Result AN ORDI ANCE JI An ordinance ammending Section 874 and Section 874-X-15, of Chapter 33, Revised Ordinances of halt Lake City, Utah, 1913, as ammended by an ordinance passed by the Board of Commissioners of. Salt Lake City, December 29th, 1916, and repealing Sections 874-X, 874-X-1, 874-X-2, 874-.-3, 874-:L-4, 874-X-5, 874-X-6, 8 74-X-11, 874-%-12 and 874-X-14 of said Chapter 33, Revised Ordinances of Salt Lake City, relating to restaurants. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SPCTION 1. That Sections 874 acid 874-X-15, of Chapter 33, of the Revised Ordinances of halt Lake City, 1913, as ammended by an ordinance passed by the Board of Commissioners of salt Lake City December i0-th, 191,,, relating to restaurants, be and the same are hereby ammended so as to read as follows: Section 874. restaurant keeper is hereby defined to be any person who shall for any consideration furnish food in any quantity to be eaten a-ion the premises where sold, within the limits o-L alt Lake City. It shall be unlawful for any person to comence or carry on the business of restaurant keeper in Salt Lake City, without first obtaining a license so to do. Every person desiring a restaurant keeper'.- license shall make an application therefor to the License Assessor and Collector, and shall, with his 92 • application, file a statement under oath showing the street and house number of the place where he proposes to carry on such business, and also stating the greatest number of persons !such applicant can furnish. with food at one time in such place Hof business. The yearly license fee for restaurants shall be at the 'ate of One {.;l.O) Dollar per person per year, for the maximum number of ,n reons that can be accommodated at any one time, Provided, however, that no license shall be issued for less Ethan Ten ( 10.00) Dollars, nor for more than One "tivadred 0100.00) Dollars. It shall be unlawful for any restaurant keeper, or any Other person, in any restaurant, to sell, give away, serve, permit to be served., or to be drunk, or to drink, any intoxi- 1 Dating liquor in or upon the licensed premises. The door or doors of every restaurant shall be and remain Unlocked and unfastened during all the time any person or persons, including the keeper, or any employe is therein, and during sack. time no orderly person shall be refused admission thereto. Section 874-1-15. Any person violating any of the provisio.kks Of Secti.ors 874, 874-X-7, 874-X-8, 874-X-9 or 874-:i-10, of Chaptezl '3, Revised Ordinances of Salt Lake City, 1913, as ammended, • Shall, upon conviction thereof, be punished by a fine in a sum not exceeding Two hundred 121-inety-nine (+a29'✓.00) Dollars, or by imprisonment in the City Jailfor a -period of not less than thirty (30) days, or by both said fine and imprisonment. The Court may, in imposing a fine, enter as a part of the judgment that in default of payment of the fine the defendant may be imprisoned in the City Jail for a ^,,eriod not exceedin thirty PO) days. -2- SECTION 2. That ,jections 874-X, 874-X-1, 874-X-2, 874-X-3, 874-L-4, 874- -6, 874-X-11, 374-L-12, and 874-X-14, of Chapter 33, Revised Ordinances of Salt Lake City, 1913, as ammended, relating to restaurants, be and the same are hereby repealed. SECTTION 3. In the opinion of the Board of Commissioners, it is necessary to the peace and safet of the City that this ordinance shall become effective immediately, for the better enforcement of the prohibition law.
