Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Sections 25-12-1, 25-12-2, 25-12-3 and 25-12-4, of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to the office of city attorney, be, and the same hereby are, amended to read as follows: "Sec. 25-12-1. Creation of office of city attorney. There is hereby created the offices of city attorney, deputy city attorney, assistant city attorneys, city prosecutor and assistant city prosecutors. Each of said offices shall be filled by appointment by the board of commissioners of Salt Lake City. "Sec. 25-12-2. Duties. The law department of salt Lake City shall comprise the offices of city attorney, deputy city attorney, assistant city attorneys, city prosecutor and assistant city prosecutors. The law department shall have charge of all legal matters pertaining to the rights, obligations, property, property rights, administration, officers and agents of Salt Lake City; it shall also have charge, in the city's behalf, of all litigation to which the city is a party. Should any of said officers have personal knowledge of any violation of a city ordinance, or receive reliable information of any such violation, he shall immediately institute the necessary steps to bring the offender to punishment. "Sec. 25-12-3. Duties of city attorney. The city attorney shall attend the meetings of the board of commissioners; but such attendance upon any given meeting may be waived by the board at its election. He, or any officer of the law department, subject to his direction, shall advise and counsel the board of commissioners and the members thereof, and all other officers of the city upon such questions of law pertaining to the business, property and all affairs of the city as may from time to time arise. He, or any officer of the law department, subject to his direction, shall prosecute and defend in all courts all actions on behalf of the city, and defend all actions against any officer or agent of the city, on account of his official acts; he shall take appeals on behalf of the city or any officer as aforesaid, with the consent and approval of the board of commissioners; and either he or any officer of the law department, subject to his direction, may make the necessary affi- davits and verifications on behalf of the city in any and all proceedings. He, or any of the foregoing officers under his direction, shall draft all ordinances and prepare all legal documents required in the transaction of the city's business. The city attorney shall be the head of the law department, and shall have charge and direction thereof. In the absence of, or during the disability of the city attorney, all functions, powers and duties of said office shall be exercised and performed by the deputy city attorney. In case of the absence or disability of the city attorney and the deputy city attorney, such functions, powers,and duties shall be discharged by the assistant city attorney with the longest tenure in that office. "Sec. 25-12-4. Duties of subordinate officers. The deputy city attorney, assistant city attorneys, city prosecutor and assistant city prosecutors shall aid the city attorney in all matters pertaining to the city's legal business as required, and shall conduct such litigation and attend to such other legal matters in behalf of the city and its officers as the board of com- missioners or the city attorney may require." 85 -2- SECTION 2. In the opinion of the Board of Commissioners of Salt Lake City, it is necessary to the peace, health and welfare of the inhabitants of Salt Lake City that this ordinance become effective immediately. SECTION 3. This ordinance shall take effect upon its first publication. Passed by the Board of Commissioners of Salt Lake City, Utah, this 8th day of August, 1972.
