AN ORDINANCE AMENDING Sections 3, 4, 5 (b), 6, 8, 11, 12, 13, 15, 16, 26,
29 and 35, of Chapter 5 of Title 18 of the Revised Ordinances of Salt Lake
City, Utah, 1955, relating to dairy and milk inspection and standards.
Be it ordained by the Board of Commissioners of Salt Lake City, Utah:
SECTION 1 . That Sections 3, 4, 5 (b), 6, 8, 11, 12, 13, 15, 16, 26, 29
and 35 of Chapter 5 of Title 18 of the Revised Ordinances of Salt Lake City,
Utah, 1955, relating to dairy and milk inspection and standards, be, and the
same hereby are, amended to read as follows:
"Sec. 18-5-3. Definitions. The following definitions shall apply in
the interpretation and the enforcement of this chapter:
(a) MILK. Milk is hereby defined to be the lacteal secretion
obtained by the complete milking of one or more healthy cows, exclud-
ing that obtained within 15 days before and 5 days after calving or
t. soch longer period as may be necessary to render the milk practically
"colostrum free; which contains not less than eight and one-f urth per
cent (8.25%) of milk solids-not-fat, and not less than three and one-
fourth per cent (3.25%) of milk fat.
(b) FLAVORED MILK. Flavored milk is a beverage or confection
consisting of milk to which has been added a syrup or flavor made from ,
wholesome ingredients. The milk used shall contain 3.25% milk fat,
the word flavor can be omitted from the label, but the flavor shall
be indicated.
(c) MILK FAT OR BUTTERFAT. Milk fat or butterfat is the fat of milk.
(d) CREAM. Cream is a portion of milk which contains not less than
eighteen per cent (18%) milk fat, and the acidity of which is not more
than 0.20%, expressed as lactic acid.
(e) WHIPPED CREAM. Whipped cream is cream to which a harmless gas
has been added to cause whipping of the product. it may also contain
sugar, other harmless flavoring, and a harmless stabilizer.
(f) SOUR CREAM. Sour cream is cream the acidity of which is more
than 0.20% expressed as lactic acid, and is made of milk or cream of
a legal grade.
(g) HALF AND HALF. Half and half is a product consisting of a
mixture of milk and cream which contains not less than 11 .5% of milk fat.
(h) SKIM MILK.
(1) SKIM MiLK. Skim milk from which a sufficient portion of
milk fat has been removed to reduce its milk fat percentage to less
than 34%.
(2) MODIFIED SKIM MILK. Modified skim milk is a market milk
product made from Grade A skim milk containing not more than two
per cent (2%) milk fat by weight, to which has been added not more
than three per cent (3%) nor less than one per cent (1%) Grade A
non-fat milk solids by weight.

(3) NON-FAT MILK. Non-fat milk is a market milk made from skim
milk and contains not more than one-tenth of one per cent of milk
fat.
(4) MODIFIED NON-FAT MILK, Modified non-fat milk is a non-fat
milk to which has been added not more than three per cent (3%) nor
less than one per cent (1%) Grade A non-fat by weight.
(5) MODIFIED SKIM MILK OR MODIFIED NON-FAT MILK. Modified
skim milk or modified non-fat milk may contain added Vitamin A
and Vitamin D. When either of these vitamins are added they shall
be present in not less than the following amounts:
VITAMIN A -- 2000 USP Units per quart
VITAMIN D -- 400 USP Units per quart
(1) MILK OR SKIM MILK BEVERAGE. A milk beverage or skim milk
beverage is a food compound or confection consisting of milk or skim
milk, as the case may be, to which has been added a syrup or flavor
consisting of wholesome Ingredients.
(j) BUTTERMILK. Buttermilk is a product resulting from the
churning of milk or cream or from the souring or treatment by lactic
acid or other culture of milk or skim milk. It contains not less
than 8.25% of milk solids, not fat. It shall be made of milk or
cream of legal grade.
(k) CULTURED BUTTERMILK Cultured buttermilk is the product re-
sulting from the souring or treatment, by e lactic acid culture, or
milk or milk products. It contains not less than 8% of milk solids-
not fat, and shall be pasteurized before adding the culture.
Each type of buttermilk, according to the culture or process used,
shall bear on the package label the common or usual name used for such
product.
(1) YOGURT. Yogurt is a product resulting from the souring or
treatment by a specific culture of milk or skim milk. It contains not
less than 8.25% of milk solids, not fat. Yogurt may be in solid, semi-
solid or fluid form.
(m) FLAVORED DRINK OR FLAVORED DAIRY DRINK. Flavored drink, or
flavored dairy drink, is a beverage or confection consisting of skim
milk to which has been added a syrup or flavor and made from wholesome
ingredients.
(n) MILK PRODUCTS. Milk products shall be taken to mean and in-
clude cream, sour cream, homogenized milk, goat milk, vitamin D milk,
buttermilk, skim milk, reconstituted or recombined milk and cream,
milk beverages, skim milk beverages, and any other product made by
the addition of any substance to milk or any of these products and
used for similar purposes.
(o) PASTEURIZATION. The terms "pasteurization," "pasteurized,"
and similar terms shall be taken to refer to the process of heating
every particle of milk or milk products to at least 161 degrees
Fahrenheit, and holding at such temperature for at least 15 seconds
or to at least 145 degrees Fahrenheit, and holding at such temperature
for at least 30 minutes, or for the heating of every particle of ice
cream, ice cream mix, frozen desserts, ice milk mix to at least 155
degrees Fahrenheit, and holding at such temperature continuously for
at least 30 minutes, or flavored dairy drink or chocolate drink or
chocolate milk, or to at least 175 degrees Fahrenheit, and holding at
such temperature continuously for at least 25 seconds in approved
and properly operated equipment; provided, that nothing contained in
this definition shall be construed as disbarring any other process
which has been demonstrated to be equally efficient and is approved
by the State Health authority.
(p) ADULTERATED MILK AND MILK PRODUCTS. Any substance claimed to
be any milk or milk product defined in this chapter, but not conforming

