AN ORDINANCE Result . . . . /e' AN ORDINANCE AMENDING Title 29 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to the Salt Lake City Plumbing Code, 1964 Edition. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Title 29 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to the plumbing code, be, and the same hereby is, amended in its entirety to read as follows: "TITLE 29 "PLUMBING "CHAPTER 1 "Sec. 29-1-1. Designation. This title shall be known as the Salt Lake City Plumbing Code. "Sec. 29-1-2. Uniform code adopted. The Utah Plumbing Code of 1964, as amended 1968, and published by the State of Utah as a code in book form, three copies of which have been filed for use and examination by the public in the office of the city recorder and which establishes rules and regulations for the installation, maintenance and repair of plumbing, is hereby adopted except as such code may be altered or modified by the provisions of the ordinances of Salt Lake City. "Sec. 29-1-3. Application and scope. The provisions of this code shall apply to all new construction, relocated buildings, and to any alterations, repairs or reconstruction, except as otherwise provided for in this code. "Sec. 29-1-4. Definition of 'trade of plumbing'. The performing of any mechanical work pertaining to the installa- tion, alteration, change, repair, removal, maintenance and use in buildings or on the premises thereabouts of the pipe, fix- tures and fittings for bringing in the water supply and removing liquid and water carried wastes, and every connection discharging, direct or indirect, into the building drainage systems and shall include the water supply, distribution pipes, fixtures and fix- CS.R. -2- ture traps, the soil, waste and vent pipes, the building drain, roof drains where installed inside the walls of a building, settling traps, septic tanks and cesspools with their devices, appurtenances and connections." "CHAPTER 2 "Sec. 29-2-1. Office of city plumbing inspector created. There is hereby created the office of city plumbing inspector within the engineering department. "Sec. 29-2-2. Appointment. The board of commissioners upon the recommendation of the commissioner of streets and public improvements shall appoint a qualified person to be the city plumbing inspector. "Sec. 29-2-3. Qualifications. For at least five years prior to appointment, the city plumbing inspector shall have been a licensed journeyman plumber or plumbing con- tractor licensed by the State of Utah or some other state having comparable licensing provisions. In the event no such person is available, the plumbing inspector shall have had background in the trade dfplumbing or general building, and shall be familiar with the plumbing laws and regulations of the State and city. "Sec. 29-2-4. Assistants. The plumbing inspector shall be furnished with assistants and staff as the board of com- missioners in its discretion shall provide. "Sec. 29-2-5. Duties. The plumbing inspector shall maintain public office hours necessary to efficiently administer the provisions of this code and amendments thereto and shall perform the following duties: "(1) Maintain an official register of all persons, firms or corporations lawfully entitled to carry on or engage in the business of plumbing or to labor at the trade of plumbing to whom a license has been issued by the Department of Con- tractors cf the State of Utah. "(2) Issue plumbing permits to properly licensed, bonded and registered persons, firms or corporations for plumbing work to be done within Salt Lake City. "(3) Administer and enforce the provisions of this code in a manner consistent with the intent thereof and inspect all plumbing and drainage work authorized by any permit to assure compliance with provisions of this code or amendments thereto, approving or condemning said work in whole or in part as conditions require. "(4) Issue upon request a certificate of approval for any work approved by him. "(5) Condemn and reject all work done or being done or materials used or being used which do not in all respects ('S. -3- comply with the provisions of this code and amendments thereto. "(6) Order changes in workmanship and/or materials essential to obtain compliance with all provisions of this code. "(7) Investigate any construction or work regulated by this code and issue such notices and orders as are necessary to prevent or correct dangerous or insanitary conditions. "(8) To recommend revocation of license to the state department of business regulation for cause, and to report to the said department of business regulation all violations of the Salt Lake City plumbing ordinance by journeymen, apprentices or contractors. "Sec. 29-2-6. Allowance for exception to code. Where structural conditions are extremely adverse to full com- pliance with the plumbing regulations of this plumbing code, the plumbing inspector may grant special permission to deviate from the regulations, provided that in the judgment of the plumbing inspector such deviation does not create an insanitary or unsafe condition, and further provided that the request for deviation is submitted for approval in writing in advance of the construction. "Sec. 29-2-7. Personal liability. The plumbing inspector, when acting in good faith and without malice for the city in the discharge of his duties, shall not thereby render himself liable personally and he is hereby relieved from all personal liability for any damage that may accrue to persons or property as a result of any act required or by reason of any act or omission in the discharge of his duties. "Sec. 29-2-8. Right of entry granted. Such