. It shall be unlawful to operate, have control of, manage, or take charge of, any portion of a steam or hot water plant, absorption system, or appliance connected therewith while working under pressure unless such plant, system, or appliance, is being operated by a steam engineer, or boiler operator, who has been duly licensed for such operation. This section shall not apply to operators of: (1) Residential heating boilers to and including four (4) dwelling units; (2) Boilers and pressure vessels under ten (10) horsepower (340,000 BTU) output rating or operating on pressure under 15 pounds per square inch, or (3) Boilers or plants coming under the jurisdiction of the Interstate Commerce Commission. Sec. 31-2-2. Issuance of licenses. It shall be the duty of the chief mechanical official to examine all applicants for licensing as steam engineers of boiler operators, as to their fitness and qualifications in accordance with the requirements of this title, and to issue licenses pursuant thereto. Sec. 31-2-3. Application for examination. All persons desiring to be licensed to perform the duties of engineer and/or boiler operator of stationary or portable boilers shall make application to the Plumbing & Mechanical Division on forms to be furnished by said division after payment of the fees, as hereinafter provided. Sec. 31-2-4. Classes of licenses. The license required for this title shall be divided into two classes for engineer, and one class for boiler operators, as follows: (1) Steam engineer - unlimited (2) Steam engineer - limited (3) Boiler operator - high pressure Sec. 31-2-5. Qualifications of a steam engineer - unlimited. An applicant for a steam engineer's license - unlimited, must be an engineer, oiler, or boiler operator, having at least five (5) years actual operating experience in the management, control or operation of high pressure steam boilers, or steam plants of 300 horsepower (10,200,000 BTU) or more. Up to four (4) years will be credited an applicant having previous equivalent training course in mechanical engineering at an accredited engineering school. Sec. 31-2-6. Steam engineer - limited. An applicant for a steam engineer license - limited, must be an engineer, oiler, or boiler operator, having at least four (4) years actual operating experience in the management, control, or operation of high pressure steam boilers, or steam plants of not less than 100 horsepower (3,400,000 BTU) . Up to four (4) years will be credited an applicant having previous equivalent training course in mechanical engineering at an accredited engineering school. Sec. 31-2-7. Boiler operator - high pressure. An applicant for a high pressure boiler operator's license must have at least one year's actual operating experience under the supervision of a licensed steam engineer or boiler operator, in the management, control and operation of a high pressure steam boiler above 15 pounds operating pressure, or a hot water boiler above 30 pounds pressure or 160° F. 59 -3- Sec. 31-2-8. Exception for experience requirements. If an applicant for a high pressure boiler operator's license has not had actual operating experience in the management, control, or operation of boilers, a provisional license may be granted by the chief mechanical official for not more than a one-year period, providing the applicant demonstrates sufficient knowledge and ability to safely and properly operate any boiler to which he may be assigned. A provisional boiler operator's license is subject to review of qualifications at any time at the discretion of the chief mechanical official. Sec. 31-2-9. Fees for examination and license. The fees for steam engineer or boiler operator examination and license shall be as follows: Steam engineer - unlimited . . . . $10.00 Steam engineer - limited 7.50 Boiler operator - high pressure . 7.50 Duplicate license 2.00 Renewal of license 5.00 Renewal of license to one year after expiration 10.00 Late renewal 10.00 (Plus $2.00 each late year, not to exceed three (3) years) Sec. 31-2-10. License granted upon passage of examination. If said applicant, after examination by the chief mechanical official, is found to have the requisite knowledge of mechanical equipment and experience to safely operate same and minimize fire, explosion, asphyxiation hazards and smoke nuisance, he shall be granted the appropriate license. Sec. 31-2-11. License certificate. Each person who has success- fully passed the required examination shall be issued a license certificate of the proper grade. Sec. 31-2-12. Renewal of license. Any person who holds a license issued under the provisions of this title may have the same renewed annually without examination provided that he pays the annual renewal fee, as stated in Sec. 31-2-9, above, and presents a receipt for the same from the City Treasurer. A new examination must be taken by any applicant who fails to renew his license within three (3) years from the expiration date of said license. The expiration date of each license issued shall be the June 30 next following the date of issuance. All records of licenses and examination may be removed from Salt Lake City files after three years from expiration date of license and destroyed. Sec. 31-2-13. Powers granted by license. Steam engineer - unlimited. Persons holding a steam enginer - unlimited - license may take charge of and operate any steam or hot water plant. Sec. 31-2-14. Steam engineer - limited. Persons holding steam engineer license may take charge of and operate any steam or hot water plant not exceeding 300 horsepower (lo,200%,000 BTU) . Sec. 31-2-15. High pressure boiler operator. Persons holding high pressure boiler operator license shall have the right to operate any steam or hot water boiler not exceeding 75 horsepower (2,555,000 BTU) . Any high pressure boiler operator operating high pressure boilers greater than 75 horsepower (2,555,000 BTU) shall be under the supervision of a qualified steam engineer. Sec. 31-2-16. Exception for emergency operation. In all cases of temporary disability from accident, sickness, or other cause, a steam engineer with a lower grade of license, or without a license, may operate boilers and machinery of an engineer of a • -4- higher grade, having charge of the plant for a period of not to exceed thirty (30) days, provided that the employer of the steam engineer so disabled shall notify the chief mechanical official as soon as possible after the occurrence of such disability, and an