with its definition as given in this ordinance or which carries a
grade label unless such grade label has been awarded by the health
officer and not revoked, shall be deemed adulterated and misbranded.
(q) MILK PRODUCER. A milk producer is any person who owns or
controls one or more cows, a part or all of the milk or milk products
from which is sold or offered for sale.
(r) GRADE A RAW MILK FOR PASTEURIZATION. Grade A milk for pasteuri-
zation is milk produced only on farms inspected and complying to Grade
A regulations as set by the Salt Lake City Board of Health.
(s) MILK DISTRIBUTOR. A milk distributor is any person who offers
for sale or sells to another any milk or milk products for human
consumption as such.
(t) DAIRY OR DAIRY FARM. A dairy or dairy farm is any place or
premises where one or more cows are kept, a part or all of the milk
or milk products from which is sold or offered for sale.
(u) MILK PLANT. A milk plant is any place, or premises, or estab-
lishment where milk or milk products are collected, handled, processed,
stored, bottled, pasteurized, or prepared for distribution.
(v) HEALTH OFFICER. The term "health officer" shall mean the
health authority of the City of Salt Lake or his authorized repre-
sentative.
(w) AVERAGE BACTERIAL PLATE COUNT, DIRECT MICROSCOPIC COUNT, AND
COOLING TEMPERATURE. Average bacterial plate count and average direct
miscroscopic count shall be taken to mean the logarithmic average,
and average cooling temperature shall be taken to mean the arithmetic
average, of the respective results of the last four consecutive
samples, taken upon separate days, irrespective of the date of grading
or regrading.
(x) GRADING PERIOD. The grade period should be such period of
time as the health officer may designate within which grades shall be
determined for all milk and milk products in this chapter, provided
,hat the grading period shall in no case exceed six (6) months.
(y) BACTERICIDE. The term "bactericide" shall be taken to mean
any bactericidal substance or process approved by the health officer.
(z) HOMOGENIZED OR VISCOLIZED MILK. Homogenized or viscolized
milk or cream is milk or cream that in addition to being pasteurized
has been treated in equipment approved by the Salt Lake City Department
of Health in such a manner to insure the break up of the fat globules
to such an extent that after 48 hours storage no visible cream separa-
tion occurs and the fat percentage of the top 100 cubic centimeter
of milk or cream in a quart bottle, or of proportionate volumes in
containers of other sizes does not differ by more than ten per cent
of itself from the fat percentage in the remainder of the bottle as
determined after a thorough mixing. The addition of a proportion of
homogenized or viscolized milk or cream to other milk to increase
the visible cream line is strictly forbidden. All homogenized or
viscolized milk or cream shall bear a label stating that the milk or
cream has been homogenized or viscolized together with any other
information required for pasteurized milk or for containers enclosing
milk and any milk products defined in this chapter.
(aa) RECONSTITUTED OR RECOMBINED MILK AND CREAM. Reconstituted
or recombined milk is a product resulting from the recombing of milk
constituents with water, and which complies with the standards for
milk fat and solids not fat of milk as defined herein. Reconstituted
or recombined cream is a product resulting from the combination of
dried cream, butter, or butter fat with c eam, milk, skim milk or water.
(bb) VITAMIN A MODIFIED SKIM MILK, OR MODIFIED NON-FAT MILK.
Vitamin A modified skim milk or modified non-fat milk to which Vitamin
A the content of which has been increased by a method in an amount
approved by the health officer and as is on file in his office.
(cc) VITAMIN D MILK. Vitamin D milk is milk the vitamin D content of
which has been increased by a method in an amount approved by the health
officer and as is on file In his office.
(dd) GOAT MILK. Goat milk Is the lacteal secretion, free from colo-
strum, obtained by the complete milking of healthy goats, and shall comply
with all the requirements of this chapter. The word "cows" shall be
interpreted to include goats.
(ee) EXTRA RICH OR PREMIUM MILK. Extra rich or premium milk is milk
as defined under Section 18-5-3 (a) with the exception that it shall
contain not less than 4% butterfat.
(ff) PERSON. The word "person" as used in this chapter, shall mean
"person, firm, corporation or association."
(gg) AND/OR. Where the term "and/or" Is used "and shall apply where
possible, otherwise "or" shall apply.
(hh) APPROVED. Means to be approved by the health officer of Salt
Lake City.
(il) SHALL. Wherever used in this chapter, is mandatory."
'Sec. 18-5-4. The sale of adulterated or misbranded or ungraded milk
or milk roducts ppr6Tbited. No person shaTT, within the—City of Salt-Cake,
or -TTs po ce urisdiction, produce, sell, offer or expose for sale, or
have in possession with intent to sell, any milk or milk product which
is adulterated, misbranded, ungraded, or not graded according to the pro-
visions of this chapter. It shall be unlawful for any person elsewhere than
in a private home, to have In possession any adulterated, misbranded or
upgraded milk."
"Sec. 18-5-5. Permits. (b) Such a permit may be revoked by the health
officer upon the violation by the holder of any of the terms of this chapter,
or in any emergency when, In the Judgment of the health officer, the milk
supply In question has become a public health menace, and/or the operator
has shown to be a persistent violator of sanitation items, provided that the
holder of said permit shall, after complying with such revocation, have the
right of appeal to the board of health."
"Sec. 18-5-6. Labeiing and placarding (a) All bottles, cans
packages and other containers enclosing milk or any milk product defined
in this chapter shall be plainly labeled or marked with:
(1) the name of the contents as given in the definitions of this
chapter;
(2) the grade of the contents;
(3) the word "pasteurization" if the contents are pasteurized;
(4) the phrase "for pasteurization" if the contents are to be
pasteurized;
(5) the name of the plant at which the contents are pasteurized; and
(6) In the case of Vitamin D milk, the designation Vitamin D milk,
and the source Vitamin D and the Vitamin D content, and shall
stipulate minimum daily requirements of Vitamin D. The name
of the producer or processor, and name and grade of the
contents shall be in solid block letters not less than 1/8
of an inch in height and shall be plainly legible and shall
contain no marks or words which are misleading or conflicting.
In case a hood or cover is used over a plug or other type cap
the wording on the under cap shall not be inconsistent with
the wording on the hood or cover.
(7) in the case of modified skim milk or modified non-fat milk,
the designation Vitamin A, and the source Vitamin A and the
designation Vitamin A and Vitamin content.
(b) All proposed caps, cap stocks, hoods, parchment paper containers,
single service, or otherwise, shall be approved by the Milk Division of
the Board of Health before such caps, cap stocks, parchment paper or container
is put into use. Sketches or drawings of such caps or containers shall be
submitted for inspection and approval before being used.

(c) Where milk is distributed by any person, firm, corporation,
or organization other than the processor or pasteurizer of such milk,
all bottles, cans, packages and other containers shall be plainly
labeled with the name of the processor or pasteurizer In letters
of equal size to those used to indicate the distributor, and shall be
located on the bottle, can, package, carton or other container in the
same relative location and position as the name of the distributor
appears on the product sold and distributed. In no case shall the
name, location of the distributor be featured more conspicuously
than is the name, location of the processor. All such labeling shall
be approved by the Board of Health and shall contain no marks, words,
illustrations or descriptive material not approved by the Board of
Health.
(d) All packages, cans, or containers used to transport raw milk
for pasteurization shall bear a label showing the name of the producer,
permit number and grade of the contents. Milk cans shall be labeled
with the above information plainly inscribed on a metal tag firmly
soldered on the shoulder of the milk can. The tag shall be of a size
and kind approved by the Board of Health and all letters shall not be
less than 1/8 of an inch in height.
(e) Every restaurant, cafe, soda fountain, or other establishment
serving milk or milk products shall display at all times in a place
designated by the health officer a notice prepared by the health officer,
stated the lowest grade of milk and/or milk products served."

"Sec. 18-5-8. The examination of milk and milk products. During
each grading periocTat least four samples off—milk and cream from each
dairy farm and each milk plant shall be taken on separate days and
examined by the health officer. Samples of other milk products may
be taken and examined by the health officer as often as he deems
necessary. Samples of milk and milk products from stores, cafes,
soda fountains, restaurants, and other places where milk or milk
products are sold shall be examined as often as the health officer may
require. Bacterial plate counts and direct miscroscopic counts shall
be made In conformity with the latest standard methods recommended
by the American Public Health Association. Examinations may include
such other chemical and physical determinations as the health officer
may deem necessary for the detection of adulteration, these examina-
tions to be made In accordance with the latest standard methods of
the American Public Health Association and the Association of Official
Chemists. Samples may be taken by the health officer at any time prior
to the final delivery of the milk or milk products. All proprietors of
stores, cafes, restaurants, soda fountains, and other similar places
shall furnish the health officer, upon his request, with the names
of all distributors from whom their milk and milk products are obtained.
Bio-assays of the Vitamin D content of Vitamin D milk shall be made
when required by the health officer in a laboratory approved by him
for such examinations.
Collform tests on pasteurized milk shall meet ail requirements of
the latest U. S. Public Health Code and Ordinance.
Whenever the average bacterial count, or the average cooling
temperature falls beyond the limit for the grade then held, the health
officer shall send written notice thereof to the person concerned,
and shall take an additional sample, but not before the lapse of
three (3) days, for determining a new average in accordance with
section 18-5-3(p). Violation of the grade requirement by the new
average or by any subsequent average during the remainder of the cur-
rent grading period shall call for immediate degrading or suspension
of the permit, unless the last individual result Is within the grade
limit."
"Sec. 18-5-11 . Grade A raw milk for pasteurization. Grade A raw
milk for pasteurization is raw milk TTUrn producer dairies conforming
with the following items of sanitation. The bacterial plate count
or the direct microscopic count of the milk as delivered from the farm
shall not exceed 100,000 bacteria per milliliter and the laboratory
pasteurized count not to exceed 5,000 bacteria per milliliter."

