The Board of Commissioners of the City of Salt Lake
City, in the County of Salt Lake and State of Utah, met in
regular session, in full conformity with law and the ordinances
and rules of said City, at the City and County Building, Salt
Lake City, Utah, being the regular meeting place of said Board,
on Wednesday , the lothday of December, 1958, at the hour
of 10:00 o'clock a.m. On roll call the following were found to

ORDINANCE NO. 79 of 1958
AN ORDINANCE PROVIDING FOR AND ORDERING A
SPECIAL ELECTION TO BE HELD ON TUESDAY,
THE 13TH DAY OF JANUARY, 1959, FOR THE
PURPOSE OF SUBMITTING TO THE ELECTORS OF
THE CITY OF SALT LAKE CITY QUALIFIED TO
VOTE THEREON THE QUESTION OF ISSUING THE
GENERAL OBLIGATION BONDS OF THE CITY OF
SALT LAKE CITY IN THE AGGREGATE PRINCIPAL
AMOUNT OF $2,500,000.00, OR SO MUCH THEREOF
AS MAY BE NECESSARY, FOR THE PURPOSE OF
PROVIDING FUNDS TO DEFRAY IN PART THE COST
OF EXPANDING AND IMPROVING THE MUNICIPAL
AIRPORT BY CONSTRUCTING A BUILDING TO BE
KNOWN AS ADMINISTRATION BUILDING NO. 2,
PRESCRIBING DETAILS IN CONNECTION THEREWITH,
DECLARING AN EMERGENCY, AND PROVIDING THE
EFFECTIVE DATE OF THIS ORDINANCE.
WHEREAS, the City of Salt Lake City, in the County of
Salt Lake and State of Utah, is a municipal corporation duly
organized and existing under the laws of the State of Utah as a
city of the first class; and
WHEREAS, the City now owns and operates a municipal
airport under the jurisdiction of the Department of Parks and
Public Property; and
WHEREAS, the City owns a tract of vacant land
approximately one mile west of the present airport administration
building on which the City proposes to construct Administration
Building No. 2 with the proceeds to be derived from the sale of
the general obligation bonds of the City, provided their issuance
is authorized at the election hereinafter ordered and called to
be held, and from such other funds as are or may become legally
available; and
WHEREAS, the Board of Commissioners has determined,
and does hereby determine, subject to the approval of the
electors as aforesaid, that the municipal airport should be
expanded and improved by constructing a building on the site
above described to be known as Administration Building No. 2,
consisting of a structure to provide office space for airlines,
together with all facilities necessary or convenient for the use
of the traveling public and others using the airport to the end
that said Administration Building No. 2 when completed will be
capable of adequately servicing the needs of airlines,
concessionaires, the traveling public and others under present
and future conditions; and

WHEREAS, the Constitution of the State of Utah provides
that no debt in excess of the taxes for the current year shall be
created by any city in the State of Utah unless the proposition
to create such debt shall have been submitted to a vote of such
qualified electors as shall have paid a property tax therein, in
the year preceding such election, and a majority of those voting
thereon shall have voted in favor of incurring such debt.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF
COMMISSIONERS OF THE CITY OF SALT LAKE CITY, SALT LAKE COUNTY,
UTAH:
Section 1. That a special bond election be, and the
same hereby is, ordered and called to be held in the City of Salt
Lake City on Tuesday, the 13th day of January, 1959.
Section 2. That at such special election to be held in
the various election districts in the City of Salt Lake City,
between the hours of 7:00 o'clock a.m. and 8:00 o'clock p.m. on
Tuesday, the 13th day of January, 1959, there shall be, and there
is hereby, submitted to the vote of such qualified electors of
the City of Salt Lake City as shall have paid a property tax
therein, in the year preceding such election, the question of
whether or not the Board of Commissioners of the City of Salt Lake
City shall authorize the issuance of the negotiable, interest
bearing general obligation bonds of the City of Salt Lake City,
in the aggregate principal amount of $2,500,000.00, or so much
thereof as may he necessary, for the purpose of defraying in part
the cost of expanding and improving the municipal airport by
constructing a building on the site above described to be known
as Administration Building No. 2, consisting of a structure to
provide office space for airlines, together with all facilities
necessary or convenient for the use of the traveling public and
others using the airport to the end that said Administration
Building No. 2 when completed will be capable of adequately
servicing the needs of airlines, concessionaires, the traveling
public and others under present and future conditions.
Section 3. That at the several voting places in the
election districts in the City of Salt Lake City the vote on said
bond proposal shall be by official ballot available only to such
qualified electors as shall have paid a property tax therein, in
the year preceding such election, and each person so qualified,
and no others, shall be permitted to cast a ballot upon the
question of the issuance of said bonds. Absentee voting will be

permitted in accordance with the laws of the State of Utah and the
ordinances of the City of Salt Lake City.
Section 4. That the ballot to be used at such election
on the question so submitted shall be in substantially the
following form:

