' AN ORDINANCE GRANTING PERMISSION TO THE OREGON SHIOFT LINE RAILROAD COMPANY, ITS SUCCESSORS AND ASSIGNS, TO CONSTRUCT A SPUR TRACK IN THIRD WEST STREET OF SALT LAKE CITY. WHEREAS, the Burton Coal and Lumber Company has procured for its use as a coal and lumber yard the north one hundred and five (105) feet by three- hundred and thirty (330) feet, in Lots Three (3) and Four (4), Block Thirty (30), Plat "A° 'of Salt Lake City, and desires the construction of a spur tract: from the main line of the Oregon Short Line Railroad in Third West street between Fifth and Sixth South streets, for the purpose of carrying on and conducting said coal and lumber yard business; and WHEREAS, the said Oregon Short Line Railroad Company has f • petitioned the City Council of said city for authority to construct, a spur track from said main line into the said premises of the said Burton Coal end Lumber Company; NOW THEREFORE, in consideration of the .premises, be it ordained by the City Council of the city of Salt Lake, State of Utah, as follows: SECTION I. That the said Oregon Short Line Railroad Company, its lessees, successors and assigns, have the authority and conson't of the said City Council, and peeslission is hereby „rantd. to construct spur track beginning at a point on its easterly main line on Third :lest ' i stret, one hundred and sixty-seven (167) feet more or less south of the south line of Fifth South street, and extending thence by a curve to the left across the easterly portion of said. Third Nest str.oet and the sidewalk on the easterly site th reof, and entering said Lot Four (4) in said Block at a point to (10) feet moire of less .south of the northwest corner of sa_if. lot. . 92 .. 1 he2ceafter, during the life of said street them, be required to keep the space between 3, and also a space two feet wide outside oft' sok properly sprinkled in conformity to the object. -2- :'7,ECTION II. During the term of this franchise the said eante, its successors and assigns, shall be subject te Pee- -holleing conditions: The sL,,_d railroad tsar:: shall be laid upon and conform to the established grade of the said street, and if said grade is afterwarCs changed Pp the City Council, said grantee shall change the said spur track so as to conform to the sees, and shall provide and keep in repair a crossing forte ams and all vehicles used upon said strt:et, and keep the aoaches to said track where the. same crosses the east- portion of said street and the easterly sidewalk thereof properly graded and zravelled so that the said spur track will not materially interfere with the public travel upon said sic set and sidewalk. The said grantee shall also put in and maintain a good and sa[ficient box and waterway along or near the curb line of said strc:et to permit of the free passage of water flowing along the said curb. line. SECTION III. The rights and franchises hereby granted, and con-firmed are for the term of fifty years from and after the passage of this ordi- nance. SECTIO7 IV.
