Shearman Wells __— ( ✓ %�/ / Mr.Chairman Result AN ORDINANCE An ordinance granting the Ut(.h Light and Railway Company permission to run cars carrying mail, express, fruit, vegetables, dairy produce and other like matter, over its tracks laid on certain streets in Salt Lake City, and granting it a franchise to construct, maintain end operate a single or double track street railroad on Second West Street between Fourth South and Fifth South Streets. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That in consideration of the sum of money to be paid by, and the performance of end compliance with the terms, conditions and agreements hereinafter set out by the Utah Light & Railway Company, said Utah Light & Railway Company is hereby authorized and permitted to carry mail, express, fruit, vegetables, poultry, dairy produce and such other like mutter as may be offered to it for transportation from points outside of the limits of this city, or from the city to such outside points, upon and over its car lines on the following streets of this city, to-wit: Beginning where its car tracks enter the northern limits of the city on its Bountiful and Centerville line, thence southerly to Second Vest Street, south on Second Vest Street to First North Street, east on First North Street to Test Temple Street, south on Vest Temple Street to the company[e property between First Gig -1 • - South and. Second. South Streets. Also beginning where its car tracks enter the southern limits of the city on its Holliday and Cottonwood. line, thence in a north- erly direction to Tim&lfth South Street, north on Eleventh East Street to Ninth South Street, west on Ninth South Street to Westda1C' Temple Street, and north on rest Temple Street toA the company's property between First South and Second South Streets. Also from the southern limits of Salt Lake City where its tracks enter on State Street, thence north on State Street to Ninth South Street, west on Ninth South Street to rest Temple Street, and north on Test Temple Street toAthe company's property between First South and Second. South Streets. SECTION 2. That the cars to be used for the purpose stated in Section 1 of this ordinance, shall be closed cars of the same generalt style, finish4and appearance as the passenger care in use by said company at the same time, and so arranged as to entirely enclose all loaded matter. SECTION S. The said Utah Light & Railway Company is hereby / authorised to carry freight in carload lots over its car lines upon the following streets of the city, to�wit: Beginning where its tracks on its Holliday and Cottonwood line enter the southern limits of the city, thence in a northerly direction to Twelfth South Street, north on Eleventh East Street to Ninth South Street, west on Ninth South to rest Temple Street, north on ?'-est Tenple Street to Seventh South Street, lest on Seventh South Street to the company's west side car barns between Third West and Fourth rest Streets. Also from the southern limits of Salt Lake City on State Street north to Ninth South Street, west on Ninth South Street to West Temple Street, north on rest Temple Street to Seventh South Street, west on Seventh South Street to the company,Se west Side car barns between Third West and Fourth West Streets. 1 'JJw e/h V'2- Also from the northerly limits of Salt Lake City on what is known as the North Salt Lake line in a southerly direction along Fourth rest Street to Fifth North Street, thence east on Fifth North Street to Rhird Test Street, thence south on Third Crest Street to Second South Street, thence west on Second South Street to Rio Grand.o Avenue, thence south on Rio Grande Avenue to Fourth South Street, thence east on Fourth South Street to Second rest Street, thence south on Second Crest Street to Seventh South Street, thence west on Seventh South Street to the company's west side car burns between Third rest and Fourth rest Streets; and on such other routes as may be directed or authorized by the Board of Commissioners of Salt Lake City, Uteh. And to enable the said grantee to so transport freight on Second rest Street from Fourth South Street to Fifth South Street, a franchise is hereby granted. said Utah Light & Railway Company to construct, maintain and operate a. single or double track street railroad on said Second rest Street between Fourth South and Fifth South Streets, a distance of one block, the said franchise hereby granted being subject to ell the terms and conditions of franchises heretofore granted by Salt Lake City to said Utah Light & Railway Company. fi _ SECTION 4. (No—freight), express or mail cars shall be permitted to stand on any track or switch on any street longer than five minutes, nor shall any freight, express or mail matter be loaded or unloaded on any street within the city. SECTION 5. Salt Lake City reserves the right to regulate and control the speed of all cars of the Utah Light & Railway Company within the city limits, and nothing in this grant shall be construed to in any wise affect the exercise of the police power of the city for the safety and health of the people. SECTION 6. That in consideration of the granting of this franchise, the grantee agrees that it will enter into a contract -3- with Salt Lake City to furnish cars for and transport over such of its car lines as may be designated by the Board of Commissioners of Salt Lake City, sand, gravel, crushed. stone and other freight in car load lots for the use of the City for a charge not to exceed twenty (20) cents per cubic yard for all sand, gravel, crushed stone or other such material hauled four miles or less, and four (4) cents additional per cubic yard per mile for all such material hauled more then four miles; and for a charge not to exceed fifteen ', (15) cents per ton for other freight hauled four miles or less, and three (3) cents additional per ton per mile for other freight hauled more then :four. miles. SECTION 7. Nothing in this ordinance shall be construed to authorize or permit the grantee named herein, its successors or • assigns, to lay any new or additional tracks upon any of the streets mentioned herein, except as provided in Section(3 of this ordinance. SECTION $. That in further consideration for the granting of this franchise, the said grantee hereby agrees to pay into the City Treasury of Salt Lake City, on or before the 20th day of January of each year, the sum of twenty-five ( 25.00) dollars per car for each of its cars used in the transportation of such produce and express matter as is authorized by Section 1 of this ordinance, Ja.nra._for---ems- y 1 of its cars used in the transportation of freight matter as is 6 t authorized in Section 3 of this ordinance, for the preceding year;;` L.-- and that it will, on or before the 5th day of January of each year, furnish the Auditor of Salt Lke City a verified statement showing the number of cars used by it for the purposes aforesaid for the preceding year.
