HomeMy WebLinkAbout76 of 1981 - Closing the northern 77.0 feet of Richards Street (#40 West) from approximately 725-730 South SALT LAKE CITY ORDINANCE No. 76 of 1981 (Closing north 77.0-foot portion of Richards Street in Block 15, Plat A at approximately 725-730 South) WHEREAS, Petition No. 119 of 1981, submitted by James W. Williams and Gordon 0. Schettler, as amended, requests the vacation of the 77.0-foot northern portion of Richards Street south of its presently-existing dealership location at 725-730 South; and WHEREAS, a review of said petition indicates that vacation would be contrary to the policy of the City, but in lieu thereof, that closure would be appropriate, based upon the findings that said portion of the street is no longer necessary for use as a public street, avenue or alley, but should be closed, with the public interest being retained for anticipated transfer at fair market value to abutting property owners, based on certain conditions and reservations; THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That the northern 77.0 feet of Richards Street (#40 West), from approximately 725 - 730 South, located within Lot 7 of Block 15, Plat A, Plat 2, Salt Lake City Survey, in Salt Lake City, Utah, more particularly described below, be, and the same hereby is, closed and declared no longer to be needed or available for use as a public street, avenue, alley or pedestrian way, but that the public's interest therein shall be reserved for a contemplated transfer for the fair market value. Commencing at a point 90.75 feet East and 92.125 feet North of the southwest corner of Lot 7, Block 15, Plat A, Plat 2, Salt Lake City Survey; thence running East 41.25 feet, more or less, to the east line of Richards Street; thence North along said East line 77.0 feet to the north line of Lot 7; thence West 41.25 feet, more or less, to the West line of said street; thence South 77.0 feet to the point of beginning. Containing 3,176.25 square feet. Said closure is expressly SUBJECT TO all existing rights-of-way and easements of all public utilities of any and every description, now located on, in, under or over the confines of the above-described property, and also SUBJECT TO the rights-of-entry thereon for the purpose of obtaining, altering, replacing, removing, repairing, or rerouting said utilities and all of them. It is expressly noted, that existing water mains, fire hydrants, and sprinkler systems connections within said property must be reserved and preserved as part of said utility easement. Said closure is also SUBJECT TO any existing rights of ways or easements of private third parties. SECTION 2. In the opinion of the City Council of Salt Lake City, Utah, it is necessary for the peace, welfare, health and safety of the inhabitants of said City that this ordinance become effective immediately as provided below. SECTION 3. This ordinance, after the date of its first publication, shall not become effective until recordation with the Recorder of Salt Lake County. However, the City Recorder of Salt Lake City is instructed that she shall not proceed with recording until the Mayor of Salt Lake City, based on the recom- mendations of the City Engineer and the City Attorney, receives fair market value and an executed Agreement providing for the relocation, dedication and construction of a replacement alley of approximately comparable square footage. Before accepting such dedication, the petitioners shall be responsible to submit plans and documents for the approval of the City Engineer and City Attorney, and to provide for the dedication, construction and performance bonding required for public roadways. Upon approval by the Mayor of the dedication and bonding documents, this closing ordinance may be recorded concurrently with the documents of dedication. If the foregoing conditions are not completed within twelve (12) months from date of passage, this ordinance shall be null, void and of no effect and no recording shall be allowed.
