AN ORDINANCE AMENDING Section 39-1-5 of the Revised Ordinances of
Salt Lake City, Utah, 1965, relating to Form of Notice of Intention
in connection with Special Improvement Districts.
Be it ordained by the Board of Commissioners of Salt Lake City,
Utah:
SECTION 1. That Section 39-1-5 of the Revised Ordinances of Salt
Lake City, Utah, 1965, relating to the form of notice of intention to
be published in connection with special improvement districts, be, and
the same hereby is, amended as follows:
"Sec. 39-1-5. Form of notice of intention. The notice of
intention shall be substantially in the following form:
NOTICE OF INTENTION
NOTICE IS HEREBY GIVEN by the Board of Commissioners of Salt
Lake City, Utah, of the intention of said board to create a
special improvement district to make improvements and to levy
assessments to pay all or a portion of the cost for the follow-
ing proposed improvements, including removal of all non-
conforming improvements as part of said work, according to plans,
profiles, and specifications on file in the office of the city
engineer, to-wit:

The places and the improvements are to be made and streets to
be improved are as follows:

The boundaries of the proposed district are as follows:
(Here describe the district by any means that will reasonably
permit owners of property situated in the district to ascertain
that their property is within the district. Such description
may be by metes and bounds, reference to streets or extensions
of streets, or by any other means reasonably describing the
boundaries of the district so as to permit owners of property
therein to ascertain that his property is within the districtA)
The total estimated cost of all improvements is $
as determined by the city engineer, of which the city's portion
is estimated to be $ , and the remainder in the
amount of $ , is to be paid by an assessment to be levied
upon property fronting or abutting upon or adjacent to the
streets and alleys to be improved, or which may be affected by
or specially benefited by any of such improvements. If the
actual cost of the improvements exceeds the estimated cost,

the governing body shall nevertheless have the right to levy
assessments in excess of the estimated cost. It is proposed
to levy assessments on property in the district to pay all or
a portion of the cost of improvements according to the
benefits to be derived by such property by levying an assess-
ment on all property in the district according to (here set forth
whether it is to be by frontage, according to area, assessed
valuation or by combination of the above) .
Any assessment may be paid in equal annual install-
ments with interest on the unpaid balance not to exceed
percent ( %) per annum until due and thereafter at the rate of
percent ( %) per annum until paid; or the whole or any
part of the assessment may be paid without interest within
days after the ordinance levying the assessment becomes
efrjctive, and if paid in part the unpaid balance shall be
payable in equal annual installments with interest as
aforesaid.
All protests or objections to such improvements or the
creation of the district or to the carrying out of such inten-
tion MUST BE IN WRITING, signed by the owner or owners of the
property affected or benefited by such imprvmnts, describing
or otherwise identifying such property, together
set forth front feet, area or assessed valuation of the property
depending on the proposed method of levying assessments) .
NOTICE OF PROTEST MUST BE FILED IN THE OFFICE OF THE SALT
LAKE CITY RECORDER ON OR BEFORE 5:00 O'CLOCK P.M. ON THEa.m.

Building to hear and consider any such protest and objections
to the creation of the special improvement district or any other

SECTION 2. In the opinion of the Board of Commissioners it is
necessary to the peace, health and welfare of the inhabitants of Salt
Lake City that this ordinance become effective immediately.
SECTION 3. This ordinance shall take effect upon its first
publication.
