C IDMillS, the Board of Jon..:_ eionera of Salt Bake Jity, Utah, on the 9th day of June, 1920, dull passed a notion requiring the bamberger ;lectric 1ailroad Company, a corporation, to appear before the Board of Commissioners on the 17th day of Juno, 1920, at the hour of ten o'clock A. 1.h. to ; .ow cause why the franchise to lay tracks and operate cars across the east side of -first Jest :street ap- proximately 330 feet north of South 'Temple Street, and also to con- struct, maintain and operate additional sidings, switches, turn outs and curves with the poles and wires necessary therefor, granted to said company by a franchise ordinance gassed by the City Council of Salt :Lake City on the 6th day of September, 1905, as upended by fran- chise ordinance passed by the City Council of Salt Lake City July 29, 1909, and as amended by an. ordinance passed by the Board of Commis- sioners of Salt Lake City hay 19, 1913, should not be declared null and void in so far as the same gives said company a right to lay tracks and operate cars across the east side of first -jest Street 11111 I I I I j W approximately 330 feet north of South Temple Street; and jWHEREAS, said company was duly and timely served with notice requiring it to appear and show cause why such franchise II II should not. be declared null and void in the respects aforesaid; i and j WHEREAS, said company has appeared by its representa- ltives and the Board of Commissioners has fully considered the +matter and has been satisfied by evidence that More than six j months have elapsed since the passage of said ordinance and the j making 'of said amendments thereto and that no track has been con,- structed across the east portion of first ;lest Street approxi- lmately 330feet north of South Temple Street. , i NOW, THEREFORE, Be it ordained by the Board of Commis- goners of Salt Lake City, Utah: j SECTION 1. That that certain franchise ordinance passe j; by the City Council of Salt Lake City on September G, 1905, as amended by an ordinance passed by the City Council of Salt Lake Hity on July 29, 1909, and as aaended by an ordinance passed by II the Board of Commissioners of Salt Lake City Hay 19, 1913, in so far as it grants to the Bamberger Electric Railroad Company, formerly called the Salt Lake P Ogden Railway Company, the right c to lay tracks and operate the same e ,ozs and upon the east side I� of first West Street approximately 330 feet north of South Temple s' Street and so far as it applies to additional sidings, switches, turn outs and curves with the poles and wires necessary therefo1 lwhich have not already been constructed by said company, be and 11 the same is hereby declared to be null and void. SECTION 2. In the opinion of the Board of Commission- 1 ers, it is necessary to the peace, health and safety of the city, that this ordinance become effective innediately. 11 SECTION 3.
