AN ORDINANCE AMENDING Section 19-2-14 of the Revised Ordinances
of Salt Lake City, Utah, 1965, relating to filing date for holders
of old beer licenses and forfeiture of renewal rights.
Be it ordained by the Board of Commissioners of Salt Lake City,
Utah:
SECTION 1. That Section 19-2-14 of the Revised Ordinances of
Salt Lake City, Utah, 1965, relating to filing date for holders of
old beer licenses and forfeiture of renewal rights, be, and the same
hereby is, amended to read as follows:
"Sec. 19-2-14. Id. Filing date for holders of old licenses
and forfeiture of renewal rights. All applications to renew
licenses shall be filed by the holders of existing licenses
with the City License Assessor at least thirty days prior to
the expiration date of the then issued license. Said renewal
applications shall state whether or not the business is
presently operating and, if not, the date when it ceased daily
operation, together with such other information as the License
Assessor shall reasonably require to verify or determine the
status of said business. Any person who fails to file such
application within the time limit shall close his licensed
premises on the expiration date of the then issued license
and shall keep the said premises closed for the sale of beer,
until the date a new license is issued by order of the Board
of Commissioners of Salt Lake City. The foregoing notwith-
standing, a licensee has the right to renew said license
annually until revoked for cause or until said license is no
longer currently and actively used to operate a business
authorized by said license; provided, however, that said
license may be renewed after termination of the authorized
business activity during a licensing period for one additional
year, if the applicant certifies under oath that: (a) He is
not holding the license for speculative reasons, and (b) He
is actively seeking a purchaser for his business premises and
assets as above provided, or is actively seeking a new business
location for which he will seek a transfer of said license as
provided by law. No license renewal may be granted beyond one
year of inactive status as above provided; if not renewed,
said license shall expire."
SECTION 2. In the opinion of the Board of Commissioners it is
necessary to the peace, health and welfare of the inhabitants of Salt
Lake City that this ordinance become effective immediately.
SECTION 3. This ordinance shall take effect upon its first
publication.
