AN ORDINANCE

An ordinance granting to Bamberger Railroad Company, its successors and \
assigns, a franchise and right of way for the construction, reconstruction and
maintenance of railroad tracks upon and over certain streets in Salt Lake City,
Utah.
Be it ordained by the Board of Commissioners of Salt Lake City, Utah:
Section 1. A franchise and right of way is hereby granted to Bamberger
Railroad Company, a corporation of the State of Utah, and its successors and assigns,
to construct, reconstruct, maintain and operate a single or double track standard
gauge railroad to be operated by electric, gas, diesel or other power, for the
transportation of passengers, freight, express and mail matter, together with all
necessary switches, wyes, turnouts, side tracks and crossover tracks, and to erect
and maintain all poles carrying telephone, telegraph, signal, trolley, power or
other transmission wires necessary to the operation of said railroad, over, upon
and along the following streets in Salt Lake City, Utah, together with the right
to cross all streets and alleys intersecting such streets, more particularly
described as follows, to-wit:
Across Utah State Highway No. 135, which runs east and west,
at the center of a double track which is approximately 1320 feet
north and 210 feet east of the southwest corner of the southeast
quarter of Sec. 14 tp. 1 N. Rg. 1 W. S.L. Mer.; thence south
3°1.;1' west across said highway for 66 feet; thence continuing
for 370 feet; thence on a 3° curve to the left for 275.5 feet;
thence south 1i.°35' east along, parallel to, and partly upon the
west side of Beck Street and partly upon private right of way for
1762 feet; thence on a 00 22' curve to the left for 100 feet;
thence south LP 13' east for 1382 feet crossing 18th North Street
and Trenton Avenue to the north line of 17th North Street in Folsom
Addition, at the east-west quarter section line of said Section 1,4;
thence on a 6° curve to the left across 17th North Street, Chicago
Street and Bertella Avenue (now closed); thence on said curve for
230 feet to point of tangent in Lot 8 Block 17 of Folsom Addition;

thence south 44° 01' east for 79 feet to the north line of 16th
North Street on the south line of Lot 6 Block 17; thence for 91.7
feet across 16th North Street; thence for 100 feet, more or less,
to the northerly end of Hot Springs Street; thence along the
center line of Hot Springs Street in Maack Addition and along the
west side of Hot Springs Street in Empire Addition, for a distance E
of approximately 2100feet to the south side of Everett Avenue,
crossing 15th North Street, Duluth Avenue (now closed) and 1L.th
North Street; thence across 13th North Street (now closed); thence
continuing south 14° 01' east and across t,.th West Street (now
closed); thenoe on a 60 curve to the right for 320 feet; thence
south 23° 57' east through Lake View Subdivision crossing Harrison
Street, Hamilton Street and along Monroe Street and across 9th North
Street (now closed); thence on a 5° curve to the right for 2L5 feet,
more or less, and entering 3rd West Street at about 30 feet south
of the northeast corner of Block 13, Lake View Subdivision; thence
on said curve to the center of 3rd West Street approximately at
260 feet. north of the city monument at the intersection of 3rd
West and 8th North Streets; thence south on 3rd West Street to
the south line of North Temple Street; thence on a curve to the
left, having a radius of 222 feet across the east side of 3rd
West Street to the east line of 3rd West Street at 128 feet north
of the southwest corner of Lot 5, Block 8L., Plat A; thence east
along the north side of Learned Avenue in Block 814., Plat A to 2nd
West Street, with the right to said grantee to have its cars in
passing over its south track extend on said Learned Avenue not
exceeding three feet; thence across 2nd West Street into Block
85, Plat A, Salt Lake City Survey; thence onto and south on 1st
West Street as provided below; thence south on 1st West Street,
from the north side of 6th south Street to the north side of the
intersection of let West Street and Fayette Avenue, extended.
The above tracks, as now constructed, are more particularly shown in red
lines or the attached blueprint, which is hereby made a part of this ordinance.
Also the right to lay, construct, reconstruct, maintain and operate