ITEM 1. COWS, TUBERCULOSIS AND OTHER DISEASES, ADULTERANTS.
(a) Except as provided,hereinafter, a tuberculin test of all herds and
additions thereto shall be made before any milk therefrom is sold, and
at least once every twelve (12) months thereaFter, by a licensed
veterinarian approved by the State Livestock Sanitary Authority. Said
tests shall be made and reactors disposed of in accordance with the
requirements approved by the United States Department of Agriculture,
Bureau of Animal Industry, for tuberculosis free accredited herds. .
A certificate signed by the veterinarian or attested to by the health
officer and flied with the health officer shall be evidence of the
above test: Provided, that in modified tuberculosis free accredited
counties in which the modified tuberculosis free accredited area plan is
applied to the dairy herds, the modified tuberculosis free accredited
area system approved by the United States Bureau of Animal Industry
shall be accepted In lieu of annual testing.
(b) From and after the adoption of this ordinance all milk produced
for pasteurization shall be from herds or additions thereto which have
been found free from Bang's Disease, as shown by blood serum tests
for agglutinins against Brucella abortus made in a laboratory approved
by a health officer and/or by a negative ring test approved by the
United States Department of Agriculture, Bureau of Animal Industry.
Said tests shall be made and reactors disposed of in accordance with
the requirements approved by the United States Department of Agri-
culture, for Bang's disease-free accredited area. In all cases reactor
cattle shall be removed from their respective herds immediately and
from the respective premises within fifteen (15) days. All such herds
shall be retested at least every six (6) months and all reactors
disposed of in accordance with the above requirements. Provided,
that cattle which have been vaccinated with an approved vaccine as
calves between the ages of four (4) and eight (8) months and which
react to the above test but are not producing milk, may be retained
in the herd until they are sixteen (16) months of age, at which time
they shall be tested and if they react shall be disposed of as required
above. A certificate identifying each animal by number, and signed
by the laboratory making the test, shall be evidence of the above test;
provided, that in modified Bang's disease-free accredited counties in
which the modified accredited area plan is applied to the dairy herds,
the modified Bang's disease-free accredited area system,"approved by
the United States Department of Agriculture, Bureau of Animal Industry,
in cooperation with the Utah State Department of Agriculture, shall
be accepted in lieu of required testing.
(c) A physical examination and brom-thymol blue test for bovine
mastitis shall be made on all lactating females in herds every sixty
days by a licensed veterinarian approved by the Board of Health of
Salt Lake City. All additions of lactating females to herds shall
be required to have a physical examination and a brom-thymol blue
test before being admitted to the herd. All reacting animals shall
be removed from the premises at once and shall not be re-admitted
until the animals are found free from disease.
(d) For disease other than tuberculosis, Bang's disease and mastitis,
such tests and examinations as the health officer may require shall be
made at intervals and by methods prescribed by him, and any diseased
animals, or reactors be disposed of as he may require.
(e) If after periodic test of producer sample, milk is shown to
contain antibiotics, or other adulterants, such producer shall be
immediately excluded from the Salt Lake Market, and re-instated only
after certification is given by a licensed veterinarian or laboratory
approved by the health officer to the effect that the product is
declared safe and negative tests are shown to prove the same.
ITEM 2. DAIRY BARN -- LIGHTING. (a) A dairy or milking barn shall
be required, and such sections thereof where cows are kept or milked
shall have at least four (4) square feet of window area for each
stanchion, properly spaced and the light well diversified. On new
construction and remodeling there shall be no obstruction of natural
light to the milking parlor by adjacent or contiguous buildings, or
by a low over-hanging roof on the outside, or by grain shafts set in
front of windows, or by any other obstruction on the inside.

Windows shall be repaired or replaced as needed. If hinged for
opening they shall be tight fitting and closed when necessary to protect
from wind and dust.
Artificial lighting must be provided for night and early morning
milking. This requirement shall be considered satisfied when all
portions of the barn are so lighted that cleaning and milking opera-
tions can be effectively performed.
ITEM 3. DAIRY BARN -- AiR SPACE AND VENTILATION. Such sections of
all dairy barns where cows are kept shall have at least four hundred
(400) cubic feet of air space per stanchion. Ceiling ventilators of
at least twenty-four by twenty-four inches (24"x24") or the equivalent
in variable shape and graduated to a shaft twelve inches (12") in
diameter extending through the roof, with a canopy or spinner set in
the top and properly screened to keep out birds and insects, shall
be provided. There shall be at least two (2) such ventilators evenly
spaced in any one milking barn.
ITEM 4A. MILK BARN -- FLOORS, DRAINAGE, ANIMALS. (a) The floors
and gutters of all dairy barns in which cows are milked shall be
constructed of concrete or other impervious and easily cleaned material
approved by the health officer.
(b) Floors and gutters shall be graded so as to drain properly.
The floor facing shall be at least fifteen (15") inches above surround-
ing ground level . On conventional type barns, waste drainage shall
be emitted through a vertical drain set at the low point of gutter and
piped under ground to the outside. Roof drainage shall not run into
corrals.
(c) No horses, pigs, fowl, calves, etc., shall be permitted in the
dairy barn or adjaeemt.thereto.within 50 feet thereof.
(d) Other portions of the barn shall be separated from the milking
portion such as grain rooms, maternity stalls, etc.
(e) No trash or unnecessary articles shall be allowed to accumulate
at any place in the milking parlor. Buckets, or grain feeding containers,
If kept in the parlor, shall be stored in an orderly manner and shall
not impede the cleaning of walls or floors.
ITEM 4B. FLOOR CLEANLINESS, GOOD REPAIR, SPECIFICATIONS AND
MEASUREMENTS. (a) The floors and contiguous area in which cows are kept
shall be cleaned after each milking.
(b) The floors and contiguous area in which cows are kept shall be
kept in good repair.
(c) Measurements it specifications -- conventional single row type.
Lengthwise, spacing shall be so arranged to be no less than TNTee
foot six inches (3'6") between each stall . Also, lengthwise, spacing
shall be so arranged to allow a passageway or barricaded area of at
least two (2') feet wide between the last cow and wall. Barricade
shall be of pipe of metal and shall extend from the stanchion line
to floor. Space at rear wall to gutter shall be at least six (6')
feet wide. Space on which cows stand shall be at least four foot ten
inches (4' 10") to five feet two inches (5'2") in width, depending
upon size of animal .
Trench gutters shall be required in all barns of this design and
they shall be no less than fourteen (14") inches wide and four (L4")
inches deep and have a uniform grade and depth of its entire length.
The curb at stanchion line shall be constructed of cement or other
impervious material at least six (6") inches wide and twelve (12")
inches high from the stall floor, and with corners rounded. Steel or
surfaced wood stanchions may be used. Lower horizontal members shall
be at least two (2") inches above stanchion curb. Stanchion posts
shall be anchored to top of curb by U-shaped strap iron anchors or
equivalent; wood sills are prohibited. Mangers when provided shall

