Shearman Wells QY-171 ,• Mr.Chairman Result AN ORDINANCE An ordinance levying a tax and for the assessment of property in Western Avenuem which runs from North Temple Street to First North Street between Fifth West and Sixth Vest Streets, in Sewer District No. 2, for the construction of a sewer. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Sewer District No. 2, for the construction of a sewer, to-wit: In Lots 2, 3, 6 and 7, Block 61, Plat "C", Salt Lake City Survey, abutting on both sides of V.estern Avenue, which runs from North Temple Street to First North Street between Fifth Vest and Sixth West Streets. This tax is levied to defray the expense of constructing a vitrified pipe sewer eight (8) inches in diameter, upon the portions of said street opposite the property hereinbefore and hereinafter described to be especially affected and benefited by said improvement, and it is hereby adjudged, determined and established that said property will be especially benefited thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assessed at an equal and uniform rate in accordance with the linePr foot frontage upon said portion of said street fronting upon and to a -1- 7 E V depth of twenty-five (25) feet back therefrom, and the tax hereby levied and to be assessed upon said parcels of land is five hundred six and 88/100 ("506.88) dollars, or 576/1000 ($0.576) dollars per! , front or linear foot of abutting property, there being 880 feet of! abutting property within the boundaries of the lots, block and . street above mentioned in said district, which is the total cost ' and cost per front foot of said sewer, according to the contract entered into for the performance of said work and making said improvement, with Gillis-Brittain Company, dated the 27th day of April, 1914, and the Treasurer is hereby authorized and directed ' to assess, in accordance with the provisions of this ordinance, for the purpose herein mentioned: The west side of the north 242 feet of the east 156 feet of Lot 2, the east side of the south 191 feet of the north 203 feet of the west 124 feet of Lot 3, the east side of the north 207 feet of ! the south 240 feet of the west 152.5 feet of Lot 6, the west side of the south 240 feet of the east 152.5 feet of Lot 7, all in Block 61, Plat "C", Salt Lake City Survey, as the same are shown ;upon the official plats of said city to P. depth of twenty-five (25) feet back from said street, and to collect said tax. SB99TI0N 2. Said tax shall become and be delinquent in five 1 equal yearly installments, withiinterest on the whole sum unpaid at the rate of six per cent per annum, payable at the time each in installment is due, to-wit: One-fifth thereof/one year after the ordinance confirming the levy of the tax for the payment for such 1 improvement becomes effective; one-fifth thereof in two years . . after said. ordinance becomes effective; one-fifth thereof in three years after said ordinance becomes effective; one-fifth thereof inl four years after said ordinance becomes effective; and one-fifth thereof in five years after said ordinance becomes effective. One! or more of said installments, in the order in which they are payable, or the whole special tax, may be paid at any time within thirty -2- days after the ordinance confirming the levy of the tax becomes effective, without interest. In the event of any installment or the interest aforesaid not being paid on the date the same becomes' due, the whole amount of the special tax unpaid at the time said installment and interest are due, shall become due and payable, and shall drew interest at the rate of eight per cent per annum until the sale of the property assessed; provided, one or more installments, in the order in which they are payable, or the wholel, special tax unpaid, may be paid on the day any installment becomes due, by paying the amount thereof and interest to said date.
