(Vacation of six alleys in the Prospect Park Subdivision
and the Utah Southern Addition Subdivision located in the
area of the 1700 South and Redwood Road)
AN ORDINANCE VACATING SIX ALLEYS LOCATED WITHIN THE PROSPECT
PARK SUBDIVISION AND THE UTAH SOUTHERN ADDITION, SUBDIVISION
SITUATED NEAR REDWOOD ROAD, AND THE JORDAN AND SALT LAKE CANAL
NORTH OF 1700 SOUTH STREET IN SALT LAKE CITY, UTAH.
WHEREAS, the City Council of Salt Lake City finds that the
City's fee simple interest in the alleys described below, which
were formally dedicated within the Prospect Park Subdivision and
the Prospect Park and the Utah Southern Addition, are no longer
necessary for use as public alleyways, and that the vacation of
said alleys within said subdivisions will not be adverse to the
general public's interest.
NOW, THEREFORE, be it ordained by the City Council of Salt
Lake City, Utah:
SECTION 1. That the six alleys located within the Prospect
Park Subdivision, portions thereof which are described and
located in Blocks 2, 3, 7, 10 and 12 of the Prospect Park
Subdivision as it is located north of 1700 South Street between
Redwood Road and the Salt Lake Jordan Canal, which were the
subject of a Petition 110 of 1971 and as modified therein, more
particularly described below, be, and the same hereby are,
vacated and declared no longer to be needed or available for use
as a public alley.
Parcel 1 - Irregular shaped in Block 2:
Commencing at the northwest corner of Lot 4, Block
2 of Prospect Park Subdivision; thence North 15
feet; thence East 145± feet to the west line of
Jordan Salt Lake Surplus Canal; thence south- co
easterly along said line 35± feet to northeast
corner, Lot 19, said Block; thence South 125± feet' C7i
East 100 feet to the west line of said canal;
thence southeasterly along said line 20± feet to a
point on the north line of Lot 17; thence West
110± feet to northwest corner of Lot 14; thence
South 125± feet to the north line of Harris
Avenue; thence West 16 feet; thence North 276 feet J:A
to the northeast corner of Lot 4; thence West 145 OD
feet to the point of beginning.

Parcel 2 - East-west alley in Block 3:
Commencing at the northwest corner of Lot 1, Block
3, of the Prospect Park Subdivision; thence North
15 feet to the north boundary line of said
subdivision, thence East 140 feet; South 15' to
the northeast corner of Lot 1, said Block 3;
thence West 140 feet to the point of beginning.
Parcel 3 - North-south alley on Block 7:
Beginning at a point on the northeast corner of
Lot 2, Block 7 of Prospect Park Subdivision;
thence south 276 feet to the southeast corner of
Lot 11; thence east 16 feet to the southwest
corner of Lot 12; thence north 276 feet to the
northwest corner of Lot 1; thence west 16 feet to
the point of beginning.
Parcel 4 - North-south alley in Block 10:
Beginning at the northeast corner of Lot 2, Block
10, Prospect Park Subdivision; thence running
south 246 feet more or less to the southeast
corner of Lot 10; thence east 16 feet; thence
north 246 feet more or less, to the northwest
corner of Lot 1; thence west 16 feet to the point
of beginning.
Parcel 5 - North-south alley in Block 12:
Beginning at the northeast corner of Lot 2, Block
12, Prospect Park Subdivision; thence south 246
feet more or less, to the southeast corner of Lot
10 of said Block; thence east 12± feet to south-
west corner of Lot 13; thence north 246 feet more
or less, to the northwest corner of Lot 1 of said
Block; thence west 12 feet more or less to the
point of beginning.
SECTION 2. That the following described portion of an alley
located between Redwood Road and Utah Street approximately 825
feet south of California Avenue, which runs south-north in the
Utah Southern Addition in Salt Lake City, Utah, more particularly
described below, be, and the same, hereby is vacated and declared
no longer to be needed or available for use as a public alleyway.
Parcel 6 - Alley in Utah Southern Addition north
of Surplus Canal:
Commencing at the northeast corner of Lot 6, Block
2, Utah Southern Addition of Z.P. Smith's G
subdivision, located in the northwest quarter of N
the northeast quarter of Section 15, Township 1 V
South, Range 1 West, Salt Lake Base & Meridian;
thence north 0° 04' 04" west 137.5 feet; thence
south 21° 33' 25" east 54.52 feet; thence south 0°
04' east 86.75 feet; thence south 89° 55' 56" west GI
20 feet to the point of beginning. GO

SECTION 3. Reservation of Easements. That the actions of
City Council in relinquishing its interest in said alleys
described above in both sections 1 and 2 are subject to the
following interest and easements which are reserved to Salt Lake
City Corporation and the public.
(a) Said vacation actions are expressly made SUBJECT TO all
existing rights-of-ways and easements of all public utilities of
any and every description, now located on, in, under or over the
confines of the above described property, and also SUBJECT TO the
rights of entery thereon for the purposes of obtaining, altering,
repairing or replacing, removing or rerouting said utilties and
all of them.
(b) Said vacation is also SUBJECT TO any existing rights-
of-ways or easements of private third parties.
(c) It is further understood and acknowledged that in the
area there is located a drainage facility known as the C.W.
Drain. At the present time said drain exists and its easement is
prescriptive in nature and its exact location has not been
platted. There is hereby reserved in the City's action of
vacation a 20 foot easement, 10 feet on each side of the
centerline of said drain for the purposes of the preservation of
said drainage easement.
SECTION 4. This vacation is made expressly subject to the
condition subsequent of the completion by the petitioners of a
survey to locate and plat the 20 foot easement for the C. W.
drain facility presently located in the area. The expense of
surveying and relocating any to portions thereof accommodate
deelopment is the petitioners. This ordinance shall be published
but shall not take effect until recorded. The City Recorder is
instructed that no recording shall take place until a certificate W
of survey bearing the approval of the City Engineer locating the ti
C. W. Drain is also submitted for recording. In the event such a g
certificate of survey locating the 20' easement to be reserved is S
not approved by the City Engineer and filed of record by the City

Recorder within 12 months from the date hereof, this ordinance
shall be of no legal force and effect and shall not be recorded
in the office of the Salt Lake County Recorder.
SECTION 5. This Ordinance, subject to the conditions set
forth in Section 4 above, shall take effect upon the date of the
recording of said ordinance with the Salt Lake County Recorder's
office.