be a minimum of two feet three inches (2'3") wide with a back wall at least
as high as the curb. The low point shall be eight (8") inches from the curb
and at least four (4") inches above the standing platform.
True lengthwise slope must be provided and a three (3") inch minimum
drain provided at the low point for cleaning.
The space between outside edge of stanchion wall and building shall be
regulated according to feeding system and need, but in no case shall it be
so restricted as to allow effacing or contact of the wall by the cow while in
a feeding position. It is also required that sufficient space be given to
allow ease of cleaning and maintenance of the wall.
The entire floor including the alleys, gutters, mangers, and curbs shall
slope lengthwise at least one (1") inch in ten (10') feet. The slope from side-
walls to gutter shall be at least one fourth (1/4") inch to one (1') foot of
width. The standing platform and rear walk-way shall be given a true even surface
with a wood float, or steel-trowell smoothed and finished with light broom
markings, the markings in all cases running toward the gutter.
The feed alley in single and two-string face-out barns shall be a minimum
of five feet nine inches (5'9") from stanchion line to wall.
Measurements and specifications for raised platform type barns. There shall
be a barred grill drain set at the rear of each cow, at least twenty-four by
twenty-four (24" x 24") inches in size or in variable shape of equal area. The
grill shall be so set as to properly deflect manure splash and eliminate waste.
In addition there shall be provided at least two (2) floor drains in the pit
area, with floor level graded thereto at a slope at least one-fourth (1/4") inch
to each foot (1') of distance. All drain lines leading to trunk line shall be
at least four (4") inches in diameter. The pit area in this type barn shall be
six (6') feet wide, the platform area on which cows are kept shall be six (6')
feet wide, the length of each stall shall be eight (8') feet or the equivalent
if cows are placed at an angle.
There shall be a concrete curb set on the pit-side edge of this type barn
at least four (4") inches wide and two (2") inches high.
In all barns of this type, a uniformly deep gutter eight inches wide, four
inches deep shall be provided along the wall away from the milkers pit.
ITEM 5. DAIRY BARN, WAIJS AND CEILINGS -- MEASUREMENTS. (a) The walls
and ceilings of all dairy barns shall be painted once every two years (2) and
more often if necessary, or finished in an approved manner.
(b) The walls and ceilings of dairy barns shall be kept clean and in good
repair.
(c) In case there is a second story above that part of the barn in which
cows are milked, the ceiling shall be tight. All doors shall be tight-fitting.
(d) If the feed room adjoins the milking parlor, it shall be separated
thereform by a dust-tight partition and door. All grain feeds shall be stored
in such manner as to prevent easy access, ingress or egress to rodents. No
open feed shall be stored in the milking portion of the barn.
(e) On all barn types, foundation walls shall extend upward at least
three feet six inches (3'6") above the top of floor and the junction of the
walls and floors shall be coved or rounded with a two (2") inch radius cove.
The distance from the top of floor to the platform shall be no less than
thirty (30") inches high.

Ceilings shall not be lower than nine (9') feet from the floor, except
in raised platform barns and ceiling should be at least seven (7') feet above
the platform. Ceiling height on all new construction of the conventional
floor-type barn shall be nine (9') feet.
The bottom half of all barn doors shall be covered with galvanized
metal or its equivalent on the inside. A water tap shall be located in
the barn to facilitate washing.
Feed storage rooms if provided shall be rodent and fly proof, partitioned
from milk barn proper, located at the barn-end away from the milkhouse, and
have a dust-tight door, if open, or if not so constructed . shall be at least
twenty-five (25') feet away from the milkhouse. Inside walls and ceilings
shall be constructed of concrete or other impervious material, smooth finished
and cleanable.
ITEM 6A. COW YARD, GRADING AND DRAINING. (a) All cow yards shall be
graded and drained for the proper disposal of waste. An adequate concrete
curbed platform and/or cow holding area shall be constructed outside the
barn entrance and exit with grade away from the barn. The size and shape
shall be determined according to size of herd, ground formation and drainage,
and shall be graded to a common point with run-off therefrom emitted through
an open gutter or other satisfactory waste water conductor to a point at least
one hundred (100') feet away from the dairy to such disposal as does not
create nuisance or pollution, Fence line and curbs surrounding this area
shall be so constructed as to afford ease of cleaning manure and pickup.
Other portions of the corral to be hard-surfaced shall be done hereafter
in the order prescribed and as individual conditions shall require: 1. Plat-
form in front of feed manger. 2. Around water troughs. 3. Passage-ways
between milking parlor, lounging shed and feed area. 4. The general corral
area.
(b) Cow yard shall be graded and drained and maintained to eliminate
standing pools of water or accumulation of organic wastes.
ITEM 6B. COW YARD CLEANLINESS. (a) The cow yard shall be kept clean
and the loose-housing area properly maintained. Cattle-housing areas
(stables, resting barns, holding barns, loafing shed, calf pens or wandering
sheds) shall be considered as part of the cow yard. Manure, soiled bedding,
and wasted feed may not be stored or permitted to accumulate therein, in such
manner as to permit the soiling of the cows' udders and flanks, nor be
maintained in such manner that the manure pack is not properly drained or does
not provide a reasonable firm footing for the animals. Lounging sheds or old
buildings converted into lounging sheds shall be open to the weather on at
least one side to afford ease of cleaning and allow ample natural light to the
area.
(b) Swine and fowl shall not be permitted in the cow yard or adjacent
area thereto.
ITEM 7. MANURE DISPOSAL. (a) All manure shall be removed and stored
ordisposed of in such manner as best to prevent the breeding of flies.
(b) Piled manure shall be stored at least fifty (50') feet from the
dairy barn and inaccessible to cows and if so piled during the fly season
it shall be treated with effective larvicides or insecticides and shall be
removed at any time it becomes a nuisance.
ITEM GA. MILK HOUSE OR ROOM, FLOOR CONSTRUCTION. (a) There shall be
provided a milk house or milk room in which the cooling, handling and
storing of milk and milk products and the washing, bactericidal treatment,
and storing of milk containers and utensils shall be done.
(b) The milk house or room shall be provided with a tight floor
construction of concrete or other impervious material and shall be kept in
good repair.

way between the milk house and the milking barn may be eliminated, provided
that a minimum distance of six (6') feet is maintained between the milk house
wall and the nearest milking stall or standing platform or litter gutter,
whichever applies; and further provide that cows are excluded from the milking
barn except during milking and any feeding while milking, is limited to concen-
trates. Any milk house doorway opening into the alleyway or barn shall be
equipped with a solid, self-closing door, opening outward from the milk house.
Milk house doord in the ouside walls may open inward if provided with self-
closing screen doors during the fly season. This alleyway should be opened
at both ends, but can be equipped with sliding or overhead doors, one end may
be fitted with openable windows occupying not less than the three-fourths
the alleyway width. The alleyway is intended to be kept open, doors and
windows are provided only as protection during storm and severe weather.
Compressors and milking machine units can be installed in the alleyway. Milk
room alleyway and milk barn can be constructed under one roof.
In two-room milkhouses one room shall be used for the cooling, handling
and storing of milk and cleaned utensils. The other room shall be a wash room
for washing, rinsing, and utensil sterilizing. Hot water heaters not creating
smoke, soot, or dust can be installed in the washroom, otherwise a boiler room
shall be provided. Gas and oil heaters must be vented to the outside.
ITEM BC. MILK HOUSE LIGHTING AND VENTILATORS: (a) The milk house shall
be well lighted and ventilated. At least ten (10%) per cent of the floor area
shall be in window space with openings to the outside on at least two sides of
the building, when possible.
(b) Ceiling vents not less than twenty-four by twenty-four (24" x 24")
inches or the equivalent in variable shape shafted to an appropriate roof
ventilator shall be provided.
(c) At least one wall ventilator shall be installed horizontally not
more than six (6") inches, nor less than three (3") inches above the floor
in the milk house. These ventilators shall be one (1) square inch in size
for each square foot of room floor area, metal jambed, have removable
screens, bottom vent openings sloped downward. Shutters may be installed.
ITEM HD. MILK HOUSE, SCREENING. (a) The milkhouse shall have all
openings effectively screened including outward-opening, self-closing,
tight-fitting doors, unless other effective means are provided to prevent
the entrance of flies.
ITEM 6E. MILK HOUSE: MISCELLANEOUS REQUIREMENTS. (a) The milk house
shall be used for no other purpose than those specified above except as may
be approved by the health officer and shall not open directly into a stable
or grain room or into any room used for domestic purposes. It shall have
water piped into it.
(b) The milk house shall be provided with adequate facilities for the
heating of water of a pressure type, the size and quantity to be regulated
by the type and size of operation, but sufficient for the proper cleaning
of utensils and building maintenance.
(c) The milk house shall be equipped with two-compartment stationary
wash and rinse vats of a size suitable to wash and sterilize all manually
cleaned equipment and an approved single compartment stainless steel vat of
a size and shape suitable to clean pipe line milking systems where they are
installed.
(d) There shall be provided a mixing tap and/or a mixing hose emanating
from the hot and cold water with a length of hose attached of sufficient
length to flush all parts of farm tank and floor.
(e) All wastes shall be properly disposed of including utensil washings
used strainer pads and other refuse.

