BE IT ORDAIIED by the Board of Commissioners of Salt Lake City, Utah: - Section 1. That there is hereby established a Legal Department as one of the branches of the administration of the municipal affairs of Salt Lake City. Section 2. That there is hereby created the offices of Corporation Counsel, Assistant City Attorney' and Second Assist- ant City Attorney. Each of said. offices shall be filled. by appointment by the Board of Commissioners. Section 3. The Legal Department of Salt Lake City shall. e.ornprise the offices of corporation counsel, city attorney, assistant city attorney and second assistant attorney. The Legal Department shall have charge of all legal matters per- taining to the City's ri;} ts, obligations, property, property- rights, adrrinistration, officers and agents; it shall also have charge, in the City's 'behalf, of all litigation to which the City is a party. Should any of said officers. have personal knowledge of any violation of a City Ordinance, or receive re- lie:ble information of any such violation, he shah immediately institute the necessary steps to bring the offender to punish- ment. Section 4. The Corporation Counsel, or in his absence, the Cit,. Attorney, shall attend the meetings of the Board of Comnissioners• but surd- attendance upon any given meeting may- be waived by the Board at its election. lie shall. advise and counsel the hoard of Commissioners and. the numbers thereof, and all other officers at the City, upon such questions of law per- taining to the business, property and all affairs of the City 6 0,L; I.lavy fror time to time arise. He, or the City. Attorney, subject to his direction, shall prosecute and defend in all Courts all ::.ctions or behalf of the City, and defend in all actions ageinst any officer or agent of the City. on account of official acts; he shall take appeals or sue out writs of error on behalf of the city or any officer as aforesaid, with the consent and approval of the Board of Commissioners; and either he Or the City Attorney nay rake the necessary affidavits and verAfjcations on behalf of the City in any and all proceedings. He shall draft all. ordinances, and shall pepare all legal documents required in the transaction of the City's business. The Corporation Counsel shall be the head of the Legal Depart- ment, and have charge and direction thereof. Section 5. The City. Attorney and Assistant City At- torneyszhall aid the Corporation Counsel. in all natters per- taining to the City's legal business, as required, and shall conduct such litigation and attend to such other legal ratters in behalf of the City and its officers as the Corporation Counsel or the Hoard of Commissoners na:;-. require. Section C. The Legal Department shall keep a record showing all claims placed v,J.th it or its officers for col- lection, all. moneys resei,:ed by it on account of the City, and all rayments made by it to the City Treasurer. It shall also keep a docket in which it shall keep a record of suits pending and the proceedings had therein. Section 7. The Corporation Counsel shall on or before the 5th day of each and every month, or oftener if required, settle with the auditor of public accounts and. pay to the City Treasurer ali moneys in the hands of the Legal Department be- longing to the City. He shall report quarterly, or oftener if reql;irod, to the Board of Com.issicners, the condition of the business ir the Legal Department. Section C. The compensation of the Corporation Counsel shall be Forty-two hundred Dollars per annum; the compensation - of the City Attorney ohall be Three Thousand Dollars per annum; the cconpe:natien of the Assistant City Attorney shall be Eighteen. Hundred Dollars per annum; the compensation of the Second Assistant. City Attorney shall be Fifteen Hundred Dol- lars per annum; said salaries shell be payable monthly, as are - the salaries of other city officers. Section 9. Before assuming; the duties of their respect- ive offices, each of said officers shall take and subscribe the constitutional oath of office, and shall furnish befde to the City, - the Corporation Counsel in the sum of Four Thousand c Dollars, the City Attorney in the sum of Four Thobthiid Dollars <nC each of the Assistant City Attorneys in the sum of T*o Thousand Dollars. Section 10. The Legal Department shall have power to employ a suitable person as stenographer at a salary of nine hundred itax±x Dollars per annum, payable monthly, as are the salaries of other city employes. Section 11. Chapter IV of the Revised Ordinances of Salt Lake City, 1903, and amendments thereof, and all other ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 12.
