AN ORDINANCE AMENDING Title 18 of the Revised Ordinances of Salt Lake City, Utah, 1955, relating to Health by adding thereto a new chapter to be known as Chapter 13 entitled Barber Shops and Barbering. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Title 18 of the Revised Ordinances of Salt Lake City, Utah, 1955, relating to Health, be, and the same hereby is, amended by adding thereto a new chapter to be known as Chapter 13 en- titled Barber Shops and Barbering, to read as follows: "CHAPTER 13 Barber Shops and Barbering. "Sec. 18-13-1. Definitions. The following defini- tions shall apply in the interpretation and enforcement of this ordinance: "(a) 'Barbering' shall mean performance of the following practices or any of them for compensation either directly or indirectly, or without compensation, if performed for the public generally: shaving or trimming the beard or cutting the hair; giving facial and scalp massages or treatments, with oils and creams and other preparations made for that purpose, either with the hands or mechanical appliances; singeing or shampooing the hair; applying any make of hair tonic or dyeing the hair; applying cosmetic preparations, antiseptics, powders, oils, clays or lotion to scalp, face or neck; removing superfluous hair from the scalp, face or neck of any person. "(b) 'Barber' shall mean any person who practices barbering and is duly licensed by the Department of Registration of the State of Utah as a barber. "(c) 'Barber Shop' shall mean any establishment, place or premises used for the practice of barbering. "(d) 'Barber School' shall mean a school teaching barbering as defined herein and which is duly licensed by the Department of Registration of the State of Utah as a barber school. - 2 - "Sec. 18-13-2. Registration required. It shall be unlawful for any person to conduct, maintain or operate a barber shop or a barber school as herein defined with- out first registering such shop or school with the Salt Lake City license assessor and collector. The registra- tion fee shall be Five and 00/100 ($5.00) Dollars per year or any part thereof for each barber shop and Ten and 00/100 ($10.00) Dollars per year or any part thereof for each barber school. To be eligible for such registration and to maintain such eligibility each barber shop, barber school and every person practicing barbering therein must have and maintain in effect a valid license therefor which has been issued by the Department of Registration of the State of Utah. It shall be unlawful for any person to practice barbering as herein defined except in a registered barber shop or barber school; provided, however, that all persons who are practicing cosmetology or electrology in a duly registered cosmetology shop or cosmetology school are exempted from the provisions of this chapter, provided that they comply with the statutes of the State of Utah and the ordinances of Salt Lake City relative to practicing cosmetology and electrology. "Sec. 18-13-3. Regulations. It shall be unlawful for any person to practice barbering in a registered barber shop or barber school without complying with the following regulations: "(a) No barber shop or barber school shall be used as living, dining or sleeping quarters. "(b) The floors, walls, furniture and fixtures of barber shops or barber schools shall at all times be kept clean and in good repair. "(c) Storage rooms or rooms having entrance from the barber shop or barber school shall be kept clean and orderly. "(d) A barber shop or barber school located in a rest- aurant or in a store or pool room where food and/or beverages are served must be located in a separate room. "(e) If a barber shop or barber school is located in a private residence, the same shall be located in a separate room which has an individual entrance from the outside or an outside entrance directly through the reception room. "(f) Every barber shall supply clean hot and cold water in such quantities as may be necessary to maintain sanitary conditions. Where public water and sewer systems are avail- able, connections must be made. Waste disposal and plumbing must be handled as required by the Salt Lake City Health Department. "(g) No owner or manager of a barber shop or barber school shall knowingly permit any person suffering from a contagious or infectious disease to act as a barber in said shop or school. 94) - 3 - "(h) Any barber, barber student or apprentice barber shall have the right to refuse service to any person afflic- ted with any contagious or infectious diseases. No person so afflicted shall be given service in any barber shop, barber school, or college. "(i) Tweezers, needles, and all other instruments used for the removal of hair and blackheads must be thoroughly cleansed with soap and hot water and then properly sterilized before and after being used on any individual, but no such instrument shall be used without the previous consent of the person being served. "(j) A sufficient supply of clean towels must be kept on or near each work bench and every barber must use separate and clean towels for each customer and shall, while serving a customer, wear a clean outer garment or white shirt which shall at all times be kept clean. After once used, the towels must be immediately discarded and placed in a receptacle for holding soiled linen until laundered. "(k) Every barber chair shall be equipped with paper roll on head rest and the same must be supplied with clean paper before permitting it to be used by a customer. Other papers shall not be used. "(1) Hair brushes may be used only upon the re- quest of the customer. All hair brushes used must be thoroughly cleaned and properly sterilized for each customer's use. "(m) Every barber shall thoroughly cleanse his hands immediately before serving each customer. Soap must be kept available for such purpose. "(n) The use of finger bowls, sponges, lump alum, styptic pencils and powder puffs is prohibited. Pow- dered alums or other approved material may be used to stop bleeding. “o) Combs, razors, clippers, shears and other barber tools shall be thoroughly cleansed before being used on each individual. "(p) Each barber or apprentice barber must have a container for disinfectant solution for submerging combs. They also must have a tight, clean cabinet or drawer containing evaporating formaldehyde or other disinfecting compound for the storage of shears, clippers, combs, brushes, etc. "(q) The use of a lather mug and brush is prohibited. A latherizer or canned lather must be used." "Sec. 18-13-4. Duty of Health Department. It shall be the duty of the Salt Lake City Health Department to inspect all barber shops and schools registered under the provisions of this chapter, to file complaints for violations fop - 4 - of the regulations herein provided and to recommend revocation of license to the Department of Registration of the State of Utah for any violation of this chapter, when in the opinion of the Salt Lake City Health Depart- ment such violation is of such nature that the license involved should be revoked." SECTION 2. In the opinion of the Board of Commissioners, it is necessary to the peace, health and safety of the inhabitants of Salt Lake City that this ordinance become effective immediately. SECTION 3. This ordinance shall take effect upon its first publication.