ITEM 9. MILK HOUSE OR ROOM - CLEANLINESS FLY CONTROL. (a) The
floors, walls, ceilings and equipment of the milk house or room shall
be kept clean at all times, including the complete flushing and cleaning
of the floors after each milking.
(b) No trash or unnecessary articles shall be allowed to accumulate
in the milk house.
(c) All means neces ary for the elimination of flies shall be used.
Any type of fly control agent shall be used with caution and by approval
of the health officer.
ITEM 10. TOILET. (a) Every dairy farm shall be provided with one
or more sanitary toilets, conveniently located, and properly constructed,
operated, and maintained.
(b) When toilet rooms are located in or attached to the milk house or
milking parlor building, they shall be located so as not to contaminate
any water supply, and shall be plumbed, vented and attached tcl a septic
tank and dralnfield and be in accordance with Utah State Board of
Health Regulations,and the U. S. Public Health Ordinance and Code.
(c) Toilet rooms shall have no direct opening into a milking parlor
or milk house.
(d) All pit-privy toilets shall be built and located according to
Utah State Board of Health Regulations.
ITEM 11 . WATER SUPPLY. (a) The water supply for the milk room and
dairy barn shall be properly located, constructed, and operated, and
shall be easily accessible, adequate, and of a safe sanitary quality.
(b) It shall remain at the discretion of the health officer to check
all water supplies used in the washing, processing or cleaning of
dairy equipment and the standard of construction for the source supplies
shall be in conformity with the standard set by the Utah State Health
Department.
(c) Bacteriological examinations shall be made in conformity with the
standard methods recommended by the American Public Health Association.
ITEM 12. UTENSILS, CONSTRUCTION. (a) All multi-use containers or
other utensils used in the handling, storage, or transportation of
milk or milk products must be made of smooth non-absorbent material and
of such construction as to be easily cleaned.
(b) All milk equipment must be in good repair. Joints and seams
shall be soldered flush. Woven wire cloth shall not be used for straining
milk.
(c) All milk pails shall be of a small-mouth design approved by the
health officer.
(d) The manufacture, packing, transportation, and handling of single
service containers and container caps and covers shall be conducted in a
sanitary manner. All strainers shall be equipped with sterilized single
service filter pads.
(e) The construction and installation of pipe line equipment shall
comply in every detail to 3-A Sanitary Standards for Pipeline Milkers,
as required by the United States Public Health Service, including the
slope and fall for drainage as so set.
ITEM 13. UTENSILS, CLEANING. (a) All multi-use containers, equip-
ment and other utensils used in the handling, storage, or transportation
of milk or milk products must be thoroughly cleaned after each usage.
(b) Upon examination, equipment must be clean to the sight, touch
and smell or by such other methods as shall be employed.
ITEM 14. UTENSILS, BACTERICIDAL TREATMENT. (a) All multi-use

containers, equipment and other utensils used in the handling, storage,
or transportation of milk or milk products shall between each useage be
subjected to an approved bactericidal process with steam, hot water,
chlorine, or hot air. The sterilizing solution containing chlorine
shall be no less than 200 parts per million of available chlorine. Any
other chemicals and the required concentration, or any other processes
for sterilizing shall be used only on the specific approval of the
health officer.
ITEM 15. UTENSILS -- STORAGE. (a) All containers and other utensils
used in the handling, storage or transportation of milk or milk products
shall be stored so as not to become contaminated before again being
used.
(b) Storage racks and wall brackets should be constructed of metal and
so built and maintained to offer a minimum of contact surface to the
pouring lip of any multi-use milf'ing equipment, and set no less than
twenty-four (241 inches above the floor,
(c) Cotton discs and strainer gauze or in-line filters shall be stored
in original containers, In a clean, dust tight place.
(d) Utensils (including strainer disks, gaskets, inflations, parch-
ment papers, etc.) shall be stored in such manner and in such location
as to not be contaminated by any insecticides, drugs, or other toxic
substances.\
All anti-biotics, or medicants used for the treatment of animals or
other items of toxic nature shall not be stored on any shelf, or within
any cabinet installed in the milk house. Further, it is hereby required
that filter disks, or in-line parchment filters shall be stored separate
from any other item within or out of a storage cabinet and shall be so
protected to arrest the infiltration of moisture, dust and dirt, and be
stored in original containers.
ITEM 16. UTENSILS -- HANDLING. (a) After bactericidal treatment
no container or other milk or milk product utensil shall be handled in such
manner as to permit any part of the person or clothing to come in contact
with any surface with which milk or milk products come in contact.
ITEM 17. MILKING, UDDERS AND TEATS, ABNORMAL. (a) The udders and teats
of all milking cows shall be clean at the time of milking.
(b) The udders and teats shall be rinsed with an approved bactericidal
solution at the time of milking of a concentration recommended by the
health officer.
(c) Abnormal milk shall be kept out of the milk supply and shall be so
handled and disposed of as to preclude the infection of the cows and the
contamination of milk utensils.
ITEM 18. MILKING, FLANKS. (a) The flanks, bellies and tails of all
milking cows shall be free from visible dirt at the time of milking.
(b) All brushing shall be completed before milking commences.
(c) Udders, tail, and that portion of flanks adjacent to udders shall
be clipped in spring and fall . The extent of clipping at the flank shall
be dependent on the care and cleanliness of the animal .
ITEM 19. MILKERS' HANDS. (a) Milker's hands shall be clean, rinsed
with a bactericidal solution, and dried with a clean towel immediately
before milking. Should the milking operation be interrupted, the milkers'
hands must be again rinsed in the solution.
(b) Wet-hand milking is prohibited.
(c) Handwashing facilities shall be provided convenient to the line
of travel between the barn and milk house, and shall include vitreous china
bowl bowl attached to thewall with kat and cold running water under
pressure, soap, and single service towels. No person with an infected cut
or lesion on hands or arms shall milk cows, or handle milk or milk utensils.
ITEM 20. CLEAN CLOTHING. (a) Milers and milk handlers shall wear clean

outer garments while milking or handling milk, milk products, containers,
utensils, or equipment. No clothing or clothing change shall be kept
in the milk house or any place where utensils are kept, where milk is
stored, or where cows are milked.
ITEM 21 . MiLK STOOLS AND SURCINGLES. (a) Milk stools shall be kept
clean and shall be made of metal or other impervious material, and
shall be stored above the floor of barn or milking parlor when not in use.
(b) Surcingles shall be kept clean and stored above the floor.
ITEM 22. REMOVAL OF MILK. (a) Each pail or can of milk shall be
removed immediately to the milk house.
(b) Milk shall not be strained or poured in the dairy barn or milking
parlor from one container to another.
ITEM 23. COOLING AND/OR STORAGE TANKS. (a) Plans for installation
of dairy farm cooling tanks, with specifications must be approved prior
to installation. Construction, equipping, and installation of farm tanks
and farm tank equipment shall comply in every detail to 3-A Sanitary
Standards for Farm Holding and/or Cooling Tanks, as required by the
United States Public Health Service. Farm Holding and/or Cooling Tanks
equipped with either integral or refrigerated cooling surface shall be
furnished with sufficient cooling surface and refrigerating capacity to
immediately cool the milk of a normal milking to below 500 F, and to
hold milk in the tank at all times at or below 50° F. Compressors cannot
be installed in the milk house, unless enclosed and/or be an integral
part of the farm tank.
ITEM 24. VEHICLES AND/OR TANKERS, SURROUNDINGS, (a) Vehicles used
for the transportation of milk are to be kept clean, both inside and
outside. Complete rinsing, washing and sterilizing of all tankers, flexible
hose, pump, and valve or any other equipment related thereto or any other
container used in the transportation of milk shall be required before
re-use.
(b) The construction of tankers and pumping equipment shall comply in
every detail with 3-A Sanitary Standards, as required by the United States
Public Health Service. Pump and milk hose must be housed in a dust-proof
cabinet. The interior of the cabinet and hose holder tube must be of
smooth non-corrosive material . There shall be provided an enclosure of
sufficient size and height to afford the cleaning of tanker inside and
outside under shelter. The enclosure area shall be set on a curbed
concrete platform sloped to a drain, convenient to hot and cold water under
p ressure for tanker washing.
(c) No substances capable of contaminating the milk or milk products shall
be transported with it.
(d) The immediate surroundings of the dairy shall be kept neat and
clean, and free of rodent harborages and insect-breeding places.
(e) All vehicles used for the transportation of milk or milk products
shall have the name of the distributor, hauler organization or cooperative
prominently displayed on the vehicle.
(f) In all proposed new construction or major alterations, changes and
modifications to Grade A milk producing dairy units or buildings, plans
and specifications of the proposed construction, alteration, change or
modification shall be submitted to the Health Officer for written approval
thirty (30) days prior to such construction change or modification,
Sec. 18-5-12. Grade B Raw Milk. Brade B raw milk is raw milk which
violates the bacterial standard and/or temperature requirement for grade A
raw milk, but which conforms with all other requirements for Grade A raw
milk and has an average bacterial plate count of not exceeding 500,000 per
cubic centimeter and an average temperature not exceeding 60° Fahrenheit as
determined under Section 18-5-3. Grade B raw milk must be pasteurized and
must not be used in a Grade A processing plant unless under emergency, or
special permission of Health Officer.
Sec. 18-5-13. Grade C Raw Milk. Grade C raw milk is raw milk which
violates any of the requirements for Grade B raw milk and has an average

