AN ORDINANCE
AN ORDINANCE AMENDING SECTION 18-h-b of the Revised Ordinances of Salt Lake City,
1955, by adding provisions regulating miscellaneous food handling establishments such
as bottling plants, grocery stores, meat and fish markets, bakeries, candy factories
packing,
or other similar establishments used for the manufacture,/packaging, storage, sale,
processing or distribution of any food products.
Be it ordained by the Board of Commissioners of Salt Lake City, Utah.
SECTION 1: That Section 18-4-4 of the Revised Ordinances of Salt Lake City,
1955, relating to inspection of food products for home consumption, be, and the same
is hereby amended, by adding provisions regulating miscellaneous food handling estab-
lishments such as bottling plants, grocery stores, meat and fish markets, bakeries,
candy factories or other similar establishments used for the manufacture, packaging,
packing, storage, sale, processing or distribution of any food products, which section
as amended shall read as follows:
"Sec. 18-h-h. Permit. Inspection Fee. (1) It shall
he unlawful for any person to engage in the mann-
facture or sale of any food products for human
consumption', without first obtaining a permit from
the board of health of Salt Lake City, and paying
for and obtaining the license required by the
provisions of Title 20 of the Revised Ordinances
of Salt Lake City. An inspection fee of one dollar
c shall be charged for each permit issued. Such per-
mit shall be presented with the application for a
license to conduct such business, and no such
license shall be issued unless accompanied by such
permit.
(2) (a) It shall be unlawful for any person to
conduct the business of bottling plant, grocery
store, meat market, bakery, candy factory or other
• similar establishment used for the manufacture,
packing, packaging, storage, sale, processing or
distribution of any food product without first .
obtaining a permit from the board of health of
•
Salt Lake City, and paying for and obtaining the
license required by the provisions of Title 20
of the Revised Ordinances of Salt Lake City. An
inspection fee of one dollar shall be charged for
each permit.

"(b) Application therefor shall be made
to the license assessor and collector showing
the location and kind of food establishment to
be operated. Upon receipt of such application,
the license assessor and collector shall refer
said application to the Health Department, where-
upon the City Health Commissioner or his authorized
representative shall make an inspection of the
premises and if the premises are found to be in
compliance with the city ordinance and the rules
and regulations of the Health Department a permit
may be issued by the Health Department to conduct
such a business. In the event the premises are
not in satisfactory compliance with the Salt Lake
City ordinances and the rules and regulations of
the Health Department, no such permit shall be
issued.
"(c) In no case shall the license assessor
and collector issue a license to Conduct such a
business until such time as a permit is issued by the
Health Department. Such a permit issued may be
suspended or revoked by the Health Officer upon
the violation by the holder of any of the terms
of this ordinance. ',Then in the opinion of the
health officer there has been a failure on the
part of the permittee to observe the sanitary rules
and regulations as adopted by the Health Department,
such permit shall be revoked, such revocation to
take place thirty (30) or more days after written
notice by the health officer to the_permittee
advising the permittee of the contemplated act and
setting forth the reason. The permittee shall
he further advised of his right to request a hear-
ing before the Board of Health at any time
during the thirty (30) days prior to the revoca-
tion of permit. ',Then in the opinion of the
health officer there exists an emergency which
may endanger the public health or safety, the
health officer is empowered to declare such an emergency
and immediately suspend any or all such permits
as may be required, and this without a hearing or
prior notice. The operation of any such business
without having in full force and effect a permit
from the Health Department to operate shall be in
violation of the ordinance and if such unlawful
operation is conducted it shall be construed as a
separate violation, for each day that such operation
continues.
"(d) Applicants proposing to build now buildings
or facilities or proposing to rake any major alteration
of food handling establishments roust submit plans and
specifications for such building, facilities or
alterations to the Health Department, and such new
buildings, facilities or major alterations shall be
built in compliance with the Salt Lake City ordinances,
and the rules and regulations of the Health Department.
The Health Department may make and enforce rules and
regulations to provide sanitary standards with respect
to the following items and to better administer the
terms of this ordinance.

