HomeMy WebLinkAbout8 of 1981 - Amending Section 30-1-13, relating to Special Officers SALT LAKE CITY ORDINANCE No. 8 of 1981 (Special Officers) AN ORDINANCE AMENDING SECTION 30-1-13 OF THE REVISED ORDINANCES OF SALT LAKE CITY, UTAH, 1965, RELATING TO SPECIAL OFFICERS. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That Section 30-1-13 of the Revised Ordinances of Salt Lake City, Utah, 1965, is hereby amended to read as follows: Sec. 30-1-13. Special Officers. The chief of police, with the advice and consent of the mayor, may at any time appoint special officers to serve with or without pay from the city for such services. Such appointments shall be made for periods designated below and shall be subject to revocation and removal prior thereto, as herein provided. Such officers shall not be peace officers or security personnel under Section 77-10-6 or Section 58-45-1, et seq., Utah Code Annotated, 1953, and shall not enjoy the authority or responsibility of such officers or personnel. Appointment as a special officer does not grant any authority to carry a concealed weapon. In addition to any applicable State law, the appointment and function of such officers shall be governed by the following: 1. The city recorder shall issue to each special officer so appointed, a certificate of appointment which shall designate whether the appointee is authorized to act as a special officer throughout the city or on the watershed, and if at any particular place, the place shall be designated in such certificate. The city recorder shall keep a book containing the names of such appointees, the date of appointment and the date of expiration of said appointment. Such officers shall carry their credentials at all times when performing in their capacity as special officers. 2. The special officers mentioned above shall be divided into three categories as follows: (a) Class A Special Officers. This class shall include only employees of the city whose duties will be specified by their appointment letter, and may include but are not limited to security and property protection functions at the Salt Lake City International Airport, watching over city- owned property, such as parks, cemeteries, buildings or watershed areas. They shall serve with pay from the City as special officers with said duties as their sole or additional duties or within assignments from their own departments, as approved by the department head, the chief of police, and the mayor. (b) Class B special Officers. This class shall not be employees or agents of the city nor shall they receive any salary or other benefit or incidents of employment from the city. Members of this class shall be special self-employed officers or officers for private industry, except private detectives, not covered by Section 58-45-1, et seq., Utah Code Annotated, 1953, and for whom they act as security or other agents in one or more places within the jurisdiction of the City. This class shall include but is not limited to security officers, funeral escorts and special officers to control traffic at given times at specific locations and others. Such officers may act only as authorized, and if appropriate, at the place or places designated in the certi- ficate of appointment. (c) Class C Special Officers. This class shall include all private investigators or detectives, hired by private persons for private protection or investigation and to detect criminals or discover matters of secrecy and pernicious import for the protection of the public. 3. The chief of police shall exercise general supervision over all such special officers, and he may issue regulations governing the conduct of such officers with the concurrence of the Mayor, and if applicable, the city department, and he may -2- issue regulations governing the conduct of such officers with the concurrence of the Mayor, and if applicable, the city department, and he may remove such officer and revoke or terminate the appointment as follows: (a) Classes A, B and C special officers may be removed or their authority revoked or terminated in writing, served upon said officer, upon recommendation of the chief of police and department head, if applicable, with the concurrence of the mayor for city employees, or by the chief of police with concurrence of the mayor for all others. Said removal, revocation or termination of authority shall state the reasons therefor in reasonable detail. (b) Any officer so terminated or whose authority is revoked shall be notified in writing by certified mail sent to his last address known to City, and given an opportunity for a hearing, if requested in writing by the officer. If no hearing is requested within ten (10) days from the date on which said written notice is sent to the officer, the action of the chief of police and department head, if appli- cable, will be final when, and as specified in said letter. If such a hearing is requested, it shall be held before the mayor at a time he designates, or before a hearing officer or panel he may appoint to hear the matter and make recommendation to the mayor. The mayor's decision shall be final. 4. Class A special officers shall be appointed for a period of up to five (5) years. Such appointments may be issued at any time, but will expire on December 31, in a year ending in "0" or "5". These appointments may be cancelled at any time by the department head under which they are employed, or by the chief of police with the concurrence of the department head and the mayor, or at any time the employee leaves the employ of the city through discharge, termination or retirement. -3- ('; 5. Classes B and C special officers shall be appointed for a period of up to one year, and shall be required to renew the said certificate on or before January 1 of each year. This may be done at the same time as, and in conjunction with the obtaining of a license granted to the individual from the city to act as special officer. 6. Credentials and/or badges may be issued to said special officers at the discretion of the chief of police and with the concurrence of the mayor. Each such credential shall have clearly printed across its face, the category of special officer and expiration date of his appointment. SECTION 2. This ordinance shall take effect thirty (30) days after its first publication.