bacterial plate count of not exceeding 1,000,000 per cubic centimeter
and an average temperature of not exceeding 70 degrees Fahrenheit
as determined under Section 18-5-3 (p_. Grade C raw milk must be
pasteurized and must not be used in a Grade A processing plant unless
under emergency or special permission of Health Officer.
Sec. 18-5-15. Grade A Pasteurized Milk. Grade A pasteurized
milk is grade A raw milk which has been pasteurized, cooled, and placed
in the final container in a milk plant which conforms with the items
of sanitation described below. In all cases the milk shall show
efficient pasteurization as evidenced by satisfactory phosphatase test,
and at no time after pasteurization and before delivery shall the
milk have a bacterial plate count exceeding 20,000bacteria per cubic
centimeter, as determined in accordance with Section 6. Grade A
cream shall not have a bacterial plate count exceeding 40,000 bacteria
per cubic centimeter as so determined.
The grading of a pasteurized milk supply shall include the in-
spections of receiving and collecting stations.
ITEM 1. FLOORS. The floors of all rooms in which milk or milk
products are handled or stored, or in which milk utensils are washed,
shall be constructed of concrete or other equally impervious and
easily cleaned material, and shall be smooth, properly drained,
provided with trapped drains, and kept clean and in good repair.
ITEM 2. WALLS AND CEILINGS. Walls and ceilings of rooms in which
milk or milk products are handled or stored or in which milk utensils
are washed shall have a smooth, washable surface of masonry or tile
construction carefully installed. It shall be of light colored
surface and shall be kept clean and in good repair.
ITEM 3. DOORS AND WINDOWS. Unless other effective means are pro-
vided to prevent the access of flies, all openings into the outer air
shall be effectively screened and doors shall be outward opening and
self-closing.
ITEM 4. LIGHTING AND VENTILATION. All rooms shall be well lighted
and ventilated.
ITEM 5. MISCELLANEOUS PROTECTION FROM CONTAMINATION. The various
milk plant operations shall be so located and conducted as to prevent
any contamination of the milk or of the cleaned equipment. All means
necessary for the elimination of flies and rodents shall be used.
There shall be separate rooms for:
(a) The pasteurization, processing, cooling, and bottling
operations; and
(b) The washing and bactericidal treatment of containers and
equipment. Cans of raw milk shall not be unloaded directly into the
pasteurizing room. Pasteurized milk or milk products shall not be
permitted to come in contact with equipment with which un-pasteurized
milk or milk products have been in contact, unless such equipment has
first been thoroughly cleaned and subjected to bactericidal treatment.
Rooms in which milk, milk products, cleaned utensils, or containers
are handled or stored shall not open directly into any stable or
living quarters. The pasteurization plant shall be used for no other
purposes than the processing of Grade A milk and Grade A milk products
and the operations incident thereto, except as may be approved by the
health officer, which approval must be uniform to all plants.
ITEM 6. TOILET FACILITIES. Every milk plant shall be provided
with toilet facilities conforming with the ordinances of the City of
Salt Lake and recommendations of the State Board of Health. There
shall be at lease one room or vestibule not used for milk purposes
between the toilet room and any room in which milk or milk products
are handled or stored. The doors of all toilet rooms shall be self-
closing. Toilet rooms shall be kept in a clean condition, in good
repair, and well ventilated.
ITEM 7. WATER SUPPLY. The water supply shall be easily accessible,

adequate, and of a safe sanitary quality. It shall be constructed
and shall comply with the recommendations of the State Board of
Health.
ITEM 8. HAND-WASHING FACILITIES. Convenient handwashing facilities
shall be provided, including hot and cold running water under pressure,
soap and approved sanitary towels, such facilities must be provided
in lavatories and in the processing rooms. The use of a common towel
or other common article is prohibited. Bottle or can washing vats
shall not be used as washing facilities for the personnel . Durable
and legible signs shall be posted conspicuously in each toilet room
directing employees to wash their hands before returning to work.
ITEM 9. SANITARY PIPING. All piping used to conduct milk or milk
products shall be "sanitary milk piping" of a type which can be easily
cleaned. It shall be kept in good repair. The installation and
operation shall conform to the latest edition of Milk Ordinance and
Code, U.S. Public Health Service.
ITEM 10. CONSTRUCTION AND REPAIR OF CONTAINERS & EQUIPMENT. All
multi-use containers and equipment with which milk or milk products
come in contact shall be of smooth, impervious, non corrodible,
nontoxic material ; shall be so constructed and so located as to be
easily cleaned; and shall be kept in good repair. All single service
containers, closures, gaskets, and other articles used shall have been
manufactured, packaged, transported, and handled in a sanitary manner.
ITEM 11. DISPOSAL OF WASTE. All wastes shall be properly disposed
of. All refuse, trash, and garbage must be kept in covered water-
tight containers and containers shall be distributed through the plant
at points as shall be needed and the collected refuse disposed of in
a sanitary manner. In such plants where garbage storage rooms are
provided they shall be well ventilated, fly and rodent proof and kept
clean at all times. All plumbing and equipment shall be so designed
and installed to prevent contamination of the water supply and of
milk equipment by back-flow.
ITEM 12. CLEANING AND BACTERICIDAL TREATMENT OF CONTAINERS AND
EQUIPMENT. All milk and milk product containers and equipment, except
single-service containers, shall be thoroughly cleaned after each
usage. All such containers shall be subjected effectively to an
approved bactericidal process after each cleaning, and all equipment
immediately before each usage. When empty, and before being returned
to a producer by a milk plant each container shall be thoroughly
cleaned and subjected to an effective, approved, bactericidal process.
ITEM 13. STORAGE OF CONTAINERS AND EQUIPMENT. After bactericidal
treatment,all bottles, cans, and other multi-use milk or milk containers
and equipment shall be stored in such manner as to be protected from
contaminat;on. Clean bottles shall be in crates elevated above the
floor, cans and such other like equipment shall be stored cn racks,
preferably constructed of metal and protected against rusting.
ITEM 14. HANDLING OF CONTAINERS AND EQUIPMENT. Between bactericidal
treatment and usage and Luring usage, containers and equipment shall
not be handled or operated in such manner as to permit contamination
of the milk. Pasteurized milk or milk products shall not be permitted
to come in contact with equipment with which unpasteurized milk or
milk products have been in contact, unless the equipment has first been
thoroughly cleaned and effectively subjected to an approved bactericidal
process.
ITEM 15. STORAGE OF CAPS, PARCHMENT PAPER, AND SINGLE SERVICE
CONTAINERS Milk bottle caps or cap stock, parchment paper for milk
cans, single-service containers, and gaskets shall be purchased and
stored only in sanitary tubes, wrappings, or cartons; shall be kept
therein in a clean, dry place until used; and shall be handled in a
sanitary manner. Suitable cabinets are to be provided for the storage
of tubes or cartons after removal from the large outer box.