application is submitted for a provisional license pursuant to the provisions of Section 31-2-8 of this chapter. Sec. 31-2-17. Duty of chief mechanical official. It shall be the duty of the chief mechanical official to see that each steam boiler plant and each hot water boiler plant shall have a person in charge who is in possession of a proper and valid license, as provided by this chapter, when said boiler plant is working under pressure. The chief mechanical official shall have authority to order discontinuance of boiler operation for non- compliance of the provisions of this code. Sec. 31-2-18. Duty of licensee. Each person licensed under this chapter shall display his license certificate in a conspicuous place in the boiler room at all times. It shall be the duty of each person licensed under this title to operate the boiler under his charge in a safe and proper manner in accordance with the provisions of the Uniform Mechanical Code as adopted by these revised ordinances and with standards approved by the chief mech- anical official. Copies of said approved standards shall be available for public inspection at the office of the Salt Lake City Department of Building and Housing Services. Sec. 31-2-19. Reports required of licensees. It shall be the duty of every licensed steam engineer and boiler operator to report to the chief mechanical official any defect, or any accident in any steam boiler, hot water boiler, stack, stoker, burners, furnace, smoke prevention device, absorption system, or appurtenances be- longing thereto, any fire hazard coming under his care, or any condition of the plant in violation of the Uniform Mechanical Code, as adopted by Salt Lake City ordinances or contrary to the standards adopted by Section 18 of this chapter. Sec. 31-2-20. Suspension, revocation and reinstatement of license. The chief mechanical official shall have the power to suspend or revoke the license of a steam engineer or boiler operator for permitting water to get too low in the boiler; for carrying a higher pressure of steam than allowed; for allowing or per- mitting a fire hazard to exist in any boiler room after being duly notified by the authority having jurisdiction over such hazard; for persistent violation of the air pollution code; for an unneces- sary absence from his post of duty; for the excessive use of intoxi- cating liquors, or other neglect or incapacity; provided, however, that no license shall be suspended or revoked without first giving an accused person an opportunity to be heard in his own defense. When a license of an engineer, or boiler operator, shall be revoked, no license shall be issued to the same person until thirty (30) days after said revocation; for the second revocation, no license shall be issued to such person for ninety (90) days thereafter; and for any subsequent revocation, no license shall be issued to said person. Sec. 31-2-21. Appeal to board of commissioners. Any licensee, or applicant for a license, who has had such a license denied, suspended, or revoked, may appeal in writing to the board of commissioners of Salt Lake City for review of such denial, sus- pension, or revocation within ten (10) days following the effective date of such denial, suspension, or revocation. The board of commissioners shall schedule a hearing thereon and its decision concerning the matter shall be final. 59 -5- CHAPTER 3 MECHANICAL EQUIPMENT DEALERS Sections: 31-3-1. Definition. 31-3-2. License required. 31-3-3. Applications. 31-3-4. Fee. 31-3-5. Duties of mechanical equipment dealers. 31-3-6. Unlawful to sell unapproved equipment. 31-3-7. Rights of licensee. 31-3-8. License subject to suspension or revocation. Sec. 31-3-1. Definition. The term "mechanical equipment dealer" shall include all persons engaged in the business of selling, vending, or offering for sale, any mechanical, equip- ment used for venting, heating, cooling, or power generating, who do not make installation of same. Sec. 31-3-2. License required. It shall be unlawful for any person to engage in the business of selling, vending, or offering for sale, any mechanical equipment or appurtenances thereto unless he is licensed so to do as herein provided. Sec. 31-3-3. Applications. Applicants for a mechanical equipment dealer license shall make application to the chief mechanical official of Salt Lake City, and furnish such informa- tion as may be required by said official. Upon approval of such application, the chief mechanical official shall present such application to the board of commissioners of Salt Lake City, and when and if approved, a license to sell mechanical equipment may be granted. Sec. 31-3-4. Fee. The mechanical equipment dealer fee for such license shall be five dollars ($5.00) per annum. Sec. 31-3-5. Duties of mechanical equipment dealers. It shall be the duty of each mechanical equipment dealer to register with the plumbing and mechanical division the name, type, and kind of each and every mechanical appliance, or apparatus, sold by him for use within the corporate limits of Salt Lake City. This registration shall include the name and address of purchaser and/or user of such equipment, the same to be filled in on forms furnished by the plumbing and mechanical division of Salt Lake City. Such information shall be mailed or delivered to the office of the plumbing and mechanical division by the seventh (7th) day of each month, and shall include information from the previous month. Sec. 31-3-6. Unlawful to sell unapproved equipment. It shall be unlawful for any dealer, or person, to sell, deliver, or offer for sale, any mechanical equipment, or apparatus, that has not been approved by a recognized listing agency. Sec. 31-3-7. Rights of licensee. The mechanical equipment dealer license shall entitle such dealer to sell and deliver approved mechanical equipment, but does not entitle said dealer to make any installation, alteration, or repair. Sec. 31-3-8. License subject to suspension or revocation. The license of any mechanical equipment dealer, provided for in this chapter, may be revoked by the board of commissioners of Salt Lake City for any violation of this chapter after notice and hearing and opportunity-tb' be heard. No refund of the license fee, or any part thereof, shall be allowed in the case of revoca- tion. No person whose license has been revoked shall be re-licensed without permission of the board of commissioners of Salt Lake City. -6- CHAPTER 4 OFFENSES Sections: 31-4-1. Violations. 31-4-2.
