AN ORDINANCE AMENDING Sections 14-1-13, 25-8-2, 25-8-3, 25-8-4, 25-8-6, 25-9-1, 25-9-2, 25-9-3 and 25-11-10(5) , of the Revised Ordi- nances of Salt Lake City, Utah, 1965, relating to the members of the combat division of the Salt Lake City Fire Department. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Sections 14-1-13, 25-8-2, 25-8-3, 25-8-4, 25-8-6, 25-9-1, 25-9-2, 25-9-3, and 25-11-10(5) , of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to members of the combat division of the Salt Lake City Fire Department, be, and the same hereby are, amended to read as follows: Sec. 14-1-13. Hours of work. Members of the Salt Lake City Fire Department regularly assigned to duty in the combat division shall not be required to work more than 122 shifts per year. A shift shall consist of 24 consecutive hours on duty at the firemen's assigned location of employment; provided, however, members off duty will be subject to call at any time in cases of emergency. The method of working such shifts shall be designated by the chief of the department, subject to approval by the board of commissioners of Salt Lake City. Fire- men who are required to work more shifts than required by their regular duty routine shall be compensated according to a schedule of overtime payment to be posted by the chief of the department after approval by the board of city commissioners. Sec. 25-8-2. Vacations for first partial year of employment. Every person who takes office or begins employment on or after . January 1st of any calendar year shall earn a vacation equal to one working day for each full month of employment from the date of employment to December 31st of such calendar year, but not to exceed 10 working days and provided, further, no person shall be entitled to any vacation unless such person completes the calendar year in the employment of Salt Lake City. Employees of the Salt Lake City Fire Department regularly assigned to duty in the combat division shall earn a vacation during the first partial year of employment based upon one duty shift off for each two months worked during the year from the date of employ- ment to December 31 of such calendar year but not to exceed five on duty shifts and provided further than no fireman shall be en- titled to vacation unless he completes a calendar year in the employment of the Salt Lake City Fire Department. -3- days sick leave each calendar year except members of the combat division of the fire department who shall be entitled to eight on duty shifts of sick leave each calendar year; provided that such leave may be taken only if, and during the period that such officer or employee is prevented by illness from discharging the duties required by his office or position of employment as certified in writing by the city personnel department nurse or by the licensed practicing physician attending such officer or employee, and provided further that no officer or full-time employee of Salt Lake City shall be entitled to the foregoing sick leave until he has completed six months of continuous employ- ment with Salt Lake City. Abuse of this privilege shall be grounds for dismissal by the head of the department. Sec. 25-9-2. Hospitalization. In addition to the sick leave authorized by Section 25-9-1, each officer and full-time employee of Salt Lake City shall be entitled to thirty(30) days hospitali- zation leave except for members of the combat division of the fire department who shall be entitled to 15 on duty shifts off for hospitalization leave each calendar year, provided that such leave may be taken only if, and during the period that, such officer or employee is actually confined to a hospital. Sec. 25-9-3. Accumulation of sick leave allowed. Authorized sick leave may be accumulated by any officer or employee from year to year provided that no officer or employee shall be entitled to accumulate more than ninety (90) days sick leave except members of the combat division of the fire department who shall be entitled to forty-eight on duty shifts off for sick leave. No accumulation of hospitalization leave shall be allowed. Sec. 25-11-10. Holidays. (1) The following days are hereby declared holidays for all employees on the regular monthly payroll of Salt Lake City. All such employees shall receive their regular rate of pay for each of the following unworked holidays: New Year's Day; Lincoln's Birthday; Washington's Birthday; Arbor Day; Memo- rial Day; 4th of July; 24th of July; Labor Day; Columbus Day; Veteran's Day; Thanksgiving Day; Christmas Day. (2) When any holiday listed above falls on Sunday, the follow- ing business day shall be considered a holiday. When any holiday listed above falls on Saturday, the preceding business day shall be considered a holiday. In addition, to the above, any day may be designated as a holiday by proclamation of the mayor, upon approval of the board of city commissioners. (3) Any employee on the regular monthly payroll of Salt Lake City who is required to work on any of the above named holidays shall receive his regular rate of pay for time so worked in addi- tion to his holiday pay or, at the discretion of his department head, shall be granted one compensatory day off from his regular work schedule for which said employee shall be compensated at his regular rate of pay and said employee shall be entitled to such compensatory time off within one month following the holiday so worked. Such compensatory time off shall be taken as directed by the head of the department at such time as would be most advanta- geous to the efficient operation of that department. (4) This section shall not apply to part-time and seasona'. employees. p -2- Sec. 25-8-3. Vacation for first eight full calendar years of employment. Every person who completes a full calendar year of employment shall earn a vacation of two weeks, exclusive of holidays except Saturdays and Sundays, except for members of the combat division of the fire department who shall be entitled to a vacation period of five on duty shifts, for the first eight consecutive full calendar years of employment. For the purpose of this section a "full calendar year of employment" shall be a year commencing January 1st and ending December 31st; provided, that the first year of employment shall be deemed a full calendar year if employment begins at any time during the month of January and continues throughout the calendar year. Sec. 25-8-4. Vacation for successive years after eight years of employment. After eight consecutive full calendar years of employment, every person who completes a consecutive full calendar year of employment thereafter shall earn a vacation of three weeks, exclusive of Saturdays and Sundays, except for members of the combat division of the fire depart- ment who shall be entitled to a vacation period of seven on duty shifts, exclusive of holidays. Sec.. 25-8-6. Vacation and termination benefits upon ter- mination. No officer azf employee shall be entitled to be paid any vacation or termination benefits if his termination is for cause, nor shall any resigning officer or employee be entitled to any vacation or termination benefit if he fails to give at least ten days' notice in writing of his contemplated resigna- tion to his department head. Every other person whose employ- ment is terminated for any reason during any calendar year shall be entitled to be paid for all earned vacation accrued and unforfeited but not taken, and in addition thereto shall be entitled to a termination benefit consisting of one day's pay for employees with less than 9 years of service and one and one-half day's pay for employees with 9 or more years of service, for each full month of employment completed prior to termination during the current calendar year, but not to exceed 10 days for employees with less than 9 years of service and not to exceed 15 days for employees with 9 or more years of service. Such vacation pay and termination benefits shall be considered to be severance benefits and shall not be used for the purpose of determining the average monthly compensation of the employee immediately prior to termination, Such sever- ance benefits shall be paid upon the termination of employment which shall be the last day of active service. Such benefits shall be paid to the employee or to his administrator, executor or surviving spouse at the election of the board of commissioners, in the event his termination is caused by death. Members of the Salt Lake City Fire Department regularly assigned to duty in the combat division shall receive benefits under this section based upon one shift's pay for members with less than 9 years of service and one and one-half shifts' pay for members with 9 or more years of service for each 2 months worked prior to termina- tion during the current calendar year. Sec. 25-9-1. Sick leave authorized. Each officer and full- time employee of Salt Lake City shall be entitled to fifteen -4- (5) Employees of the combat division of the Salt Lake City Fire Department in lieu of days off for the above enumerated holidays shall be granted six (6) on duty shifts off per year to be taken at such time as approved by the Fire Chief. SECTION 2. In the opinion of the Board of Commissioners it is necessary to the peace, health and welfare of the inhabitants of Salt Lake City, Utah, that this ordinance become effective immediately. SECTION 3. This ordinance shall take effect upon its first pub- lication.