Section 5. That notice of such election shall be given
by publication for four weeks prior thereto, once a week, in
The Deseret News-Salt Lake Telegram , a newspaper published in
the City of Salt Lake City, by five insertions at weekly
intervals, immediately prior to the date of said election. The
Mayor and the Recorder of the City of Salt Lake City be, and they
hereby are, authorized and directed to cause said notice to be
so published, which notice shall be in substantially the followin=

for the purpose of submitting the question:

obligation bonds of the City of Salt Lake City
in the aggregate principal amount of
$2,500,000.00, or so much thereof as may be
necessary, maturing serially over a period of
not to exceed twenty years from date, bearing
interest at a rate not exceeding four per

The official ballot, after the statement of the question
submitted, shall contain the words, "For the issue of bonds:
Yes. No." If the voter desires to vote for the issue of bonds,
he shall place an X in the space after the word "Yes." If the
voter desires to vote against the issue of bonds, he shall place
an X in the space after the word "No." If the question so sub-
mitted is approved by a majority of those voting thereon, bonds
to the authorized amount may be issued.
At said special bond election the polls will be open
at the hour of 7:00 o'clock a.m. and remain open and be closed
at the hour of 8:00 o'clock p.m. of the election day.
For the purposes of said bond election, the City of
Salt Lake City has been divided into election districts and one
polling place established in each such election district, all

Three judges and an alternate judge have been appointed for each
election district.
No person shall be permitted to vote at said special
bond election who is not a qualified elector, who has first been
registered within the time and in the manner and form as
required by Chapter 2, Title 20, of the Utah Code, 1953, as
amended and supplemented. There shall be no special registration
of voters but the official register last made or revised shall
constitute the official register for such bond election.

Section 6. That, in addition to the notice provided
for in Section 5 above, each registration agent shall, at least
five days prior to the special bond election, post notices in
his district in at least five conspicuous places within the
district stating the date and place of election and the hours
during which the polls will remain open. Such notice may be
substantially in the form set forth in Section 5 above.
Section 7. That said special bond election shall be
held, except as otherwise provided by law, as nearly as
practicable in conformity with the general election laws of the
State of Utah.
Section 8. That the polling places for all qualified
electors of the City, and the hours during which the polls
remain open, shall be the same as designated in the foregoing
notice of election.
Section 9. That the City Recorder be, and he hereby is,
authorized and directed to communicate such instructions to the
judges of election as to enable them properly to conduct such
election, canvass the votes, and certify the results thereof to
the Board of Commissioners of Salt Lake City as required by law,
and the City Recorder be, and he hereby is, authorized and
directed to have ballots printed in the form set forth in this
Ordinance, and to furnish the same to the judges of election, to
be by them furnished to the qualified electors. The City
Recorder shall also provide a ballot box, poll book, and all
stationery necessary for the use of the judges at said election.
Section 10. That if a majority of the qualified voters
voting thereon shall have voted in favor of incurring such in-
debtedness, the Board of Commissioners of the City of Salt Lake
City may proceed to issue the amount of bonds specified in the
election question, or such part thereof as may be necessary to
accomplish the purposes above recited. The Board of Commission-
ers shall meet at its regular meeting place at the hour of l0:00
o'clock a .m. , on Monday, the 19th day of January, 1959, to sit
as a canvassing board to canvass the returns of said special
bond election.
Section 11. That if any section, paragraph, clause or
provision of this Ordinance shall for any reason, be held to be
invalid or unenforceable, the invalidity or unenforceability of
such section, paragraph, clause or provision shall not affect any
of the remaining provisions of this Ordinance.

Section 12. That by reason of the fact that the
airport facilities of the City of Salt Lake City are not
adequate to supply the present and future needs of the City and
of its inhabitants, and for other reasons, in the opinion of the
Board of Commissioners an emergency exists, and this Ordinance is
necessary for the immediate preservation of the peace, health
and safety of the City of Salt Lake City, and shall be, in full
force and effect immediately after its final publication and
passage.
Section 13. That this Ordinance after its passage
shall be deposited in the office of the City Recorder, shall be
recorded in the Book of Ordinances of said City kept for that
purpose, and authenticated by the signature of the Mayor and
attested and countersigned by the City Recorder.
