BIM Fehr Finch 217 /� /, Moran Mr.Chairman - - - - -- AN ORDINANCE Result AN ORDINANCE AMENDING SECTION 254, Revised Ordinances of Salt Lake City, Utah, 1920, relating to building code. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION I. That Section 254, Revised Ordinances of Salt Lake City, Utah, 1920, relating to building code, be and the same is hereby amended to read as follows: (a) Whenever the inspector of buildings Shall find any building, or structure or part thereof, in the city in such an unsafe condition as to endanger life, jbut in such condition that by the immediate application of precautionary measures such danger may be averted, he shall,'have authority, and it shall be his duty, to forthwith notify; in writing, the owner, agent or person in possession, charge or control of such building or structure or part thereof;, to adopt and put into effect such precautionary measures ail may be neces- sary or advisable in order to place such building, or struo- ture or part thereof in a safe condition; such notice shall state briefly the nature of the work required to be done and shall specify the time within which the work so required to be done shall be completed by the person, firm or corporation notified, which shall be fixed by said inspector of buildings, upon taking into consideration the condition of such building or structure or part thereof, and the danger to life or prowl 8 i 1 -2 party which may result from its unsafe condition, which time may be any time not less thantbie.e days. (b) pphenever such inspector of buildings shall be unable to find the owner of such building, structure or part thereof, or any agent or person in possession, charge or con-1 �; trol thereof, upon whom such notice may be served, he shall address, stamp and mail such notice to such person or persons, at their last known address, and in addition thereto shall place or cause to be placed the notice herein provided for upon such building at or near its principal entrance, and shall also post or cause to be posted in a conspicuous plasm at each entrance to such building, in large letters, a notice) as follows: "THIS BUILDING IS IN A DANGEOUS CONDITION AND HA BEEN CONDEIJNED BY THE INSPECTOR OF BUILDINGS." (c) It shall be unlawful for any person, firm or corporation to remove said notice or notices without written] permission from the inspector of buildings. (d) If at the expiration of the time specified in such notice for the completion of the work required to be done by the terms of such notice in order to render the build- ing or structure safe, said notice shall not have been com- plied with, and said building or structure is in such an un- safe condition as to endanger life or property, it shall be the duty of the inspector of buildings to proceed forthwith to tear down or destroy that part of said building or struc- ture that is in such unsafe condition as to endanger life or property, and in cases where an unsafe building or structure cannot be repaired or rendered safe by the application of precautionary measures, such building or structure, or the l dangerous parts thereof, shall be torn down by said inspecto4 I of buildings or by his order and the expense of tearing down) any part of such building or structure shall be charged to tKe,. I , person owning or in possession, charge or control of such building or structure or part thereof, and the said inspector of buildings shall recover or cause to be recovered from such owner or person in possession, charge or control thereof the cost of doing such work, by legal proceedings prosecuted by the department of law. (e) If the owner, agent or person in possession, charge or control of such building or structure, or pert thereof, when so notified, shall fail, neglect or refuse to place such building or structure, or part thereof, in a safe condition, and to adopt such precautionary measures as shall have been specified by said inspector of buildings within the time specified in such notice, in such case, at the expira- tion of such time, it shall be unlawful for any person, firm or corporation to occupy or use said building or structure, or any part thereof, until said building or structure, .or part thereof, is placed in a safe condition; and in case where a building or structure, or part thereof, is in a dan- gerous or unsafe condition and has not been placed in a safe condition within the time specified in the notice of the in- spector of buildings; such building or structure, or such part thereof, shall be forthwith vacated, and it shall be unlawful for any person or persons to enter same except for the purpose of making repairs required by the inspectof of buildings and the ordinances of the City of Salt Lake City. SECTION 3. In the opinion of the Board of Commissioners it is necessary to the peace, health and safety of the inhabitant of Salt Lake City that this ordinance shall take effect immediate ly.
