Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Article 18 of the Traffic Code of Salt Lake City, Utah, 1965, relating to regulations for bicycles, be, and the same hereby is, amended to read as follows: ARTICLE 18 REGULATIONS FOR BICYCLES Sections: 273. Parents responsible. 274. Licenses required. 274.1 Dealer licensing. 274.2 Police licensing. 275. Mutilation, alteration, removal of license, etc. 276. Equipment. 277. Bicycle riders subject to motor vehicle code. 278. Bicycles, miscellaneous rules. 279. Revocation or suspension of license. Sec. 273. Parents responsible. It shall be un- lawful for a parent or custodian of any child and the guardian of any ward to knowingly permit any such child or ward to violate any of the provisions of this article. Sec. 274. Licenses required. It shall be unlaw- ful for any person to operate or ride a bicycle upon any of the streets, alleys, sidewalks, or public ways of this city: (a) Unless said bicycle has been registered, li- censed and is displaying the proper license, as herein- after provided; or (b) After the license has been duly suspended or revoked. Every bicycle before being so reg- istered and licensed must be inspected with relation to its frame number, operating condition, brakes, warning device, reflector and handle bars. Any license issued under the provisions of this chapter shall be valid until the transfer of ownership of said bicycle, or until the bicycle license so issued is destroyed, lost or mutilated, at which time such bicycle shall again be inspected, reg- istered and licensed as herein provided. The fee to be paid for each bicycle license or re-license because of transfer of title or destruction, loss or mutilation of the license, or for any other reason, shall be $1.00 payable in advance. Sec. 274.1. Dealer licensing. All dealers re- quired to obtain a license pursuant to the provisions of Section 20-6-1 et seq of these Revised Ordinances shall, at the time of sale of a new or used bicycle, license and inspect said bicycle, if the purchaser is a resident of Salt Lake County or if the said bicycle is purchased for use by an individual who is a resident of Salt Lake County, as determined by completing the questionnaire required to be completed pursuant to the provisions of Section 20-6-4 of these Revised Ordinances. Sec. 274.2. Police licensing. The Chief of Police is hereby authorized and directed, to prepare and issue regulations governing the inspection and licensing of bicycles required to be licensed, but not validly li- censed by Dealers as above required; provided, that any such license so issued or heretofore issued by the Police Department shall be valid for the life of such bicycle or until the transfer of ownership thereof, or until the license issued to such bicycle becomes destroyed, lost or mutilated, at which time the bicycles shall again be inspected, registered and licensed or re-licensed. The cost of any licensing or re-licensing under the provisions of this section shall be $1.00 payable in advance. Sec. 275. Mutilation, alteration, removal of license, etc. No person shall wilfully or maliciously destroy, mutilate or alter the number of any bicycle frame number, any bicycle license issued pursuant to this code or remove, destroy or mutilate any license decal while the same is valid, or operate any vehicle without having attached thereto a valid license decal issued as provided in these Revised Ordinances. Sec. 276. Equipment. Any bicycle operated upon any street, alley, sidewalk or public way of this city shall be equipped with a warning device consisting of a bell or horn capable of giving an audible signal for a distance of at least 100 feet, which must be sounded to warn all persons of its approach. However, no bicycle shall be equipped with and no person shall use a siren or whistle as a warning device. Every bicycle shall be equipped with a brake which will enable the operator to control the movement of and to stop and hold such bicycle. Any bicycle operated during the period of one-half hour before sunset and one-half hour before sunrise, shall in addition to the foregoing, be so equipped with a lighted lamp, visible under normal atmospheric conditions for a distance of at least five hundred feet to the front. There shall be attached to the rear of said bicycle a reflector ora lighted lamp visible under like conditions for a distance of at least five hundred feet. Sec. 277. Bicycle riders subject to motor vehicle code. Every person riding a bicycle upon the streets, alleys, sidewalks, or public ways of this city shall be subject to the provisions of this code, including Article 5, applicable to the driver of a motor vehicle, except as to special regulations of this code or those provisions -3- which by their nature can have no application. Sec. 278. Bicycles, miscellaneous rules. It shall be unlawful for operators of bicycles: (1) When riding upon a sidewalk to fail to yield the right-of-way to pedestrians and sound a warning device before overtaking or passing any ped- estrian. (2) To ride more than two abreast upon any street. (3) To proceed other than single file upon any sidewalk. (4) To carry extra passengers or carry any packages, bundles or articles which would require the removal of the hand or hands from the handle bars of said bicycle. (5) To permit the bicycle he is riding to be towed by another vehicle or bicycle. (6) To ride any bicycle upon any sidewalk within the area bounded by, but not including, North Temple Street on the north, Fifth South Street on the south, Second East Street on the east and West Temple Street on the west. (7) To carry more persons at a time than the number for which the bicycle is designed to carry on seats firmly attached thereto. Sec. 279. Revocation or suspension of license. The city judges or judges of juvenile courts who hear traffic cases are hereby empowered to revoke or suspend the license of any bicycle when it appears that the owner of any bicycle is not the licensee of record or that the owner of the bicycle or the licensee thereof has used or knowingly permitted said bicycle to be used in violation of this code. The police department is hereby directed and authorized to impound any bicycle so used in violation of this code for a reasonable period of time pending investigation of any alleged violation of this code or until such bicycle is reg- istered and licensed by the owner thereof and equipped as herein provided. SECTION 2. In the opinion of the Board of Commissioners of Salt Lake City, it is necessary to the peace, health and wel- fare of the inhabitants of said City that this ordinance become effective immediately.