plumbing inspector shall have the right of entry within reasonable hours to any building or premise for the purpose of inspec- tion or to investigate any work or conditions governed by this plumbing code. "Sec. 29-2-9. Power to condemn granted. The plumbing inspector is hereby empowered to condemn and order repaired, removed, replaced or changed any plumbing found in an insanitary condition or not in accordance with the plumbing code. "Sec. 29-2-10. Interest in sale or installation of equip- ment prohibited. The city plumbing inspector and his assis- tants shall not in any way engage in the sale or installation of plumbing equipment upon which they are required to make inspection hereunder." "CHAPTER 3 "Sec. 29-3-1. Registration required. It shall be unlawful for any person, firm or corporation licensed by the State of 81 -4- Utah to perform any work requiring a plumbing permit in Salt Lake City without first having registered with the city plumbing inspector. "Seca 29-3-2. Registration. Applicant for registration shall furnish evidence that said applicant is currently licensed under the provisions of the Utah Contractor's License Law, as it presently exists or hereafter may be amended, giving the number of the license; shall have secured all licenses required by the ordinances of Salt Lake City; and shall file with Salt Lake City a surety bond in the sum of one thousand dollars. "Sec. 29-3-3. License bond. The license registration bond shall be a surety bond issued by a corporate surety authorized to do business in the State of Utah, which bond shall be filed with the city engineer and approved by the city attorney, and shall be conditioned that the said appli- cant during the term for which said registration shall be granted shall faithfully observe and comply with the pro- visions of all ordinances of Salt Lake City regulating the trade of plumbing and such 'bond shall indemnify Salt Lake City and any person injured or damaged through the failure of the applicant to comply with said ordinances. "Sec. 29-3-4. Excavation bond. Any person, firm or corporation properly licensed to do business in the trade of plumbing who in the course of their work has occasion to excavate in city streets, alleys or rights of way shall file an additional bond with Salt Lake City in the sum of ten thousand dollars as required by Chapter 5, Title 41, Revised Ordinances of Salt Lake City, Utah, 1965, as amended. "Sec. 29-3-5. Registration fee. Each person, firm or corporation required to register in accordance with this chapter shall pay a registration fee of ten dollars. "Sec. 29-3-6. Permits required. Except as otherwise provided by this title it shall be unlawful for any person to begin any plumbing work without first obtaining a permit for such plumbing work from the office of the plumbing inspector. "Sec. 29-3-7. Permits to be issued only to licensed con- tractors. Except as otherwise provided by this title it shall be unlawful to issue a permit to any person other than a duly registered general contractor or specialty contractor licensed to do business in the trade of plumbing by the Utah State Department of Business Regulation. "Sec. 29-3-8. License not transferrable. It shall be unlawful for any registered contractor to use his license or to allow his license to be used in any way for the purpose of procuring a permit for any person other than himself. "Sec. 29-3-9. Revocation of permit. The plumbing inspec- tor may revoke any permit when the person to whom the permit 81 -5- is issued fails, neglects or refuses to do the work thereunder in conformance with this title, or when permit issued in error. "Sec. 29-3-10. Expiration of permit. Every permit issued by the plumbing inspector shall expire by limita- tion and become null and void, if the work authorized by such permit is not commenced within sixty days from the date of such permit, or if the work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of one hundred and twenty days. "Sec. 29-3-11. Denial of permit. The plumbing inspector may refuse to issue any permits for any plumbing work to any person who has had a permit revoked in accordance with this title during such time as such person fails to perform plumbing work in conformance with this title. "Sec. 29-3-12. Hearing on revocation or denial of permit. Any person adversely effected by the action of the plumbing inspector in accordance with the proceeding sections may appeal to the board of commissioners of Salt Lake City for a hearing upon such revocation or denial. "Sec. 29-3-13. Penalty for beginning work without permit. If any work regulated by this plumbing code for which a per- mit is required is commenced without a permit first having been obtained therefor, double the permit fee herein prescribed shall be paid by the defaulting party when the permit is obtained. Payment of any fee mentioned in this section, however, shall in no way relieve any person of the penalties that may be imposed for violation of the plumbing code. "Sec. 29-3-14. Permits not required. Repairs which involve only the working parts of a faucet or valve, the clearance of stoppages, the repairing of leaks or the replacement of defec- tive faucets or valves may be made without a permit provided no alterations are made in the existing piping to fixtures, and provided that the permits shall be procured to replace fixtures, traps, soil, waste and vent pipes unless waived by the plumbing inspector. "Sec. 29-3-15. License required for cleaners and repairers. It shall be unlawful for any person other than a duly registered person to engage in the business of doing the class of