ORDINANCE .
An ordinance amending Article 9 of an ordinance granting a fran-
ohise to the Citizens' Heating and Power Company, its successors and
assigns, passed by the City Council of Salt Lake City, Utah, September
18, 1905, and approved by the Mayor September 21, 1905, which fran-
chise was subsequently and on the lst day of September, 1906, assigned
to the Salt Lake Public Service Company, and duly approved by the
'City Council September 24, 1906; and repealing an ordinance amending
said Article 9 of said franchise, passed by the City Council November
12, 1906, and approved by the Mayor November 13, 1906.
Be it ordained by the City Council of Salt Lake City, Utah:
SECTION 1. That Article 9 of an ordinance granting a franchise
to the Citizens' Heating and Power Company, its successors or assigns,
passed by the City Council of Salt Lake City September 18, 1905, and
approved by the Mayor September 21, 1905, be, and the same is hereby
amended and changed so as to read as follows:
ARTICLE 9. It is further agreed upon and made a part of
this franchise that the Citizens' Heating and Power Company, its
successors or assigns, shall lay at least four (4) miles of steam
mains prior to October 1, 1908, or that part of this franchise
which partioularly specifies this right or oonoession in this
ordinance or franohise shall be forfeited by the Citizens'
Heating and Power Company, its successors or assigns; provided,
that the grantee in this franchise, its successors Sad assigns,
shall, on or before December 10, 1907, execute a bond to Salt
Lake City in the sum of twenty-five thousand ($25,000.00) dollars,
with surety, subject to the approval of the City Council, in
lieu of the bond heretofore given by said grantee, conditioned
as provided in Article 2 of the franchise to said grantee, passed
September 18, 1905, and approved September 21, 1905, and in lieu

of the bond heretofore given by the Salt Lake Public Service
Company, assignee of said Citizens' Heating and Power Company,

dated December 10, 1906, conditioned as provided in Article 9 of
said franchise, pursuant to an amendment of said Article 9 of
said franchise, passed by the City Council of Salt Lake City
November 12, 1906, and approved by the Mayor November 13, 1906.
SECTION 2. That an ordinance amending Artiole 9 of an ordinance
;granting a franchise to the Citizens' Heating and Power Company, its
successors and assigns, passed by the ,City Council-of Salt Lake City
;.November 12, 1906, and approved by the Mayor November 13. 1906, be,
and the same is hereby repealed; provided, that nothing in this re-
npeal shall be in any manner construed to release the principal and
surety in the bond dated December 10, 1906, and delivered in, pursu-
`anoe to the provisions of said Article 9 as amended as aforesaid,
from any liability thereon which may have heretofore arisen, or which
may arise before the exeoution, delivery and approval of the bond
mentioned in the preceding section; and until the execution, delivery
and approval of the bond mentioned in the preoeding section, tka
said bond, dated December 10, 1906, shall remain in full force and
, effect.
SECTION 3. This ordinance shall take effect upon approval.
