Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Section 19-2-17 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to the issuance of a new beer license upon purchase of business, be, and the same hereby is, amended to read as follows: "Sec. 19-2-17. Issuance of new license upon business purchased. If any licensee sells his place of business, together with the entire assets of said business, his license shall expire and be forfeited; provided, however that the purchaser of said place of business and its assets shall have a prior right to and be granted the license previously held by the vendor, if he complies with all requirements for its reissue and if he possesses the qualifications to obtain the license as provided in these Revised City Ordinances. Any prospective purchaser of assets and a business licensed pursuant to this chapter may petition the Board of Commissioners for a determination of his fitness and eligibility to be granted a license as herein provided. When such a determination is favorable to the petitioner, he shall thereafter be granted said license upon making application therefor and submitting to the Board of Commissioners proper proof of his purchase of said business assets and place of business, within sixty days after filing his original petition; provided, however,that no such license shall be issued to any applicant whose eligibility therefor shall have been terminated by the discovery of grounds for his disqualification subsequent to his original petition. The current license fee to be paid by such purchaser shall be payable in advance in the following amounts: (1) All of the required annual license fee, if such license is issued on or before September 30th of the license year hereinabove set forth. (2) Three-fourths of the required annual license fee, if such license is issued after September 30th and on or before December 31st. (3) One-half of the required annual license fee, if such license is issued after December 31st and on or before March 31st. (4) One-fourth of the required annual license fee, if such license is issued after March 31st and on or before -2- June 30th." SECTION 2. In the opinion of the Board of Commissioners of Salt Lake City,Utah, it is necessary to the peace, health and welfare of the inhabitants of Salt Lake City that this ordinance become effective immediately. SECTION 3. This ordinance shall take effect upon its first publication. Passed by the Board of Commissioners of Salt Lake City, Utah, this 4th day of June , 1974.