work men- tioned in the preceeding section in a capacity or status of service to the public and it shall be unlawful for any person other than a duly registered person to indicate by the display of any sign or advertisement that he is permitted to engage in the class of work mentioned in said section, or to serve the public in any work governed by the plumbing code. "Sec. 29-3-16. Home ower permit. Any permit required by this code may be issued to any person to do any plumbing or drainage work regulated by this code in a single family dwelling used exclusively for living purposes, including the usual -6- accessory buildings and quarters in connection with such buildings in the event that any such person is the bona fide owner of any such dwelling and accessory buildings and quarters, and that the same are occupied by or designed to be occupied by said owner, and further provided that said owner shall furnish the plumbing inspector with a complete layout drawing of the pro- posed work, satisfies the plumbing inspector that he has a working knowledge of the code requirements, pays the necessary fees, and calls for all inspections required by this code. "Sec. 29-3-17. Permit not transferrable. When any plumbing work is not completed by a permittee under the permit issued to him for the said work and the work in question is added to or completed by one or more registered contractors, each registered contractor shall procure a permit covering the work he performs. "Sec. 29-3-18. Permit fees. Before a permit shall be issued, permit fees as follows shall be paid to the city treasurer: "For issuing each permit, unless waived by inspector $1.00 "For each plumbing fixture or trap roughed in for, installed or changed in location 2.00 "Change, altering or replacement of soil, waste or vent pipe 2.00 "Each roof drain installed inside building 2.00 "Each mechanical refrigeration drain and each safe drain discharging direct or indirect into the building drainage system 2.00 "Each air conditioning apparatus discharging into the building drainage system 2.00 "Water softener or water conditioning equipment 2.00 "Electric water heaters 2.00 "Septic tank connections from house 3.00 "Pools for roof drains 2.00 "Each store, restaurant or home appliance or apparatus connected to the culinary water supply and/or building drainage system 2.00 "Installation, alteration or repair of water piping 2.00 "For each lawn sprinkler control valve system on any one meter including backflow devices therefor 5.00 -7- "For vacuum breakers or backflow protective device on tanks, vats, etc., or for installation on unpro- tected plumbing fixtures including necessary water piping $2.00 "Sec. 29-3-19. Reinspection charge. After notice that any plumbing work is ready for inspection and the plumbing inspector calls at the place designated to make such inspec- tion and finds the work not ready for inspection, he shall charge an additional inspection fee of three dollars for each additional inspection required." "CHAPTER 4 "Sec. 29-4-1. Operating without state license prohibited. It shall be unlawful for any person to engage in the trade of plumbing in Salt Lake City without first being duly licensed as a journeyman plumber, apprentice plumber, specialty plumbing contractor or general contractor with the state department of business regulation. "Sec. 29-4-2. Acts of apprentices prohibited. It shall be unlawful for an apprentice to engage in the trade of plumbing except he be under the direct supervision of a journeyman present in the same building or on the premises thereabouts. "Sec. 29-4-3. Inspection required for connections. It shall be unlawful for any person to connect any plumbing work to the Salt Lake City water supply system or sewer system in the absence of inspection, approval and certification by the city plumbing inspector as provided in the preceeding chapter. "Sec. 29-4-4. Mandatory and prohibitory nature of title. The provisions of this title whether directory or prohibitory shall be mandatory upon all persons and it shall be unlawful for any person to violate or cause to be violated any pro- vision of this title. "Sec. 29-4-5. Refusal to comply with order of inspector. It shall be unlawful for any owner, agent or occupant of any building or premises to fail, neglect or refuse to repair, remove, replace or change within ten days after written notice so to do from the plumbing inspector any plumbing condemned by such :inspector. "Sec. 29-4-6. Exception for minor repairs. Any person regularly employed by an owner or lessee of property, or his agents for the sole purpose of operating and maintaining such property and to make minor repairs thereof, and any owner or lessee of property shall be exempt from the provisions of this title when doing work for which permits are not required. "Sec. 29-4-7. Liability of employers and agents to penalty for violation of ordinances. When the provisions of an ordinance prohibit the commission or omission of an act, not only the per- son actually doing the prohibited thing or omitting the directed -8- act, but also the employer and all other persons concerned or aiding or abetting therein, shall be guilty of the offense described and liable to the penalty prescribed for the offense. "Sec. 29-4-8. Continuing offenses deemed daily violation. Where no other penalty is prescribed any person convicted of violating any provision of this title shall be punished by a fine in any sum not exceeding two hundred ninety-nine dollars, or by imprisonment in the city-county jail for a period not longer than six months, or by both such fine and imprisonment."
