Green Neslen Scheid - q_ `� Mr. Chairman V- Result AN ORDINANCE An ordinance levying a tax and for the assessment of property on both sides of Virginia Street between Second and Fourth Avenues, on both sides of Alta Street between Second and Fourth Avenues, on both sides of Third Vienne between Virginia and Alta Streets, and on both sides of Fourth Avenue between Virginia and Alta Streets, in Sidewalk District No. 42 (Sidewalk Extension No. 189), for the construction of cement (concrete) sidewalks. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That the Board of Commissioners of Salt Lake City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Sidewalk District No. 42 (Sidewalk Extension No. 189), for the construction of dement (concrete) sidewalks, to-wit: In Lots 1 to 25, inclusive, Block 6; 25 to 48, inclusive, Block 6; 25, Block 11, Popperton Place Subdivision; 1 to 24, inclusive, Block 5; 25 to 48, inclusive, Block 4, Popperton Place Plat "A" Subdivision, all in Section 33, Township 1 north, Range 1 east, Salt Lake Base and Meridian, and in part of said Section 63, Township 1 north, Range 1 east, Salt Lake Base and Meridian, abutting on both sides of Virginia Street between Second and Fourth Avenues, on both sides of Alta Street between -1- iy Second and Fourth Avenues, on both sides of Third Avenue between Virginia and Alta Streets, and on both sides of Fourth Avenue between Virginia and Alta Streets. This tax is levied to defray the expense of constructing dement (concrete) sidewalks five (6) feet wide and four (4) inches thick, with three and one-quarter (34) inch base and three-quarter O inch topping, upon the portions of said streets opposite the property hereinbefore and hereinafter described to be especially affected and benefited by said improvement, and it is hereby adjudged, determined and established that said property will be especially benefited thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assessed at an equal and uniform rate in accordance with the linear foot frontage upon said portions of said streets, fronting upon and to a depth of twenty-five (25) feet back therefrom, and the tax hereby levied and to be assessed upon said parcels of land is four thousand four hundred fifty-seven and 69/100 ('; ,457.69) dollars, or one and 2/100 ($1.02) dollars per front or linear foot of abutting property, there being 4370.28 feet of abutting property within the boundaries of the lots, blocks and streets above mentioned in said district, which is the total cost and cost per front foot of said sidewalks, according to the con- tract entered into for the performance of said work and making said improvement, with Ryberg Brothers, dated the 22nd day of August, 1917, and the Treasurer is hereby authorized and directed to assess, in accordance with the provisions of this ordinance, for the purpose herein mentioned: Commencing 25 feet east of the southeast corner of Lot 23, Victoria Place Subdivision of Block 17, Plat "G", Salt Lake City Survey, thence north 157 feet; commencing 25 feet east of the southeast corner of Lot 1, Victoria Place Subdivision of Block -2- 17, Plat "G", Salt Lake City Survey, thence north 157 feet; com- mencing 25 feet east of the southeast corner of Block 32, Plat "G", Salt Lake City Survey, thence north 189 feet, all in Section 33, Township 1 north Range 1 east, Salt Lake Base and Meridian; the west side of Lots 1 and 25, the east side of Lot 24, the north side of Lots 1 to 24, inclusive, Block 6; the west side of Lot 25, the south side of Lots 25 to 48, inclusive, the east side of Lot 48, Block 5, all in Popperton Place Subdivision; the west side of Lot 1, the north side of Lots 1 to 24, inclusive, the east side of Lot 24, Block 5; the south side of Lots 25 to 48, inclusive, Block 4, Popperton Place Plat "A" Subdivision; the west side of Lot 25, Block 11, Popperton Place Subdivision, all in Section 33, Township 1 north, Range 1 east, Salt Lake Base and Meridian; oommencing 15 feet north of the northwest corner of Lot 25, Block 11, Popperton Place Subdivision, thenoe north 140 feet; commencing 66 feet east and 15 feet south of the southeast corner of Lot 48, Block 5, Popperton Place Subdivision, thence north 300.28 feet; commencing 66 feet east of the southeast corner of Lot 48, Block 4, Popperton Place Plat "A"Subdivision, thence south 27 feet, all in Section 33, Township 1 north, Range 1 east,Salt Lake Base and Meridian, as the same are shown upon the official plats of said city to a depth of twenty-five (25) feet back from said streets, and to collect said tax. SECTION 2. Said tax shall become and be delinquent in five equal yearly installments, with interest on the whole sum unpaid at the rate of six per cent per annum, payable at the time each installment is due, to-wit: One-fifth thereof one year after the ordinance confirming the levy of the tax for the payment for such improvement becomes effective; one-fifth thereof in two years after said ordinance becomes effective; one-fifth thereof in three years after said ordinance becomes effective; one-fifth -3- ) thereof in four years after said ordinance becomes effective; and one-fifth thereof in five years after said ordinance becomes effective. One or more of said installments, in the order in which they are payable, or the whole special tqx, may be paid at any time within thirty days after the ordinance confirming the levy of the tax becomes effective, without interest. In the event of any installment or the interest aforesaid not being paid on the date the sane becomes due, the whole> amount of the special tax unpaid at tbe. time, said installment 'and interest are dhe, shall become due and payable, and shall drIleinterest at the rate of eight per cent per annum until the e141e of the prop- erty assessed; provided; one or more installments, in the order in which they are payable, or the whole special tax unpaid, may be paid on the day any installment becomes due, by paying the amount thereof and interest to said date.
