AN ORDINANCE AMENDING CHAPTERS 21 and 22 of the Revised Ordinances of Salt Lake City, Utah, 1965, as amended, by adding thereto Sections 51-21-8 and 51-22-5, relating to conditional uses in Business "B-3" and Commercial "C-1" Districts. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1- That Chapter 21 of the Revised Ordinances of Salt Lake City, Utah, 1965, as amended, relating to Business "B-3" Districts, be, and the same hereby is, amended by adding thereto a new Section 51-21-8 relating to conditional uses, said section to read as follows: "Sec. 51-21-8. Conditional uses. In a Business 'B-3' District the Board of Adjustment may permit as a conditional use the following: 1. A mortuary, or reception center or wedding chapel if, after a public hearing it is determined that due to the size and location of the property and the character of the neighbor- hood in which it is to be located such use would be in keeping with the proper development of the area, would not bring undue traffic into or through a residential district nor interfere with the use of the adjoining properties. If, in the opinion of the Board, such use is proper, the Board may impose such design conditions and other requirements involving parking, landscaping, signing, etc. which will protect the adjoining properties as is deemed necessary. Before the Board of Adjust- !' ment renders its final decision, they shall first secure the recommendation of the Planning and Zoning Commission." SECTION 2. That Chapter 22 of the Revised Ordinances of Salt Lake City, Utah, 1965, as amended, relating to Commercial "C-1" Districts, be, and the same hereby is, amended by adding thereto a new Section 51-22-5, relating to conditional uses, said section to read as follows: "Sec. 51-22-5. Conditional uses. Conditional uses shall be the same as those permitted in Business 'B-3' districts." -2- SECTION 3. In the opinion of the Board of Commissioners of Salt Lake City, it is necessary to the peace, health and welfare of the inhabitants of Salt Lake City that this ordinance become effective immediately. SECTION 4. This ordinance shall take effect upon its first publica- tion.