"(e) It shall be the duty of the Health
Commissioner or his authorised representative to visit
and inspect all such food establishments for the purpose
of determining the sanitary conditions existing therein
and all such inspections shall be recorded in duplicate,
one copy of which shall be conspicuously posted and
maintained by the proprietor or on an inside wall of the
food establishment and the other copy shall be filed
with the Health Department. For the purpose of
determining the sanitary conditions of all such food
establishments, the Health Commissioner shall use as a
guide, the following items, each of which be known as
an item of sanitation; provided, however, that the
enumeration of such items shall not be construed as a
limitation to the general powers and duties of the
Health Commissioner to inspect and regulate food
establishments in the interest of public health and
sanitation,
"Item 1. Floors. The
floors of all rooms in which food or
drink is stored, prepared or handled
or in which utensils and equipment
are washed, shall be kept clean and in
good repair. The floors of all rooms in
which food or drink is prepared or handled
shall be of smooth impervious material
and must be kept clean and in good repair.
"Item 2. Walls and Ceilings.
Walls and ceilings of all rooms in which
food or drink is stored, prepared or
handled shall be kept clean and in good
repair. The rooms in which food or
drink is prepared or handled shall be
of a smooth washable surface and shall
be of light colored finish.
"Item 3, Doors and Windows.
Openings into the outer air shall be
effectively screened and doors shall
be self-closing, unless other effective
means are provided to eliminate flies
or prevent their access.
"Item L. Lighting. All rooms
or places in which food or drink is
prepared, cooked, mixed, baked, exposed,
bottled, packed, handled, stored, manu-
factured, offered for sale, or sold,
shall be properly and adequately lighted
so that all parts thereof may be readily
inspected.
"Item 5. Ventilation. All
places in which food or drink is prepared,
cooked, mixed,baked, bottled, packed,
handled or manufactured shall be provided
with ventilating hoods and ducts or with
other mechanical moans to carry off into
the outer air, any steam, gasses, odors,
vapors, dust and excessive heat, that may
be generated in the process of cooking
or baking, so as to render same harmless
to persons working therein.
"Item(!... Toilet facilitiee .
2very food establishment shall be provided with
adequate toilet facilities for its employees
and shall conform with all laws of the Utah

State Industrial Code and Salt Lake City Plumbing
Code. In food establishments hereafter constructed
toilet rooms shall not open directly into any room
where food, drink, or utensils are handled or stored,
The doors of all toilet rooms shall be self-closing.
Toilet rooms shall be kept in a clean condition,
in good repair, and well lighted and ventilated.
Hanlwashing signs shall be posted in each toilet
room used by employees.
"Item 7. 'rater Supply. Hot and cold
running water under pressure shall be accessible
to all rooms in which food or drink is prepared or
utensils are washed, and the water supply shall be
adequate, and of a safe sanitary quality. _
"Item 8. Lavatory Facilities.
Adequate and convenient handwashing facilities
shall be provided including hot and cold running
water, soap, and approved sanitary towels. The
use of a common towel is prohibited. No employee
shall resume work after using the toilet room
without first washing his hands.
"Item 9. Construction of Utensils and
Equipment. All utensils, show and display cases,
windows, counters, shelves, tables, refrigerating
equipment etc. used in connection with the oper-
ation of a food establishment shall be constructed
so as to be easily cleaned and shall be kept in
good repair. The using or keeping of any utensil
which is badly worn, rusted, corroded, or in such
condition that it cannot be readily rendered
clean and sanitary by washing, is prohibited.
Utensils containing or plated with cadmium or
lead shall not be used; provided, that solder
containing lead shall not be prohibited for
jointing. The tops of tables, counters, benches
and blocks shall he so constructed as to render
thesame non-absorbent and free from cracks and
crevices. Slicer and grinder bench tops and
drainboards shall be of metal or other non-
absorbent materials, approved by the health
officer.
"Item 10. Cleaning and Bactericidal
Treatment of Utensils and Equipment. All
equipment, including display cases or win-
dows, counters, shelves, tables, refrigera-
tors, stoves, hoods and sinks, shall be kept
clean and free from dust, dirt, insects and
other contaminating material. All cloths and
towels used by employees shall be clean.
Utensils, bottles and other containers
used in food establishments shall be properly
cleaned with hot water and soap or other suit-
able detergent and sterilized with live
steam, hot water, a chemical solution or a
caustic alkali solution of sodium hydroxide
as approved by the Health officer. No
article, polish, or other substance containing
any cyanide preparation or other poisonous
material shall be used for the cleaning or
polishing of utensils.

