..( lu-zi-yi -(J � t4 SALT LAKE CITY ORDINANCE No. '7q of 1981 3628 O1 (Carrigan Canyon Annexation and Zoning) AN ORDINANCE EXTENDING THE CORPORATE LIMITS OF SALT LAKE CITY BY ANNEXING THE "CARRIGAN CANYON ANNEXATION", ZONING THE SAME PRESERVATION "P-1" OR RESIDENTIAL "R-1A" SUBJECT TO THE FOOTHILL OVERLAY "F-1" ZONE BY AMENDING THE USE DISTRICT MAP ADOPTED BY SECTION 51-12-2; AND PROVIDING FOR AN ANNEXATION AGREEMENT, INCORPORATED BY REFERENCE. WHEREAS, there has been filed with the City Recorder of Salt Lake City, Utah, Petition No. 21 of 1981, together with a plat showing a tract of land proposed for annexation, hereafter known as the "Carrigan Canyon Annexation", requesting that said tract of contiguous land, hereinbelow described, be taken within the limits of Salt Lake City Corporation for purposes of development; and WHEREAS, this Petition is signed by a majority of the owners of the real property and the owners of more than one-third in value of all the real property included therein, as shown in the last assessment rolls; and WHEREAS, the petitioners have caused an accurate plat or map to be made and certified to by a competent, licensed land surveyor and approved by the City Engineer, which shall be filed with the City Recorder; and WHEREAS, the City Council of Salt Lake City, Utah, on or about the 17th day of February, 1981, passed a Resolution accept- ing the Carrigan Canyon Annexation petition for purposes of review and hearing; and WHEREAS, the City Council of Salt Lake City, Utah, after fJt examining the Petition of said owners regarding said tract of land, having said Petition reviewed by various departments of the City, and having considered the circumstances thereof at a Co Qa publicly-advertised hearing held March 17, 1981, and said Council to finding said proposed annexation is in keeping with the City's Master Policy Declaration and governing annexations, being located in Study Area No. 14 of said policy declaration as adopted on June 20, 1979, and amended December 9, 1980, and having been voted on by a nearly unanimous vote of all the City Council members favoring said annexation; and WHEREAS, no objection or contest of said annexation or the policy declaration of proposed annexation has been filed as required by law; and WHEREAS, the proposed annexation is conditional, being based on certain conditions and requirements forming the consideration for this ordinance which have been reduced to writing in an Annexation Agreement. Said Agreement which is adopted herein and incorporated by reference, sets forth conditions, requirements and obligations of owners which become conditions subsequent to this act and conditions precedent to govern development of the tract, notwithstanding annexation. Said Annexation Agreement, marked Exhibit "A" is hereby incorporated by reference as a portion of the terms and considerations of this ordinance. NOW, THEREFORE, Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. Area. That the City limits of Salt Lake City, Utah, be, and the same herein are, enlarged and extended so as to include the following-described tract of land of approximately 150 acres situated north and easterly of Lakeline Drive in Salt Lake County, Utah: Beginning at the South Quarter corner of Section 14, T1S, R1E, S.L.B. & M.; and running thence North 89°41 '10" West 70.55 feet along the Section Line to a point on the West Line of Lakeline Drive; thence North 7°20'40" West 20.56 feet; thence Northwesterly along the arc of an 854.99 foot radius curve to the left a distance of 144.08 feet (Long Chord bears North 12°10'20" West 143.91 feet); thence North 17°00' West a' 225.00 feet; thence Northerly along the arc of a 233.54 8 foot radius curve to the right a distance of 114.13 feet (Long Chord bears North 3°00' West 113.00 feet); ),.a, thence Northerly along the arc of a 301.56 foot radius 60 curve to the left a distance of 89.48 feet (Long Chord bears North 2°30' East 89.15 feet); thence North 6°00' West 202.00 feet; thence North 54°28'35" East 233.91 feet to the Quarter Section Line, said point being the Southwest corner of the Salt Lake City Municipal C� Corporation Tract; thence North 0°07'45" West 654.66 -2- 79 • feet along said Quarter Section Line and Salt Lake City Municipal Corporation Tract; thence North 45°00' East 1536.97 feet to the Quarter Section Line; thence South 89°48'27" East 1546.87 feet along said Quarter Section line to the East Boundary of said Section 14; thence South 0°04'05" East 2666.026 feet along said Section Line to the South Boundary of said Section 14; thence North 89°41 '10" West 2633.321 feet along said Section Line to the point of beginning. Be it further ordained and declared that a portion of the property described in Section 1 above, be, and the same hereby is, zoned to a Residential "R-1A" Use District, subject to the Foothill Overlay ("F-1") Zone; and the Use District Map, as adopted by Section 51-12-2 of the Revised Ordinances of Salt Lake City, Utah, 1965, as amended, relating to the fixing of boundaries of Use Districts and Overlay Zones, be, and the same hereby is amended by the addition of the following-described property zoned to the Residential "R-1A" and Foothill Overlay "F-1" Zone classifications. Be it further ordained f+ CCI and declared that said tract of land described in Section 1 shall henceforth be within the corporate limits of Salt Lake City CID Corporation. Said tracts of land described in Sections 2 and 3 Cat shall be zoned as respectively provided in said sections. All -4- u , ordinances, jurisdictions, rules and obligations of or pertaining to Salt Lake City Corporation are extended over and made applicable and pertinent to the tract of land described in Sec- tion 1; and the streets, blocks, alleys and ways of said tract shall be controlled and governed by the ordinances, rules and regulations of said City in that behalf. The monuments of the City Engineer shall thenceforth be taken therein as the centers of locations and distances. Said tract shall be further governed by the Annexation Agreement hereby incorporated into this ordinance by reference. SECTION 5. Annexation Agreement. The annexation of said tract described in Section 1 above is granted on a condition subsequent that prior to or concurrent with the adoption of this ordinance but prior to the publication and recording thereof, the Annexation Agreement prepared by the City Attorney as reflected in the proposed Annexation Agreement (attached as Exhibit "1") and incorporated herein by reference bearing the signatures of property owners within said tract, shall be accepted and executed by the Mayor of Salt Lake City. The agreements dealing with requirements for development of said tract are incorporated by reference and constitute the consideration for the annexation. It reduces to writing representations and requirements stipulated to by owners to govern and accommodate future development upon the tract of land. The execution of the Annexation Agreement by property owners is a condition precedent to passage of this ordinance. Said agreement shall govern future development. No permits or approvals will be granted, no services provided, unless owners are in compliance with the terms of the Agreement. $ SECTION 6. Transmittal. Upon the passage of this CO ordinance, the City Recorder shall forward this ordinance 40 concurrently with executed Annexation Agreement to the Mayor for W acceptance and execution. After the Mayor's signature on the cn Agreement this ordinance may thereafter be effective upon -5- publication. After publication the City Recorder is directed to file with the County Recorder of Salt Lake County a copy of the map or plat above mentioned, duly certified and acknowledged, a certfied copy of this ordinance, and the original Annexation Agreement. SECTION 7. This ordinance shall take effect upon its first publication, provided, however, no publication may occur before proper execution of the Annexation Agreement by the Mayor.
