AN ORDINANCE AMENDING Sections 1-3-2, 1-3-3 and 1-3-24of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to licensing and impounding dogs. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Sections 1-3-2, 1-3-3 and 1-3-24 of the Revised Ordinances of Salt Lake city, Utah, 1965, relating to licensing and impounding dogs, be, and the same are hereby, amended to read as follows: "Sec. 1-3-2. License and registration required. It shall be unlawful for any person to own, keep, harbor or maintain in Salt Lake City any dog which has been weaned or has attained the age of two months unless such dog has been licensed and registered as herein provided, and any person convicted of violating this ordinance shall be punished by a fine in any sum not exceeding two hundred ninety-nine dollars, or by imprisonment in the city jail for a period not longer than six months, or by both such fine and imprisonment. Dog licenses shall be issued by the department of animal control upon the payment of a license fee of three dollars for each dog, male or female, to said department of animal control or an authorized representative thereof. The owner shall state at the time application is made for such license, his name and address, and the sex, breed and color of each dog owned or kept by him. The license fee shall cover the calendar year in which the license is issued and such license shall expire on the thirty- first day of December of the year in which it was issued regardless of the date of issuance. The provisions of this section are subject to the following exceptions: "(1) The provisions of this section shall not be intended to apply to dogs whose owners are non-residents temporarily within the city for thirty days or less, nor to dogs brought into the city for the purpose of participating in any dog show, nor to commercial kennels. "(2) Dogs used as guides for blind persons and commonly known as seeing eye dogs shall be licensed and registered as other dogs hereinabove provided for except that the owner or keeper of such dog shall not be required to pay any fee therefor.' "Sec. 1-3-3. Date of license. The owner of any dog of licensing age shall pay a fee of three dollars annually for each dog, male or female, said license fee being payable from the first day of January to the first day of March of each year, inclusive. Any 84 -2- person, during the period mentioned in this section, who keeps or harbors a dog within the corporate limits of Salt Lake City, and fails to register said dog as herein provided, shall pay the sum of ten dollars for such dog, male or female, as a license fee. The owner of any newly-acquired dog of licensing age or of any dog which attains licensing age, shall make application for a license and official metal registration tag for such dog within ten days after such acquisition or age attainment. "Sec. 1-3-24. Redemption of impounded dogs. Any dog impounded as a licensed or unlicensed dog may be redeemed and taken from such pound by the owner or any authorized person, upon exhibiting to the supervisor or person having charge of said pound, a certificate of registry as provided in Section 1-3-5 showing that the license imposed by this chapter has been paid for such dog and upon paying the person in charge of said pound an impounding fee of ten dollars and the sum of fifty cents for each and every day such dog shall have been impounded. All impounded dogs not redeemed within five days shall be sold for the best price obtainable, at either private or public sale and all moneys received from such sales shall be paid daily to the treasurer of Salt Lake City. All dogs that are not sold or redeemed in the required time shall be killed in a humane manner." SECTION 2. In the opinion of the Board of Commissioners of Salt Lake City, Utah, it is necessary to the peace, health and welfare of the inhabitants of Salt Lake City that this ordinance become effective immediately. SECTION 3. This ordinance shall take effect upon its first publi- cation.