spur tracks, with all the necessary switches in connection therewith, that run
from the main line tracks above described and which spur tracks are also shown
in red on the said attached blueprint, which is hereby made a part of this ordinance
and which spur tracks are more particularly described as follows:
A spur track extending south 79° 141 east across Beck Street
intersecting the east side of Beck Street at a point approximately
537.5 feet east and 835 feet south L3° 51' east from the northwest
corner of Section 25, Tp. 1 N. Rg. 1 W., S. L. Mer., which point is
fit:
60.8 feet north 58° 09' east from the city monument, which is 1151
feet north 143° 51' west from the city monument at the intersection
of Beck Street and Columbus Street.
Also a spur track beginning on private property and entering
16th North Street at the center line of Lot 5, Block 17, Folsom
Addition; thence on a curve to the left, having a radius of 200
feet, for approximately 1140 feet to the south line of 16th North
Street.
Also a spur track commencing 5 feet west and 277 feet south
of the city monument at the intersection of 3rd West and 8th North
Streets on the center line of the west track of the Bamberger Rail-
road; thence northwesterly on a curve to the left, having a radius
of 529.65 feet, through an arc of 19° 30' for 180 feet; thence
north 19° 30' west for 53.25 feet; thence across 8th North Street
on a curve to the right, having a radius of 331. 8 feet, through
an arc of 19° 30'; for 112.5 feet; thence north 3.37 feet to the
south line of Lot 1, Block 170, Plat A, at 9 feet west of the
southeast corner of said lot and block.
Also a spur track commencing 5 feet west and 281.8 feet north
of the city monument at the intersection of 3rd West and 7th North
Streets on the center line of the West track of the Bamberger Rail-
road; thence southerly on a curve to the right, having a radius of
529.65 feet, for 180 feet; thence south 19° 30' west for 53 feet;
thence on a curve to the right, having a radius of 298 feet, for
79.5 feet; thence south 34° 50' west for 67 feet, more or less,
to the south line of 7th North Street at a point approximately
63.5 feet west of the northeast corner of Lot 8, Block 152, Plat A.
Also a spur track commencing 3.85 feet west and 329 feet
south of the city monument at the intersection of 3rd west and 5th
North Streets, on the center line of the west track of the Bamberger
Railroad; thence northwesterly on a curve to the left, having a
radius of 529.65 feet, through an arc of 7° 37' 141" for 70.62 feet;
thence north 7937'41" west for 7 feet; thence continuing on a curve
to the left, having a radius of 150 feet, through an arc of 144° 12'
20" for 115.73 feet to the east property line of Block 134, Plat A,
at 88.08 feet south of the northeast corner of said block.
Also a spur track commencing 21.83 feet east and approximately
385 feet south of the monument at the intersection of 3rd West and
aid North Streets on the center line of the east track of the
Bamberger Railroad; thence on a curve to the right, having a radius
of 527.65 feet, for 70.146 feet; thence continuing on a curve to
the right, having a radius of 200 feet, for 80 feet; thence on a
curve to the left, having a radius of 200 feet, for approximately

Also a spur track commencing 206.37 feet south and 19.86 feet
east of the city monument at the intersection of North Temple and
3rd West Streets on the center line of the east track of the Bam-
berger Railroad; thence southeasterly on a curve to the left, having
a radius of 200 feet, for 135.5 feet to the east line of 3rd West
Street at 64.5 feet north of the southwest corner of Lot 4, Block

Also a spur track commencing on the north side of Learned Avenue
and running thence on a 10° ourve to the right across Learned Avenue
in a general direction of south 31° east to the south line of Learned
Avenue and into Lot Li., Block 84., plat A, at 80 feet east of the
northwest corner of said lot.
Also a spur track commencing 330 feet west of the west line of
2nd West Street and 1.75 feet north of the north line of Learned Avenue
on the center line of the south track of the Bamberger Railroad, which
point is on private property; thence westerly on a curve to the left,
having a radius of 190.67 feet, for 42.4 feet; thence on a curve
to the left, having a radius of 150 feet for 73.14 feet to the south
line of Learned Avenue at 98.5 feet west of the northeast corner of

Beginning on the center line of a double track railroad, on the
west line of First West Street at approximately 26 feet south of the
northeast corner of Lot 8, Block 85, Plat A, Salt Lake City Survey;
thence southeasterly on a curve to the right, with a radius of 222.3 feet,
to a tangent on the center line of said street 212.6 feet north of the
intersection monument at South Temple and First West Streets; the center

Also a spur track commencing 7.86 feet south and 411.0
feet east of the city monument at the intersection of West Temple and
9th South Streets; thence northeasterly on a curve to the left to the
north line of 9th south Street at 185.17 feet west of the southeast
corner of Block 4, Plat A, Salt Lake City survey.
Also a single track running from north to south across Fayette
Avenue approximately 114c;.5 feet west of the west line of Main Street.
Section 2. During the term of this franchise the grantee shall be subject
to the following conditions, viz:
(a) That the aforesaid tracks shall be laid upon and conform to the
established grades of the streets, and if said grades are afterwards changed by
ordinance of the Board of Commissioners of Salt Lake City, the grantee shall
at its own expense, change the elevation of the tracks so as to conform to the same.
(b) Whenever streets, where the aforesaid tracks are constructed, shall
be paved, then said grantee, its successors and assigns, shall pave between the
rails and for a space of two feet outside of each rail with materials, to be approved
by the City Engineer, and all ties shall be laid upon a concrete base of such
thickness as shall be directed by the City Engineer.
(a) Said grantee shall put in and maintain such crossings over the
aforesaid tracks as shall from time to time be required by the Board of Commissioners.
(d) The aforesaid tracks shall be laid, and the road operated, so as
to cause no unnecessary impediment to the common and ordinary use of the streets
upon which they are laid.