"Item 11. Storage and Handling of
Utensils and Equipment. Utensils, bottles
and containers which have been properly
cleansed and sterilized must be stored,
kept and handled as to prevent recontamina-
tion of them by dust, dirt, flies and other
sources. Where it is deemed necessary by
the Health Department, vats, tanks, hoppers,
mixing machines and other equipment shall
he provided with suitable covers and kept
covered.
"Item 12. Disposal of Wastes. All
wastes shall be properly disposed of, and
all garbage and trash shall be kept in
suitable receptacles in such manner as not
to become a nuisance. All plumbing shall
comply with the Salt Lake City and Utah
State plumbing, ordinances.
"Item 1.3. Refrigeration. All
readily perishable food and drink, except
fruit and vegetables, shall be kept at or
below 50°F. except when being prepared.
Waste water from refrigeration equipment
shall be disposed of properly. Ice shall
be handled and stored in approved manner.
"Item 14. Wholesomeness of Food
and Drinks. All food and drink shall be
clean, wholesome, free from spoilage, and
so prepared as to be safe for human consump-
tion. No food or drink shall be prepared
in a private home. All materials that are ,..-
prepared or manufactured into food or drink
products shall be from approved sources.
"Item 15. Storage and Display of
Food and Drink. All food and drink shall
be so stored and displayed as to be protected
from dust, flies, vermin, depredation
and pollution by rodents, unnecessary
handling, droplet infection, overhead leakage,
and other contamination. No animals or fowls
shall be kept or allowed in any room in which
food or drink is prepared or stored. Open
foods shall be kept in a clean covered con-
tainer when transported from one establishment
to another. All means necessary for the elim-
ination of flies, roaches, and rodents shall
be used.
"Item 14. Cleanliness of Employees.
All employees shall wear clean outer garments
and shall keep their hands clean at all times
while engaged in handling food, drinkk, utensils,
or equipment. ?lnployees shall not expectorate
or use tobacco in any form where food is
prepared; and shall wear suitable hairnet or
cap.
"Item 17. Miscellaneous. The
premises of all f-nod establishments shall
be kept clean and free of accumulated litter
or rubbish. None of the operations connected

with a food establishment shall be conducted
in any room used as living or sleeping quarters.
Adequate lockers or dressing rooms shall be
provided for employees clothing and shall
he kept clean. Also, soiled linens', coats and
aprons shall be kept in containers provided
for this purpose.
"(f) Every person angaged in the manufacturing, preparation or
handling of food or drink, or employed in or around food in a bottling
plant, grocery store, meat market, candy factory or other similar establish-
ment shall submit to medical examination when and as required by the health
officer and certificates of such examination on forms provided by the city
shall be filed with the health officer. Every healthy person shall be
entitled to a certificate of health.
'i(g) No person who is affected with any disease in a communicable
form or is a carrier of such disease shall work in any bottling plant,
grocery store, meat market, candy factory or other similar establishment and
no bottling plant, grocery store, meat market, candy factory or other similar
establishment Shall employ any such person or any persons suspected of being
affected with any disease in a communicable form or of being a carrier of
such disease. If the manager of the bottling plant, grocery store, meat
market, candy factory or other similar establishment suspects that any em-
ployee has contracted any disease in a communicable form or has become a
carrier of such disease he shall notify the health officer immediately.
A placard containing this section shall be posted in all toilet rooms.
"(h) When suspicion arises as to the possibility of transeission of
infection from an employee of any bottling plant, grocery store, neat market,
candy factory or other similar establishment, the health officeris authorized
to require any or all of the following measures:
1. "The employee shall be immediately excluded from the place of
. ' employment.
2. "The immediate closing of the bottling plant, grocery store, meat
' market, candy factory or other similar establishment concerned until
no further danger of disease outbreak exists in the opinion of the
health officer.
3. "Adequate medical examinations of the employee and of his associates,
with such laboratory examinations as may be indicated.
"(i) Any person who violates the terms and provisions of this ordinance
or any lawful rule or regulation promulgated by the 9oard of Health to enforce
the provisions of this ordinance shall be guilty of a misdemeanor which shall be
punishable by fine in any sum not exceeding 1299.00 or by imprisonment in the
city ;fail for a period not to exceed six (6) months or by both fine and imprison-
ment.
"(j) All licenses for establishment subject to this ordinance issued and
existing under Title 20 of the Revised Ordinances of Salt Lake City, 1955, shall
be continued until the next expiration date; subject, however, to the items of
sanitary regulation and control imposed by this ordinance and to the powers of
suspension or revocation as provided. by this ordinance and by the ordinance
under which the license was issued.

SECTION 2. In the opinion of the Board of Commissioners, it is necessary
to p€ace , health and safety of the inhabitants of Salt Lake City that this
ordianance shall become effective immediately.
SECTION 3. This ordinance shall take effect upon its first publication.
