Romney Tedesco Mr.Chairman . . -- �> AN ORDI N E Result AN ORDINANCE AMENDING CHAPTER XXX of the Revised Ordi- nances of Salt Lake City, Utah, 1944, pertaining to fire preven- tion, by amending Sections 3005, 3.010, 3014, 3019, 3024, 3056 by amending paragraph (a) thereof, 3061, 3062, 3064, 3066, 3067, 3074, 3081, 3082, 3094, 3111, 3115 by amending paragraph (h) thereof, 3116, 3118, 3131, and 3155, and repealing Sections 3068 and 3119 of said Chapter Y X. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Section 3005 of Chapter . 0 of the Revised Ordinances of Salt Lake City, Utah, 1944, pertaining to fire preven- tion, be and the same is hereby amended to read as follows: ',SEC. 3005. DANGEROUS AND DEFECTIVE STRUCTURES, FIRE HAZARDS. ORDER TO MAKE SAFE. -Whenever any building or struc- ture, or any portion thereof, or any appurtenances or fixtures thereto, or any chimney, smokestack, stove, oven, furnace, or or unsafe, thing connected with such building or premises is defective, and such defect or unsafe condition is such as to create a danger from fire, or to create a hazard to life, limb, or pro- perty in case of fire; or whenever there is a lack of or de- fect in fire escapes, •fire doors and/or exits, automatic or other fire alarm apparatus, standpipes and other fire extin- guishing equipment; or whenever the owner, lessee, agent, occu- pant or other person or persons having control or beneficial use of such building or structure, or part thereof, keeps or stores or permits to be kept or stored any explosive, combus- tible, flammable material, waste or rubbish of any description in such manner that the sale creates a danger from fire; or -2- whenever any other condition exists upon any premises or in any building or structure which will or does create a hazard from fire to life or property, the Fire Larshal or his deputy shall give the owner, agent, lessee or persons having control of such building, structure or premises not exceeding five (5 days notice of required changes, alterations or repairs neces nary to make the same safe to life and property from fire; ani any person or persons refusing or neglecting to begin within the specified time and diligently pursue to a satisfactory completion all such changes, alterations and repairs required by said notice shall be deemed guilty of a violation of this section." SECTION 2. That Section 3010 of Chapter XXX of the Revis ed Ordinances of Salt Lake City, Utah, 1944, pertaining to fire prr- hereby vention, be and the same isnamended to read as follows: "SEC. 3010. SIGNS ON BUILDINGS. It shall be unlawful for any person to construct or maintain any signs made of paper, muslin, cloth or other light flammable material on the outsid of any building or structure within the fire limits of Salt Lake City when it is determined by the Fire Marshal such sign•• create a fire hazard." SECTION 3. That Section 3014 of Chapter XXX of the Revis ed Ordinances of Salt Lake City, Utah, 1944, pertaining to fire pr.:— vention, be and the same is hereby amended to read as follows: "SEC. 3014. DEPOSIT OF ASHES, RECEPTACLES. It shall be unlawful for any person to deposit ashes, or cause the same to be deposited or placed, or permit or suffer the same to be in or remain in. any wooden vessel or receptacle, or in any vessel or receptacle composed or made of combustible material or any receptacle composed or made of any incombustible ma- terial which is located nearer than eighteen (18) inches to any woodwork, wooden floor or other combustible structure or material; or on the ground nearer than eighteen (18) inches to any wooden building or structure, wooden fence, lumber, -3- wood, hay, straw or other combustible material; or to place any combustible material whatsoever in a receptacle for ashes " SECTION 4. That Section 3019 of Chapter XXX of the Bevis ed Ordinances of Salt Lake City, Utah, 1944, pertaining to fire pr,- vention, be and the same is hereby amended to read as follows: "SEC. 3019. DECORATION OF PLACES OF AMUSEMENT, ASSEMBLAG, . The decoration of any store, dance hall, theater, school, church or other place of public amusement or assemblage or building where large numbers of persons gather or come together for any reason whatsoever shall be made only with fire-resis tive materials or with decorations which have been made flame proof by treating with an approved fire-retarding solution, of otherwise made safe from fire to the satisfaction of the Fire - Marshal. No decorations shall be placed nearer than six (6) inches to any lighting fixture. The use of coils or rolls of paper or other flammable materials which form ribbon-like strips when thrown or propelled through the air, con;monly known as 'serpentine,' is hereby prohibited in such places of amusement or public assemblage, and any person using or causirg decorations to be used contrary to the above provision shall be guilty of a violation of this section." SECTION 5. That Section 3024 of Chapter XXX of the Revis ed Ordinances of Salt Lake City, Utah, 1944, pertaining to fire pr.