(e) Good and sufficient conduits to convey water shall be laid and
maintained in good condition, at the expense of said grantee, in all water ditches
crossed by the aforesaid tracks so as to admit the free passage of water.
(f) Salt Lake City reserves the right to regulate and control the
speed of all trains, engines and cars operated by the grantee, .its successors
and assigns, upon the aforesaid tracks.
(g) If said grantee, in installing the aforesaid tracks, shall remove or
in any manner interfere with the pavement, curb, gutter, waterway or sidewalk on the
streets, it shall replace the same so far as possible and to the satisfaction of
the Supervisor of Streets and Irrigation.
(h) Steam may be used as a motive power upon said railroad at any
point northerly of the intersection of 3rd West and South Temple Streets, but shall
not be used south or east of said point in the operation said railroad.
Section 3. Nothing in this grant shall be construed so as to prevent
Salt Lake City or its authorized agents, contractors, persons or corporation to whom
a franchise may have been, or may hereafter be granted, from paving, sewering, laying
gas or watermains or pipes, altering, repairing or in any manner improving the streets,
but all such improvements shall be made with as little injury as practicable to the
aforesaid tracks and the operation thereof. +fihen the city undertakes to lay any
subterranean utility under the tracks of the grantee it shall be the duty of the grantee
to under-pin and protect its tracks while the utility is being put under the same and
said under-pinning and protecting of its tracks shall be at the expense of the grantee.
Section 4. The said grantee herein, its successors and assigns, shall,
any by the acceptance of the privileges and franchises herein granted, and in considera-
tion of the same, does bind itself, its successors and assigns, upon its acceptance
of this franchise, to save the city harmless from all suits, claims, demands and
judgments whatsoever, whether in law or in equity which shall be asserted, found or
rendered in any manner whatsoever, against said city for injury or damage to abutting
property or otherwise, by reason of the granting of this franchise, or by reason of
the operation of the aforesaid tracks; and that the grantee, its successors and assigns,

will pay the amount of any judgment, determination or adjudication which, in any
suit or proceedings may or shall be found against Salt Lake City; provided,
however, that said grantee, its successors or assigns, shall have had notice of
any such suits and an opportunity to appear and defend the same; and said grantee,
its successors and assigns, shall appear in and defend all actions brought against
Salt Lake City for any injury or damage by reason of the construction, operation
or maintenance of the aforesaid tracks.
Section 5. In the granting of the right to use the tracks on 1st West
Street, north of the north side of 6th South Street, it is distinctly understood
that the Board of Commissioners of Salt Lake City has heretofore granted
franchises to the Salt Lake Terminal Company and to Julian M. Bamberger, Receiver
thereof, to construct and operate railroad tracks over said portions of said streets;
and it is also distinctly understood that it is not the intention of the said Board
of Commissioners by this ordinance to grant to the grantee herein named, and its
successors or assigns the right to construct and maintain railroad tracks over said
portions of said streets in addition to the rights heretofore granted to
the Salt Lake Terminal Company and to Julian hi. Bamberger, Receiver thereof, but
that the grantee herein and the Salt Lake Terminal Company and Julian M.
Bamberger, Receiver thereof, or their successors or assigns shall construct
and maintain said tracks over said portions of said streets jointly; and
in case the grantee herein, or its successors or assigns, cannot arrange
for such a joint construction and maintenance then there is hereby granted
to the grantee herein, or its successors or assigns, the right

to operate its cars and trains over and on the railroad tracks owned by
the Salt Lake Terminal Company and Julian M. Bamberger, Receiver thereof,
or their successors or assigns, of a just and equitable proportion of the
cost of the construction, maintenance and operation of the tracks on the
said portions of said streets so used.
Section 6. This franchise shell expire on the first day of
January, 1975 provided, however, that if the grant of this franchise be
not accepted in writing, by the grantee within sixty days after this
ordinance becomes effective, or if said t rante , its successors or assigns,
shall fail or refuse to comply with any of the conditions, provisions,
agreements , or obligations of this :ro+rrt, or to perform any of the condi-
tions or obligations imposed upon them, then this franchise shall be null
and void, provided, further, that if any track on any street is not used
for ❑ period of nine consecutive months during; the life of this franchise
for the purpose for which this franchise is granted, that portion of
track shall be: deemed abandoned and snall be voidable at the option of
the Board of Commissioners, and, if so ordered by the Board of Commissioners,
such track shall be removed by said grantee within thirty Boys thereafter
and the streets restored by said grantee to a condition uniform with the
balance of said street with respect to grade, materials and construction,
and to the satisfaction of the Supervisor of Streets. In the event of
failure of said grantee to so remove said track and restore said street
upon such notice, the said work may be done by the City, at the expense
of said grantee.

Section 7. The term "grantee" as used herein shall, in addition
to its ordinary and generally accepted meaning, be construed to include
the successors and assigns of bamberger Railroad Company, a corporation of
the State of Utah.
Section 8. In the opinion of the Board of Commissioners, it is
necessaryjto the peace, health and safety of the inhabitants of Salt Lake
City this ordinance shall be come effective iimnediately.
Section 9. This ordinance shall taice effect upon its first
publication. �•
