Green -- Min Mr. Chairman Result AN ORDINANCE AN ORDINANCE AMENDING SECTIONS 1510, 1512, 1513, 1514, 1615, and 1621,REVISED ORDINANCES of SALT LAKE CITY, 1920, relat- ing to the POLICE DEPARTMENT. BE IT ORDAINED by the Board of Commissioners of Salt Lake City, Utah: SECTION I. That Sections 1510, 1512, 1513, 1514, 1615 and 1521, Revised Ordinances of Salt Lake City, 1920, relating to the POLICE DEPARTMENT, be, and the same are, hereby amended to read as follows: Section 1510. ORGANIZATION and SALARIES. The Police Department of Salt Lake City shall consist of the following officers, whose salaries shall be as fixed by the Board of Commissioners, within the limits specified as follows: Chief of Police, who shall be head of the Police Department, not to exceed $3600.00. Inspector, with rank of senior captain, not to exceed $2700.00. Chief of Detectives, who shall report directly to the Chief of Police, not to exceed $2700.00. Three captains, each not to exceed $2000.00. Seven sergeants, each not to exceed $1740.00. Superintendent of Identification Bureau, not to exceed $1920.00. Secretary to the Chief of Police not to exceed $1600.00. } I [ at Lri Secretary to the Detective Dept. not to exceed $1620.0i. Patrolmen of the first grade not less than $1620 nor more than $1920.00. Patrolmen of the second grade not less than $1500 nor more than $1620.00. Patrolmen of the third grade not less than $1380 nor more than $1500.00. Matron, $900.00. Jailers, patrol drivers, motorcycle patrolmen, mounted policemen, members of the Anti-vice division, property clerk, detectives and detective sergeants shall be graded as patrolmen of the first, second and third grade. Section 1512. APPOINTMENTS. The Chief of Police shall, by and with the advise and consent of the Board of Com- missioners and subject to the roles and regulations of the Civil Service Commission, appoint from the classified Civil Service list furnished by the Civil Service Commission, all subordinate officers and employes in said Police Department. All sabordinate officers and employes in the Police Department shall be subject to removal from office or employ- ment by the Chief of Police, for misconduct, incompetency or failure to perform their duty or failure to observe and obey city ordinances, rules and regulations of the Civil Service Commission, or the rules of the chief of the department, subject to an appeal by the aggrieved party to the Civil Service Commis- sion. Any person discharged may, within five days of the order discharging him, appeal therefrom to the Civil Service Commissio,, which commission shall hear and determine the matter. The dis- charged person shall be entitled to appear in person and have counsel and a public hearing. The finding and decision of the Civil Service Commission upon said hearing shall be certified to the Chief of Police and shall be enforced and followed by him. In case the Civil Service Commission shall sustain the Chief of -2- Police such discharged person shall not be entitled to compensa- tion from and after the date of his discharge. In the event such discharge is not sustained, the Civil Service Commission shall determine, after hearing, whether such discharged person shall be entitled to full compensation from date of discharge to the date of reinstatement, or whether he shall be on suspen- sion without pay during said period, and also what, if any, demerit he shall receive. Section 1613. ASSIGNMENTS. The Chief of Police may assign any subordinate officer in the department to any duty which in his judgment the good of the service requires and may change such assignment from time to time whenever in his judg- ment the good of the service requires. Whenever assignments are intended for a period of thirty days or more, the Chief of Police shall report to the Board of Commissioners the names of such patrolmen as are assigned by him to the following services, to-wit: Detective Sergeants, detectives, Lieutenant in charge of Anti-vice Depart- ment, Anti-vice policemen and mounted policemen. Copies of such assignment shall be filed with the City Auditor and Secretary of the Civil Service Commission. Patrolmen, when acting in the following capacities under assignment for thirty days or more, shall be entitled to compensation in additional to regular c anpensation as patrolmen, to be determined by the Board of Commissioners, and not to ex- ceed the following: Detective Sergeants $25.00 per mo. Detectives 10.00 " " Lieutenant in charge of Anti-Vioe Division 10.00 " " Members of Anti-vice Division other than Lieutenant 5.00 " " Mounted policemen, for maintenance of mount 30.00 " " Section 1514. POLITICAL ACTIVITY. No person of the classified civil service of the Police Department shall -3- i I use his official position or authority to influence or coerce the political action of any person, nor be a member or delegate or alternate to any political convention, nor serve as a member of any committee of any political party, or take any active part in the management of any political campaign, nor solicit, collect or reoeive any assessment, subscription, contribution or dues intended or used for any political purpose whatsoever, nor shall he be obliged to contribute to any political fund or render any political service whatsoever. Section 1515. Civil Service Commission. The Mayor, by and with the consent of the Board of Commissioners, shall appoint a civil service commission to be composed of three members, one of whom shall serve until July 1, 1922, another to serve to July 1, 1924 and another member to serve until July 1, 1926. In the month of June, 1922, and every second year there- after one member shall in like manner be appointed for the term of six years to take the place of the member whose term shall next expire. In case of a vacancy, appointment shall be made in like manner for the unexpired term. Not more than two members of the Civil Service Commission shall at any one time be of the same political party. No member of the Civil Service Commission shall, during his tenure of office, hold any other public office nor shall he be a candidate for any other public office. Each member of the Civil Service Com- mission shall receive $5.00 for each meeting of said com- mission which he shall attend, provided that he shall not re- ceive more than $40.00 in any one month. Any member of the Civil Service Commission may be removed from office by the Board of Commissioners for misconduct, inability, or wiiLful neglect of duty and such member shall have opportunity to be heard in defense. The Civil Service Commission shall have full charge of all examinations and the making up of the classified civil service list from which appointments shall be made for position -4- `I 11 in the Police and Fire Departments and shall also review all cases of discharge from such departments by the head thereof, and shall make such rules and regulations as it may deem necessary for the carrying out of the powers conferred upon it by law. The Civil Service Commission may employ such ex- aminers as it may deem necessary at such compensation as the Board of commissioners may fix. Section 1521. PATROLMEN. Applicants without pre- vious experience in police service shall, after the probation- ary period, be appointed to the third grade only and may be promoted by the Chief of Police into the second grade after service of one year in the department, according to the rules of the Civil Service Commission. Applicants who, in addition to regular requirements, have served at least one year in the Salt Lake City Police Department or at least two years in police or detective service elsewhere, shall be appointed into the second grade after probationary period. Patrolmen, after serving continuously for at least one year in the second grade, may be promoted into the first grade, according to rules and regulations of the Civil Service Commission. SECTION II. In the opinion of the Board of Commissioner= it is necessary to the health, peace and safety of the inhabitants of Salt Lake City that this ordinance become effective immediately. SECTION III.