ITEM 16. PASTEURIZATION. Pasteurization shall be performed as
described in Section 18-5-3 (o) of this chapter. The time and
temperature charts shall be dated, initialed and preserved by the
operator for a period of 3 months for the information of the health
officer showing all products pasteurized and unusual occurrences,
cut-in cut-out temperature initial and pasteurized temperature initial .
ITEM 17. COOLING. All milk not pasteurized within two hours
after it is received at the plant shall then be immediately cooled
to a temperature of 50 degrees Fahrenheit or less and maintained
thereat until pasteurized, and all pasteurized milk shall be immediately
cooled to a temperature of 50 degrees Fahrenheit or less and main-
tined thereat until delivery.
Recirculated water and liquid refrigerants which are used In cooler
and regenerators shall be properly protected, and treated if necessary.
ITEM 18. BOTTLING AND PACKAGING. Bottling of milk and milk
products shall be done at the place of pasteurization in approved
mechanical equipment.
ITEM 19. OVERFLOW MILK. Over=flow milk or milk products shall
not be sold for human consumption.
ITEM 20. CAPPING. Capping of milk and milk products shall be
done In a sanitary manner by approved mechanical equipment. Hand-
capping is prohibited. The cap or cover shall cover the pouring lip
to at least its largest diameter. The milk of all bottles not
properly capped shall be re-pasteurized and/or processed and only
so done by permission from the health officer. Milk from broken
glass bottles shall be disposed of.
ITEM 21 . PERSONNEL, HEALTH. The health officer or a physician
authorized by him shall examine and take a careful morbidity history
of every person connected with a pasteurization plant, or about to be
employed, whose work brings him in contact with the production,
handling, storage or transportation of milk, milk products, containers,
or equipment. If such examination or history suggests that such
person may be a carrier of or infected with the organisms of typhoid
or paratyphoid fever or any other communicable diseases likely to be
transmitted through milk, he shall secure appropriate specimens
of body discharges and cause them to be examined in a laboratory
approved by him or by the State Health authorities for such examina-
tions, and if the results Justify, such person shall be barred from
such employment.
Such persons shall furnish such information, submit to such physical
examinations, and submit such laboratory specimens as the health
officer may require for the purpose of determining freedom from In-
fection. Health examinations shall be conducted annually.
ITEM 22. PERSONNEL, CLEANLINESS. All persons coming in contact
with milk, milk products, containers, or equipment shallwear clean
outer garments, such as caps, hair nets or suitable head covering
and shall keep their hands clean at all times while thus engaged.
ITEM 23. VEHICLES. (a) All vehicles used for the transporation
of Grade A pasteurized milk or Grade A pasteurized milk products in
their final delivery containers shall be constructed with permanent
tops, sides and back, which permit, if desired, doors of a size
necessary to pass the delivery man for loading and unloading purposes.
All vehicles shall be kept clean, and no substance capable of con-
tamination of milk or milk products shall be transported with Grade
A milk or Grade A milk products in such manner as to permit con-
tamination.
(b) All vehicles used for the transportation of Grade A pasteurized
milk or Grade A pasteurized milk products shall have the name of the
distributor prominently displayed thereon.
(c) Vehicles used for the transportation of milk are to be kept
clean, both inside and outside. Complete rinsing, washing and

sterilizing of all tankers, flexible hose, pump, and valve or any
other equipment related thereto or any other container used in the
transportation of milk shall be required before re-use.
(d) The construction of tankers and pumping equipment shall comply
in every detail with 3-A Sanitary Standards as required by the United
States Public Health Service. Pump and milk hose must be housed in
a dust-proof cabinet. The interior of the cabinet and hose holder
tube, must be of smooth non-corrosive material. There shall be pro-
vided an enclosure of sufficient size and height to afford the cleaning
of tanker inside and outside under shelter. The enclosure area shall
be set on a curbed concrete platform sloped to a drain, convenient
to hot and cold water under pressure for tanker washing.
(e) No substances capable of contaminating the milk or milk products
shall be transported with it,
(f) Where ungraded or unpermitted milk is hauled in the same vehicle
with permitted or graded milk, such unpermitted or ungraded milk shall
be placed In a separate compartment in such vehicle in such manner
as to prevent the raising of the temperature or contaminate the per-
mitted or graded milk. Such compartments in the vehicles shall be
constructed in compliance with the rules and regulations of the Board
of Health.
ITEM 24. SURROUNDINGS. The surroundings shall be kept clean and
neat and free from insect breeding and rodent harborages.
Sec. 18-5-16. Grade B Pasteurized Milk, Grade B pasteurized milk
is pasteurized milk which violates the bacterial standard for Grade
A pasteurized milk and/or the requirement that Grade A raw milk be
used, but which conforms with all other requirements for Grade A
pasteurized milk. It shall have an average bacterial plate count after
pasteurization and before delivery not exceeding 50,000 per cubic
centimeter, as determined under Sections 18-5-3 (w) and 18-5-8.
Sec. 18-5-26. Future dairies and milk plants. All dairies and
milk plants from wnlch milk or milk products are supplied to the City
of Salt Lake which are hereafter constructed, reconstructed, or
extensively altered shall conform In their construction to the re-
quirements of this chapter for Grade A dairy farms producing milk
for Grade A pasteurization plants. Properly prepared plans for all
dairies and milk plants which are hereafter constructed, reconstructed,
or extensively altered shall be submitted to the health officer for
signed approval before work is begun.
Sec. 18-5-29. Fees (a) All milk produced for use as or in market
milk, market cream;Tce cream, frozen milk and cream products by any
milk producer, dairy or dairy farm, regardless of grade which is
received by any milk distributor, milk plant, separator, handler,
bottler, processor or manufacturer, possessing a permit from the Salt
Lake City Board of Health shall be subject to the following fees:
I . Milk producers shipping to the Salt Lake City market and located
in the following counties: Tooeie, Salt Lake, Davis, Weber, Morgan,
Wasatch, Summit and Utah, shall pay one (1) cent for each hundred
pounds of milk so received; provided, that such fee collected from
each milk producer, dairy or dairy farm shall not in any one month be
less than two dollars ($2.00) or more than six dollars ($6.00).
2. Milk producers shipping to the Salt Lake City market and located
in the following counties: Box Elder, Juab, Sanpete, Cache, Duchesne,
Carbon and Emery, shall pay one and one-half (1-1/2) cents for each
one hundred pounds of milk so received; provided that such fee collected
from each milk producer, dairy or dairy farm, shall not in any one
month be less than Two and 50/100 ($2.50) Dollars nor more than Seven
and 00/100 ($7.00) Dollars.
3. Ail producers shipping from any area outside of the Abrementioned
counties shall pay two (2) cents for each one hundred pounds of milk

