"Salt Lake City reserves the right, during the life of this franchise. upon three years notice to the grantee, its successors or assigns, to terminate this franchise by paying the said grantee, its successors or assigns, the value of the improvements made in compliance with this franchise, at the time said termination becomes effect- ive. The Price so to be paid to be arrived at by arbitration, to which arbitration the said grantee, its successors and assigns, hereby agrees; the arbitrators to be selected as follows: One by Salt Lake City, and one by the grantee, its successors or assigns, and in the event that those two are unable to agree upon a valuation, then they shall select a third arbitrator or referee, and the award made by them shall be binding upon Salt Lake Oily and upon said grantee, its successors o. i assrs 11r�; ,- !i AN ORDINANCE • .1 An ordinance granting to the Oregon Short :Line Railroad Com- 1 pang, and to its successors and assigns, a franchise to construct, maintain and operate a spur railroad track across the County road j at a. point just South of the intersection of said County road with Oak Street, in Salt Lake City, Utah: Be it ordained by the Board of Commissioners of said Salt Lake City, Utah: II SECTION I. A franchise and right of way is hereby given 1 and granted to the Oregon Short Line Railroad Company, and to its li successors and assigns, to lay, maintain and operate a spur stair- , 1 dard guage railroad track across the street hereinafter described on the following location, to-wit: il It A Beginning et the Southeast corner of the NW IIli 1/4 of the SE 1/4 of Section 23, Tp. 1 north, Rg. 1 West of Salt Lake Meridian, and running thence North along said 1/4 Section line 585.66 feet to a point in the East line of the County Road; thence deflecting an angle of 43 deg. 52 min. left and along said East line of said Ii County road a distance of 205.22 feet to point of begin- ning, which is a point in the center line of proposed spur track; thence deflecting an angle of 80 deg. 10 min. left and for a distance of 66.98 feet from said inter- section of East line of County road with the center line of said proposed track, to a point where the west line of said County road intersects the center line of said 4 proposed track. During the terms of this franchise the grantee shall be subject to the following j conditions: (a) That said spur track shall be laid upon and con- !. form to the grade of said street, and if the said grade is after- ward changed by ordinance of the Board of City Commissioners, the grantee shall, at its own expense, change the elevation of the tracks so as to conform to the same. (b) Whenever said street where such track is con- p structed shall be paved, then said grantee, its successors and as- • signs shall pave between the rails =and for a space of two feet out- side of,.each rail, with the same material as that used in the street'--) " ! 17 f .�,_.. ....._.�_..� -:__ ._ (2) pavement, and all ties shall be laid upon a cement base of such thickness as shall be directed by the City Engineer, (c) Said grantee shall put in and maintain such crossings over said spur track as shall from time to time be requir- ed jl by the Board of City Commissioners, and cars shall not be permit- ted to stand on said County road (d) The said spur track shall be laid and the road operated so as to cause no unnecessary impediment to the common and ordinary use of said street upon which it is laid. (e) Good and sufficient conduits to convey water shall be laid and maintained in good condition at the expense of the said grantee, in all the water ditches crossed by said spur track, so as to admit of free passage of water. (f) Said grantee, its successors and assigns shall ;gravel and maintain in good condition at the established grade, the ;street- along which the track rune, to within one and one-half inches of the top rails and for a distance of(25)twenty-five feet on each side of the outer rail, subject to the approval of the Supervisor of Streets. (g) Salt Lake City reserves the right to regulate and control the speed of all trains, engines and cars operated by the grantee, its successors and assigns,- upon the st'1¢.track. SECTION III. Nothing in this grant shall be so construed as tc prevent Salt Lake City or its authorized agents, contractors or person or corporation to whom a franchise may have been or may here- after be granted, from paving, sewering, laying gas or water mains, Pipes or conduits, altering, repairing, or in an y ray manner improving said streets. SECTION IV• Said grantee herein, its successors and assigns shall, and by the acceptance of the privileges and franchises here- in granted, and in consideration of the same does bind itself, its successors and assigns, upon its acceptance of this franchise, to save paid City harmless from all suits, claims, demands and judgment what- soever, whether in law or in equity, which shall be asserted, found l " �.