- vention, be and the same is hereby amended to read as follows: "SEC. 3024. MOTION PICTURE BOOTHS. Motion picture booths and the storage of film therein shall be in accordance with the Uniform Building Code, 1946 Edition, or amendments theret ." SECTION 6. That Section 3056 of Chapter XXX of the Revis ed. Ordinances of Salt Lake City, Utah, 1944, pertaining to fire pr=- vention, be and the same is hereby amended by amending paragraph (s) thereof, which shall read as follows: "(a) For the storage, use or handling of Class I liquids in any building occupied wholly or in part as a dwelling, apartment house, hotel, rooming house, convalescent home, hos -4- pital or similar occupancy; or in excess of five (5) gallons ' . within or outside of any other building, or occupancy." SECTION 7. That Section 3061 of Chapter XXX of the Revis- ed Ordinances of Salt Lake City, Utah, 1944, pertaining to fire pre vention, be and the same is hereby amended to read as follows: "SEC. 3061. STORAGE OF FLAMMABLES NEAR EXITS. No class I or II liquids may be stored within teh (10) feet of any stairway, elevator shaft or exit, except in a space separated from such stairway, elevator shaft or exit by at least a two- hour fire-resistive partition." - SECTION 8. That Section 3062 of Chapter XXX of the Revis- ed Ordinances of Salt Lake City, Utah, 1944, pertaining to fire pre- vention, be and the same is hereby amended to read as follows: "SEC. 3062. STORAGE LIMITED IN BUILDINGS. The storage of flammable liquids inside all buildings shall be as given under the following sub-sections; provided, however, that in a special storage room, conforming to the requirements of Section 3063, quantities stored shall be limited according to the order of the Fire Marshall: CLASS I. In approved sealed containers or safety cans of not more than one (1) gallon capacity and not ex- ceeding a total of five (5) gallons. CLASS II. In approved sealed containers or safety cans of not more than five (5) gallons capacity and in barrels, drums or tanks not exceeding sixty (60) gallons capacity. CLASS III. In approved sealed containers not exceeding five (5) gallons capacity, in barrels, drums or tanks not exceeding hne hundred twenty (120) gallons capacity, except as permitted in Section 3091." SECTION 9. That Section 3064 of Chapter XXX of the Revis- ed Ordinances of Salt Lake City, Utah, 1944, pertaining to fire pre- vention, be and the same is hereby amended to read as follows: "SEC. 3064. STORAGE OF CLASS I LIQUIDS. Except where kept in safety cans or sealed containers, Class I liquids sha .l -5- be kept in storage tanks underground or outside of the build- ing, and no discharge system shall have an outlet inside of the building, unless in a. special room in accordance with Sec,. tion 3063. Safety cans of not over five (5) gallons capacity may be used in any part of buildings where permitted. In public garages, repair shops and manufacturing plants, the Fire Marshal may permit the storage of Class I liquids in approved portable tanks or buggies of not more than sixty (60) gallons capacity. Such tanks shall be mounted on all-metal wheels with rubber tires, and when not in use must be kept near the entrance of the building, subject to the provisions of Section 3072. The reservoirs of motor vehicles shall be filled directly through hose from a pump attached to said portable tank and provided with a grounded shut-off nozzle." SECTION 10. That Section 3066 of Chapter XXX of the Revis- ed Ordinances of Salt Lake City, Utah, 1944, pertaining to fire pre- vention, be and the same is hereby amended to read as follows: "SEC. 3066. STORAGE OF BARRELS AND DRUMS LIMITED. Barrels and drums containing or having contained Class L, II or III liquids inside or outside of any building shall not be piled upon each other or stored in a passageway or beneath any win dow, and no open flames or open lights shall be permitted in any storage