so received; provided, that such fee collected from each producer,
dairy or dairy farm, shall not in any one month be less than Three
and 00/100 ($3.00) Dollars nor more than Eight and 00/100 ($8.00)
Dollars.
(b) Said fees shall be collected or deducted by said milk dis-
tributor, milk plant, separator, handler, bottler, processor oF such
market milk or cream or by the manufacturer of such ice cream or other
frozen milk or cream products semi-monthly from monies due any such
producer, dairy or dairy farm, and shall be payable by said distributor,
milk plant, separator, handler, bottler, processor or manufacturer to
the Board of Health for deposit with the treasurer of Sait Lake City
on or before the 20th day of each calendar month covering the amount
of milk or cream delivered by each producer, dairy or dairy farm
during the preceding month; provided, that if any such distributor,
milk plant, separator, handler, bottler, processor or manufacturer
shall receive due notice from any such producer, dairy or dairy farm
to the effect that such producer, dairy or dairy farm refuses to pay'
said fee or to have thesame deducted from monies due him from the
sale of such milk or cream, said milk distributor, milk plant,
separator, handler, bottler, processor manufacturer shall within
twenty-four hours of receipt of such notification, advise the Board
of Health in writing of the action of said milk producer, dairy or
dairy farm, and the Board of Health shall upon receipt of such notice
immediately revoke the permit of said producer, dairy or dairy farm.
(c) Every producer, dairy or dairy farm shall at the time of
filing an application for a Grade A permit pay to the Board of Health
for deposit with the treasurer of Salt Lake City the sum of Fifteen
Dollars ($15.00) to defray the costs and expenses of the preliminary
Inspection by the Board of Health of the premises involved.
(d) The Salt Lake City Board of Health will not furnish milk
inspection to any milk distributing plant engaged in the processing,
pasteurizing or bottling of milk or milk products located more than
twenty (20) miles from the corporate limits of Salt Lake City. When
such milk distribution plant desires to market its products on the
Salt Lake City market they may apply to the Salt Lake City Board of
Health to enter into a reciprocal agreement with the local or State
Health Department maintaining inspection and supervision over such
a milk distributing plant. When the Salt Lake City Board of Health
determines such supervision or direction is adequate and comparable
to such inspectional services as are maintained by the Salt Lake City
Board of Health the Board of Health may, with the permission of the
City Commission, enter into such reciprocal agreement and permit the
products of such milk distributor to be sold within the Salt Lake
City limits.
(e) Milk receiving stations operated by milk distributors under
the supervision of the Salt take City Board of Health and located
more than twenty (20) miles from the corporate limits of Salt Lake
City shall be charged a fee of ten (10) cents per mile to the milk
receiving station and return to Salt Lake City and a per diem fee in
the amount of Eight ($8.00) Dollars when one employee of the Board
of Health is required for inspection work and Ten ($10.00) Dollars
per diem when two employees are required for inspection work. Such
fee is to be charged each time it becomes necessary to make an
inspectional visit to the collection station for the purpose of
inspections or the collection of milk samples. Such fee is not to
be charged when a representative of the Health Department travels to
the vicinity of the milk collection station only for the purpose of
making milk producer Inspections.
(f) Any fees thirty (30) or more days delinquent shall be subject
to a 10% penalty and for such legal fees and court costs as are
incurred in the collection of such fees and penalties.

(g) The Auditor of Salt Lake City shall have the right at any and
all reasonable times to audit the books of any plant, separator, bottler,
processor, distributor or producer referred to in this chapter.
Sec. 18-5-35. Ice Cream definitions and standards of purity. (a)
ICE CREAM. Ice Cream is a frozen dairy food made with pure, sweet milk, cream,
skim milk, condensed milk, condensed skim milk, dried milk, dried skim milk,
wholesome sweet cream, butter, pure milk fat, egg yolk, or any American made
egg yolk powder acceptable to the Health Department or any combination of such
products, with or without sweetening, and with or without the use of harmless
flavoring and coloring, containing not less than ten (10%) per cent by weight
of milk fat, and not less than twenty (20%) per cent by weight of total milk
solids, nor more than five-tenths of one per cent of pure, harmless edible
vegetable gum or gelatine. In no case shall any ice cream contain less than
one and six-tenths pounds of total food solids per gallon, and shall not weigh
less than four and five-tenths pounds per gallon.
(b) FRUIT ICE CREAM. Fruit ice cream is ice cream which contains not
less than eight (8%) per cent by weight of milk fat and not less than sixteen
(16%) per cent by weight of total solids, nor less than three (3%) per cent by
weight, of clean, mature, sound fruit or the juice thereof, with or without
the use of harmless flavoring and coloring and containing not more than five-
tenths of one per cent of pure harmless edible vegetable gum or gelatine.
(c) NUT ICE CREAM. Nut ice cream is ice cream which contains not less
than nine (9%) per cent by weight of milk fat and not less than twenty-six
(26%) per cent by weight of total solids, nor less than one (1%) per cent by
weight of sound, non-rancid nut meats, with or without the use of harmless
flavoring and coloring and containing not more than five-tenths of one per
cent of pure harmless edible vegetable gum or gelatine.
(d) ICE MILK. Ice milk is a frozen product containing less milk fat
than ice cream and made from pure milk and sugar, with or without harmless
flavoring and containing not less than four (4%) per cent of milk fat nor
less than fifteen (15%) per cent by weight of total solids and not more than
five-tenths of one per cent of pure, harmless edible vegetable gum or gelatine.
In no case shall ice milk contain less than one and three-tenths pounds of total
food solids per gallon.
1. No person shall use the name ice cream, cream, creme, creamy
or creamey or any word or phrase which may be construed to be
misleading in either labeling or advertising or in any other manner
either orally or written in connection with the advertising, sale or
distribution of ice milk.
2. All cartons, cups or other containers, except edible containers
in which ice milk is sold, shall be plainly labeled "Ice Milk" on the
side or top of the container. Such label shall be in bold-faced Gothic
type letters not less than 1/2 inch in height, and shall be placed in a
conspicuous position with respect to other printed matter or
illustrations that may appear on the container and shall not be obscured
in any way by such other matter.
3. All persons, or places or establishments where ice milk is sold
shall display at the point of sale, a sign or placard bearing the
statement "Ice Milk Sold Here." Such sign or placard shall be in bold
faced Gothic type letters not less than 1-1/2 inches in height and shall
be displayed in such a manner as to readily be seen and read by the
purchaser.
(e) ICE CREAM, BRICK OR PACKAGE. Ice Cream, brick or package shall be
composed of any one or more of the ice cream mixes hereinbefore defined as
ice cream, fruit ice cream, nut ice cream, or ice milk, and may contain water,
ice or sherbet, in portions of not more than one-half water, ice or sherbet,
to one-half ice cream.
(f) ICE CREAM, FROZEN CUSTARDS. Shall be manufactured and furnished
under the above general specifications for ice cream and shall have added

not less than two (2%)per cent of fresh egg yolks, or not less than four (4%)
per cent of fresh whole eggs, egg yolk or an American made egg yolk powder
acceptable to the Health Department.
(g) ICE OR ICE SHERBET. Ice or ice sherbet is a pure clean frozen
product made from milk products, water and sugar, with harmless fruit-or
fruit juice flavoring, and with or without harmless coloring, with not less
than zero point three five (0.35) of one (1) per cent of acid as determined
by titrating, with standard alkali, and expressed as lactic acid, and with
or without added stabilizer composed of wholesome edible material. It contains
not less than four (4) per cent by weight of solids.
(h) ICE CREAM MIX. Ice cream mix is the unfrozen mixture from which
ice cream or any other frozen milk or cream product is made.
No ice cream mix shall contain any boracic or salicylic acid, formaldehyde
or other chemical or preservative or any pathogenic bacteria.
No more than 50,000 living bacteria per cubic centimeter after
pasteurization shall be permitted in any ice cream mix, ice cream, frozen
desserts, other frozen milk or cream products of sherbet.
The bacteria count for the above ice cream mix, ice cream, frozen desserts,
ice cream products or frozen milk products, shall be based upon the average
for four (4) consecutive specimens or samples according to American Public
Health Association Standard and said ice cream mix, ice creamy,frozen desserts,
ice cream products or frozen milk products must be pasteurized by the method
prescribed in Section 18-5-3 of this chapter. It must at all times be transported
and handled under such temperature and conditions as to check bacterial growth
and prevent contamination.
Whenever the average bacterial count exceeds the logarithmic average of
50,000 bacteria per cubic centimeter, the health officer shall send written
notice thereof to the person concerned, and shall take an additional sample,
but not before the lapse of three (3) days, for determining a new average.
Violation of the requirement by the new average or by any subsequent average
shall call for immediate suspension of the permit, unless the last individual
result is within the 50,000 limit.
