AN ORDINANCE Al/ENDING CHAPTER I of the Revised Ordinances
of Salt Lake City, Utah, 1944, relating to administration, by add-
ing in and to said Chapter a new section to be known as Section
143, relating to employee retirement benefits.
Be it ordained by the Board of Commissioners of Salt Lake
City, Utah:
SECTION 1. That Chapter I of the Revised Ordinances of
Salt Lake City, Utah, 1944, relating to administration, he and the
same is hereby amended by adding in and to said Chapter a new section
to be known as Section 143, relating .to employee retirement benefits,
which shall read as follows:
"SEC. 143. EMPLOYEE RETIREMENT BENEFITS. (a) All retire-
ment pensions now being paid retired. City employees and those
retirement pensions approved by the Board of City Commission-
ers prior to December 31, 1952, shall be, and continue jto be,
paid as provided under the present City Pension Retirement
system from funds provided for that purpose by Salt Lake City,
subject to the terms and conditions of this ordinance as is
hereinafter provided.
(b) All disability pensions now being paid and those ap-
proved by the Board of City Commissioners prior to December
31, 1952, shall continue to be paid as is provided by Section
137 of the Revised Ordinances of Salt Lake City, Utah, 1944•
(c) All disability pensions as provided by Section 137
of the Revised Ordinances of Salt Lake City, Utah, 1944, ap-
proved by the Board of City Commissioners after January 1,
1953, shall be reduced by the "primary insurance amount"
(single person benefilt) if and when earned under the Federal

Social Security Act, regardless of whether application has
been made therefor.
(d) Any employee, who, prior to January 1, 1953, has been
in the employ of Salt Lake City for a period of twenty (20)
years,or longer, shall be entitled to retirement benefits as
follows: If he has been an employee of the City for 20 years
prior to January 1, 1953, whether continuous or not, he may,
upon reaching the age of 60 years, at the option of the Board
of City Commissioners, or upon reaching the age of 65 years,
at his own option, or any employee who has been employed by
the City for 30 years prior to January 1, 1953, whether con-
tinuous or not, upon reaching the age of 60 years, may at his
own request, be retired from active service at any time after
January 1, 1953, and receive a monthly pension for the remain-
der of his life in an amount eqial to ono-half of his average
monthly wage or salary during the five years prior to January
1, 1953, as hereinafter computed, but in no event shall any
such pension exceed $100.00 per month. The average monthly
wage shall be computed as follows: The average yearly total
sum paid in wages or salary over the last five years of ser-
vice rendered to the City next preceding January 1, 1953, shall
be computed and one-twelfth of such average yearly sum shall
constitute the average monthly wage or salary hereunder.
(e) The pensions provided for in paragraph (d) of this
ordinance shall be reduced by the "primary insurance amount"
(single person benefit) if and when earned under the Federal
Social Security Act, regardless of whether application has
been made therefor.
(f) The pensions provided for in paragraphs (a), (b), (c)
and (d) of this ordinance shall be paid first from monies de-
ducted and remaining from the wages or salaries of the em-
ployees entitled thereto and paid into the City Pension Retire-
ment Fund, prior to January 1, 1953, and then from monies made
available for that purpose by Salt Lake City.
(g) No employee with less than 20 years' employment with

Salt Lake City prior to January 1, 1953, shall be entitled to
any of the benefits provided for in paragraph (d) of this
ordinance.
(h) Any employee of Salt Lake City with the required
years of service as set forth in paragraph (d) of this ordi-
nance shall, prior to February 15, 1953, exercise in writing,
one of the following options;
1. Elect in lieu of, and in full settlement of,
the benefits provided for in paragraph (d) of this
ordinance; to receive repayment of his contributions
into the Salt Lake City Pension Retirement Fund, less
the amount due from such employee for Federal Social
Security coverage, retroactive from December 30, 1952,
to January 1, 1951, or subsequent date of employment.
2. Elect to leave his contributions in the City
Pension Retirement Fund, less the amount due from such
employee for Federal Social Security coverage, retroactive
from December 30, 1952, to January 1, 1951, or subsequent
date of employment, and be eligible to receive the bene-
fits for which he qualifies under the provisions of Sec-
tion (d) of this ordinance, and, provided further, that
he may at any time prior to receiving any of such bene-
fits as provided in said Section (d) waive in writing
his rights to all of such benefits and receive repayment
of such amount as may be left to his credit in the City
Pension Retirement Fund.
(i) Any employee with the required years of service as
set forth in paragraph (d) of this ordinance, who elects to
leave his contributions in the City Pension Retirement Fund,

-ri3& , upon death, termination or discharge prior to receiving
any of the benefits as provided in paragraph (d), have refund-
ed to him, his beneficiary or personal representative, such
amount as may be left to his credit in the City Pension Retire-
ment Fund.
(i) Any employee of Salt Lake City with the required

years of service as set forth in paragraph (d) of this ordi-
nance, who elects to leave his contributions in the City Pen-
sion Retirement Fund as provided by paragraph (h) of this
ordinance and leaves the employ of the City for any reason
prior to reaching retirement age as provided in paragraph (d)
of this ordinance, may, upon reaching such retirement age as
provided herein, whether then in the employ of the city or
not, pay into the City Pension Retirement Fund the amount re-
funded to him as provided by paragraph (i) of this ordinance
and be restored to all retirement benefits he had at the date
of leaving the employ of Salt Lake City, as is provided by
paragraph (d) of this ordinance; provided, however, that such
benefits shall not exceed the difference between the amount
he would be entitled to under the provisions of paragraph (d)
of this ordinance and the amount of the "primary insurance
benefit" (single person benefit) of the Federal Social Security
Act; using as a base for computing the Social Security benefit
his earnings with Salt Lake City from January 1, 1951, to the
date of his first prior termination of employment with Salt
Lake City.
In no event, however, shall any monthly benefit provided
for by this paragraph (j) exceed Pifteen and 00/100 (;;15.00)
Dollars per month unless the employee is again in the employ-
ment of Salt Lake City on the date 4e becomes eligible for
such benefits.
(k) Any employee who is receiving or shall receive bene-
fits as provided by paragraphs (b), (c) and (d) of this ordi-
nance and who dies prior to receiving an amount equal to the
total left to his credit through his own contribution in the
Pension
City/Retirement Fund after any deductions provided for in this
ordinance shall be entitled to have refunded to his beneficiary
or personal representative such monies as may remain to his
credit in the City Pension Retirement Fund after deducting
the amount received by him in benefits while living.
(1) All employees with less than 20 years' employment
