85 of 1911 - Ordinance 85 of 1911 – Curb and Gutter Extension No. 16, First Partial Estimate.
AN ORDINANCE . An ordinance levying a tax and for the assessment of property on both sides of Seventh East Street between Martin and Tempest Avenues, in Paving District No. 31, for the purpose of providing for the grading, guttering and ourbing thereof, constructing storm sewer, inlet to storm sewer, and water boxes as hereinafter desoribed. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That the City Council does hereby levy the tax and provide for the assessment of the same upon the property here- inafter described in Paving District No. 31, for the purpose of the grading, guttering and curbing of a portion thereof, also con- structing a storm sewer, inlet to storm sewer, and water boxes thereof, to-wit: In Lots 2, 4, 5, 6, 7, 9, 10 and 11, Block 15; 23 to 30, in- clusive, Violet Addition, Block 15; 28 to 36, inclusive, Perkins' Fourth Addition, Block 15; 1 and 37, and 16 to 28, inclusive, Bl,o. 1, Marion Park Subdivision, Block 14; 1 and 13 to 22, inclusive, Block 1, Maryland Subdivision, Block 14; 1 to 4, inclusive, and 49 1, 16, 19 and 2., to 52, inclusive, Grand Haven Subdivision, Block 14; lixistx22x 23 Block 14; 1 and 19 to 28-, inclusive, Block 1, Ouray Place Subdivi- sion, Block 14; 1 to 10, inclusive, Midvale Subdivision, Block 14, Alixtft abutting on both sides of Seventh East Street between Marti. and Tempest Avenues. This tax is levied to defray the expense of grading, guttering and curbing with oement, constructing storm sewer inside curb of vitrified pipe eight (8), ten (10), and twelve (12) inches in diem eter, and across streets of wrought iron pipe twelve (12) inches i diameter; also constructing inlet to storm sewer from gutter, of vitrified pipe eight (8) inches in diameter; also constructing cement water boxes two (2) feet by two (2) feet, opposite the property hereinbefore and hereinafter described to be especially affected and benefited by said improvement, and it is hereby ad- judged, determined and established that said property will be 85 -2•- especially benefited thereby to the full amount of the tax hereby levied, and said parcels of land are hereby assessed at an equal and uniform rate in accordance with the linear foot frontage upon said portions of said streets fronting upon and to a depth of twenry- five (25) feet back therefrom, and the tax hereby levied and to be assessed upon said parcels of land is eight thousand seven hundred two and 98/100 (e8,702.98) dollars, or one and 615792/1,000,000 (01.615792) dollars per front or linear foot of abutting property for grading, guttering and curbing with cement, constructing storm sewer, inlet to storm sewer, and water boxes on said portion of th street above mentioned in Paving District No. 31, there being 5384.2 feet of abutting property within the boundaries of the lots, blooks and street above mentioned, which is the total cost and cost per front foot of said improvement, according to the contract entered into Istilvskitaxilsintaxtbsiitsitert for the performance of said work and making said improvement with the Gillis Construction Company, dated the 12th day of June, 1911, and the Treasurer is hereby authorised and directed to assess in accordance with the provisions of this ordinance for the purpose herein mentioned: The west side of Lots 9, 10 and 11, Block 15; the west side o Lots 23 to S0, inclusive, Violet Addition, Block 15; the west side of the north 146.1 feet of Lot 7, the west side of the south 115.5 feet of Lot 7, Block 15; the west side of Lots 4, 5 and 6, Block 15; the west side of Lots 28 to 36, inolusive, Perkins' Fourth Addition, Block 15; the west side of Lot 2, Block 16; the east side of Lot 37, Block 1, Marion Park Subdivision, Block 14; the east aide of Lots 1, and 16 to 28, inclusive, Block 1, Marion Park Subdivision, Block 14 he east side of Lots 1, and 13 to 22, inclusive, Block 1, Maryland subdivision, Block 14; the east side of Lots 49 to 52, inclusive, he east side of Lots 1 to 4, inclusive, Grand Haven Subdivision, '.lock 14; the east side of Lot 16, Block 14; the east aide of Lots � , and 19 to 23, inclusive, Block 1, Ouray Place Subdivision, Block -3- 14; the east side of Lots 1 to 10, inclusive, Block 1, Midvale Sub division, Block 14; the east side of Lots 1, 19 and 20, Block 14, Five Aore Plat "A", Big Field Survey, as the same are shown upon the official plats of said city to a depth of twenty-five (25) fee' bank from said street, and to collect said tex. SECTION 2. Said tax shall become and be delinquent in five equal yearly installments, with interest on the whole sum unpaid at the rate of Six per cent per annum, payable at the time each in stallment is due, to-wit: One-fifth thereof one year after the ap proval of the ordinance confirming the levy of the tax for the pay ment for such improYement; one-fifth thereof in two veers after su•h approval; one-fifth thereof in three years after;ouch approval; on-- fifth thereof in four years after such approval; and one-fifth the e- of in five years after such approval. One or more of said install ments,in the order in which they are payable, or the whole special tax may be paid at any time within thirty days after the approval of the ordinance confirming the levy of the tax, without interest. In the event of any installment or the interest aforesaid not bein: paid on the date the same becomes due, the whole amount of the special tax unpaid at the time said installment and interest are due, shal beoome due and payable, and shall draw interest at the rate of eigJt per cent per annum until sale of the property assessed; provided, one or more installments, in the order in which they are payable, or the whole speoial tax unpaid may be paid on the day any install meat becomes due, by paying the amount thereof and interest to sad, date. SECTION 3. This ordinance shall take effect upon approval.
