HomeMy WebLinkAbout87 of 1981 - Closing all of Folsom Street (#50 South), as it runs west from 200 West Street to approximately 275 SALT LAKE CITY ORDINANCE No. 87 of 1981 (Closing Folsom Street in Block 78, Plat A, at approximately 50 South from 200-275 West) AN ORDINANCE CLOSING FOLSOM STREET IN BLOCK 78, PLAT A, AT APPROXIMATELY 50 SOUTH FROM 200-275 WEST. WHEREAS, Petition No. 591 of 1981, submitted by Salt Lake County Commission, requests the vacation of Folsom Street (#50 South) , in Block 78 of Plat A as it extends west from 200 West Street for the purposes of accomodating the expansion of the Salt Palace Project; and WHEREAS, a review of said Petition indicates that vacation would be contrary to the policy of the City, but, in lieu thereof, that closure would be appropriate, based upon the Council's finding that most of said street is no longer necessary for use as a public street, avenue or alley, but should be closed, with the public interest being retained for anticipated transfer to the petitioner, based on certain conditions and reservations; THEREFORE, be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. That all of Folsom Street (#50 South) , as it runs west from 200 West Street to approximately 275 West, located within Block 78 of Plat A, Salt Lake City Survey, in Salt Lake City, Utah, more particularly described below, be and the same hereby is, CLOSED and declared no longer to be needed or available for use as a public street, avenue, alley, or pedestrian way, however, the public's interest therein shall be reserved for a contemplated transfer to accommodate the expansion of the Salt Palace. Beginning at the Northeast corner of Lot 1, Block 78, Plat A, Salt Lake City Survey, thence running south 30 feet; thence west along the entire length of the platted south line of said street 416.5'±; thence north 30'± to the north line of Lot 3 of said Block; thence west along said north line 7'2"+ to the west line of Folsom Street in Lot 6; thence north along said west line 25'± to the existing north line of Folsom ; thence east 93'8"+ to the east line of Lot 6; thence north 5'± to a point on the north line of Folsom Street; thence east 330'+ along said north line to the west line of 200 West Street; thence south 30'+ to the point of beginning. Said CLOSURE is expressly SUBJECT TO all existing rights of way and easements of all public utilities of any and every description, now located on, in, under or over the confines of the above-described property, and also SUBJECT TO the rights of entry thereon for the purpose of obtaining, altering, replacing, removing, repairing, or rerouting said utilities and all of them. Said CLOSURE is also subject to any existing rights of way or easements of private third parties. SECTION 2. Conditions Subsequent. This ordinance, after passage, shall be published, but shall not become effective until conditions subsequent, which form a portion of the consi- deration for this action, have been satisfied. Such consideration includes the requirement that prior to any transfer the Petitioner provide documentation verifying an alternative method of access to properties located at the west end of Folsom Street has been established via a non-exclusive easement or right of way not less than 26+ feet in width, and which can accommodate a minimum of 35 foot turnaround radius according to a plan approved by the City. The act of closing said road contemplates making the land available to ultimate transfer to Salt Lake County or abutting property owners for appropriate value to accommodate the expansion of the Salt Palace. Before executing any final documents for such transfer, the Council will be advised of proposed terms. If said terms are found unacceptable by the Council, the Mayor may proceed by way of agreement to transfer title. This ordinance shall be recorded with the County Recorder concurrently with the approved documents to transfer title to all or part of said road. SECTION 3. This ordinance, after the date of its first publication, shall not become effective until recorded with the recorder of Salt Lake County as designated in Section 2 above. If the foregoing conditions specified in Section 3 are not completed within twelve (12) months from the date of passage, this ordinance shall be null, void, and of no effect and no recording shall be allowed. Section 2 of this ordinance indicates that it shall not become effective until conditions subsequent have been satisfied. Such consideration includes the re- quirement that prior to any transfer the petitioner provide documentation verifying an alternative method of access to properties located at the west end of Folsom Street has been established via a non-exclusive easement or right of way not less than 26+ feet in width, and which can accommodate a minimum of 35 foot turnaround radius according to a plan approved by the city. In this event, according to Section 3 of the ordinance, if the conditions specified are not completed within twelve months from the date of passage, this ordinance shall be null, void, and of no effect and no recording shall he allowed. The records in our office will reflect that the conditions were not met and the ordinance is null and void. Attached for your convenience is a copy of the ordinance.
