' Barker Harmsen // Harrison Phillips AN ORDINANCE Result AN ORDINANCE AMENDING Chapter 6 of Title 20, et seq., of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to Bicycle Dealers. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Chapter 6 of Title 20, et seq., of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to Bicycle Dealers, be, and the same hereby is, amended to read as follows: CHAPTER 6 BICYCLE DEALERS Sections: 20-6-1. License required. 20-6-2. Definition. 20-6-3. Dealing with minors restricted. 20-6-4. Dealer licensing and information to be kept. 20-6-5. Duty to impose serial number. 20-6-6. Unlawful to sell without title. Sec. 20-6-1. License required. It shall be un- lawful for any person to: (a) Keep a store, shop, office or other place of business for the purchase, barter, ex- change or sale of bicycles, whether new or used; or (b) To repair, trade or exchange new or used bicycles without obtaining a business license. Sec. 20-6-2. Definition. Any person engaged in buying, selling, bartering or exchanging bicycles, whether dealing exclusively in bicycles or in conjunction with other wares, goods and merchandise, is hereby declared to be a Bicycle Dealer. 20-6-3. Dealing with minors restricted. It shall be unlawful for any Bicycle Dealer, by himself, his agents, servants or employees to purchase or receive from any minor, any bicycle, whether as a trade-in or another bi- cycle or an outright purchase for cash, or as an exchange or barter for another bicycle without the written consent of the parent or guardian of such minor. Sec. 20-6-4. Dealer licensing and information to be kept. It shall be unlawful for any Bicycle Dealer to fail to license: (a) Any new or used bicycles sold, bartered or exchanged by them, which bicycle was purchased by or for use by any resident of Salt Lake County; or (b) Any unlicensed bicycle brought to them for repair prior to the time of re-delivery. The Dealer shall not license bi- cycles purchased for use outside of Salt Lake County's geo- graphical boundaries, but shall complete the registration form and mail it to the appropriate Police or Sheriff's Department as hereinafter provided. Any license and reg- istration required shall be issued, completed, and the license decal affixed by the Dealer at the cost charged to the customer not to exceed $1.00. At the time of said sale, the Dealer shall complete a bicycle registration and license form supplied by Salt Lake City Corporation and available to the Dealer at approximately the cost of production fr au the Salt Lake City Treasurer's Office. The green copy of the registration form shall be retained by the Dealer for a period of three years and the third copy of said form shall be mailed, not later than one week from the date of sale, to the Police or Sheriff's Depart- ment of the jurisdiction where the user resides. All entries on the registration form shall be made in ink or typewritten and, if written in ink, shall be printed. All said records of such Bicycle Dealers shall be open for in- spection by any Police Officer at any reasonable time. Sec. 20-6-5. Duty to impose serial number. When a bicycle desired to be sold by a Dealer does not have a serial number on its frame prior to sale, the Dealer shall impress in the metal of the bicycle frame a serial number by using the Dealer's initials and the license decal number issued with the bike or a serial number using the manufacturer's system of serial numbering. Said serial number shall be placed on the underside of the bottom frame sprocket. It shall be unlawful to sell any bicycle without a serial number embedded in the frame, either by the manufacturer or as provided herein. Sec. 20-6-6. Unlawful to sell without title. It shall be unlawful for any Bicycle Dealer to sell or otherwise dispose of any bicycle unless he can show a good title thereto either by bill of sale from a seller, or from the former owner, or by registration. SECTION 2. In the opinion of the Board of Commissioners of Salt Lake City, it is necessary to the peace, health and welfare of the inhabitants of said City that this ordinance be- come effective immediately. SECTION 3. This ordinance shall take effect upon its first publication. Passed by the Board of Commissioners of Salt Lake City, Utah, this 19th day of July, 1973.