space." SECTION 11. That Section 3067 of Chapter XXX of the Re- vised Ordinances of Salt Lake City, Utah, 1944, pertaining to fire prevention, be and the same is hereby amended to read as follows: "SEC. 3067. MANUFACTURING PLANTS. All manufacturing plants located in a building in which persons are employed above the second story shall have all rooms, in which Class I and II liquids are mixed or stored in receptacles permitting the escape of vapor, constructed in accordance with Section 3063." SECTION 12. That Section 3074 of Chapter XXX of the Re- vised Ordinances of Salt Lake City, Utah, 1944, pertaining to fire prevention, be and the same is hereby amended to read as follows: -6- "SEC. 3074. OPEN FLAMES PROHIBITED. No gasoline, kerosene, flammable anti-freeze or any other flammable liquids may be stored, dispensed, handled or used in any room containing a stove, furnace, torch, forge or any other kind of open flame." SECTION 13. That Section 3081 of Chapter XXX of the Revis- ed Ordinances of Salt Lake City, Utah, 1944, pertaining to fire pre- vention, be and the same is hereby amended to read as follows: "SEC. 3081. UNDERGROUND STORAGE REGULATIONS. Tanks buried underground shall have the top of the tank not less than two (2) feet below the surface of the ground and below the level off any piping to which the tanks may be connected, except that, in lieu of the two-foot cover, tanks may be buried under twelve (12) inches of earth, over which is laid a cover of reinforced concrete at least five (5) inches thick and extending at least One (1) foot beyond the outline of the tank in all directions; concrete cover to be placed on a firm, well-tamped foundation. Rhere necessary to prevent floating, tanks shall be anchored securely or weighted. Where a tank cannot be buried entirely, it shall be covered with earth to a depth of at least two (2) feet, with a slope on all sides not steeper than one and one-. half (11) foot horizontal to one (1) foot vertical. Tanks shall be separated by at least one (1) foot. The storage of flammable liquids permitted shall depend upon the location of tanks with respect to the building to be supplied and adjacent buildings, as determined by a finding of the Fire Marshal.;'Tanks iocatea beneath a uuiLuinp shun be beiowall portions of that buiiainr." SECTION 14. That Section 3082 of Chapter XXX of the Revis- ed Ordinances of Salt Lake City, Utah, 1944, pertaining to fire pre- rention, be and the same is hereby amended to read as follows: "SEC. 3082. LOCATION OF ABOVE-GROUND TANKS. Above-ground tanks allowed under Section 3058 shall be spaced from adjoin ing property lines or a nearby building or builaings, at a aeterminea distanceto be safe by the Fire Marshal." SECTION 15. That Section 3094 of Chapter XXX of the Re- vised Ordinances of Salt Lake City, Utah, 1944, pertaining to fire. -7- prevention, he and the same is hereby amended. to read as follows: "SEC. 3094. ABANDONED TANKS. When any tank used for the storage of flammable liquids is abandoned,it shall be filled completely with sand or removed." SECTION 16. That Section 3111 of Chapter XXX of the Revis- ed Ordinances of Salt Lake City, Utah, 1944, Pertaining to fire pre- vention, be and the same is hereby amended. to read as follows; "SEC. 3111. TANK TRUCKS RESTRICTED ON STREETS. Except when given special permission by the City Commission, tank trucks or trailers making deliveries to storage tanks at ser- vice stations, garages and other places within the city shall be prohibited from traveling upon or crossing state Street, Main Street and West 'Temple on or between South Temple and Fifth South Streets, except that such trucks may travel on Fifth South Street or make deliveries by the most direct route to storage tanks within the prohibited area. These restrictions also shall apply to Twenty-first South Street between Ninth and Eleventh East Streets and to Eleventh East Street between Hollywood and Simpson Avenues. No tank truck or trailer what- soever, while carrying flammable liquids, shall be allowed on the viaducts spanning railroad properties on Fourth South and North Temple Streets, or on Main Street or State Street between South 'Temple and Second North Streets, or on Twenty-first South Street between Eleventh and Thirteenth East Streets. Interstate and intrastate tank trucks and trailers entering Salt Lake City from the north shall continue on Deck Street and Second West Street until they pass the city limits on the south or alter their routes to the west. Such vehicles approaching the city from the south or east must swing over to Second West before entering the city limits and remain on Second West and Beck Streets until they leave the north bounds of the city or alter their routes to the west. At no time will any such loaded tank truck or trailer be allowed east of Second West Street within the city limits,except by permission of the City Commission." SECTION 17. That Section 3115 of Chapter XXX of the Revis4 -8- ed Ordinances of Salt Lake City, Utah, 1944, pertaining to fire pre- vention, be and the same is hereby amended by amending paragraph (h) thereof, which shall read as follows: "(h) No gasoline shall be allowed to remain in any open can or receptacle of any kind. in or about any building." SECTION 18. That Section 3116 of Chapter XXX of the Revis- ed Ordinances of Bait Lake City, Utah, 1944, pertaining to fire pre- vention, be and the same is hereby amended to read as follows: "SEC. 3116. LIQUEFIED AND COMPRESSED GASES. The storage, handling and use of compressed or liquefied petroleum or simi- lar flammable gases, other than acetylene, shall be in accord- ance with the standards of the National Board of Fire Under- writers for the design, installation and construction of con- tainers and pertinent equipment for the storage and handling of liquefied petroleum gases as recommended by the National Fire Protection Association known as Pamphlet No. 58 of the Standards of the National Board of Fire Underwriters, publish- ed in pamphlet form in January, 1947, and all amendments there- to, three copies of which pamphlets and all amendments thereto have been filed with the City Recorder of Salt Lake City." SECTION 19. That Section 3118 of Chapter XXX of the Revis- ed Ordinances of Salt Lake City, Utah, 1944, pertaining to fire pre- vention, be and the same is hereby amended to read as follows: "SEC. 3118. NOT ALLOWED IN CERTAIN BUILDINGS. No part of any building hereafter erected or of any existing building which is used as ti hotel, apartment house, rooming house or lodging house, shall be used as a public garage, repair shop or service station, unless such garage, repair shop or service station is separated therefrom by an occupancy separation as specified in the Uniform building Code." SECTION 20. That Section 3131 of Chapter XXX of the Revis- ed Ordinances of Salt Lake City, Utah, 1944, pertaining to fire pre- vention, be and the same is hereby amended to read as follows: "SEC. 3131 FIRE SEPARATION. Any shop in which the appli- cation of paints, lacquers or other flammable finishes is per; -9- formed by means of spraying or dipping in buildings used whol- ly or in part as dwellings or other occupancies shall be separated from other portions of such buildings as required by the Uniform Building Code." SECTION 21. That Section 3155 of Chapter XXX of the Revis- ed Ordinances of Salt Lake City, Utah, 1944, pertaining to fire pre- vention, be and the same is hereby amended to read as follows: "SEC. 3155. EXITS TO BE INDICATED. All exits in theaters, hotels, dance halls, stores, schools, churchesj.or in any other binding used for amusement or public assemblage, or where large numbers of persons gather or come together for any reason whatsoever, shall be marked conspicuously with signs illuminat- ed from behind or within and bearing the words "EXIT" or "EMER- GENCY EXIT" as the case may be. Such signs shall have white letters on a green field or red letters on a white field not less than five (5) inches high and shall be provided not only at the exit or exits but at other points in the building wher- ever necessary to indicate clearly the direction of egress. It shall be the duty and responsibility of the owner, manager, lessee, agent, occupant or person having control or beneficial use of such building to maintain such signs and illuminate them or cause them to be illuminated during all times that the building is used or occupied; provided, that the main doorway to such buildings need not be indicated as herein described if such doorway is easily accessible and clearly visible." SECTION 22. That Sections 3068 and 3119 of Chapter XXX of the Revised Ordinances of Salt Lake City, Utah, 1944, pertaining to fire prevention, be and the same are hereby repealed. SECTION 23. In the opinion of the Board of Commissioners, it is necessary to the peace, health and safety of the inhabitants of Salt Lake City that this ordinance becomes effe 've immediately. SECTION 24.
