Harmsen Harrison Phillips (� Result AN ORDINANCE // AN ORDINANCE AMENDING Title 46 of the Revised Ordinances of Salt Lake City, Utah, 1965, by adding thereto a new Article 23, relating to Noise Standards. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Title 46 of the Revised Ordinances of Salt Lake City, Utah, 1965, be, and the same1reby is, amended by adding thereto a new Article 23 relating to noise standards, to read as follows: ARTICLE 23 NOISE STANDARDS Section:- 290. Definitions 291. Motor Vehicle Noise 292. Sound Level Measurement 293. Enforcement Sec. 290. Definitions. For purposes of this article, the following definitions shall apply: (a) dB(A) Level. " (dB(A) level" shall;mean the total sound level of all noise as measured with a sound level meter using the "A" weighting network. The unit is the decibel. (b) Decibel. "Decibel" (dB) shall mean a logarithmic unit of amplitude which denotes the ratio of two (2) quantities. (c) Sound Pressure Level. "Sound pressure level" (SPL,Lp) is expressed in decibels and shall be twenty (20) times the log- arithm to the base ten (10) of the ratio of the effective sound pressure to the reference sound pressure. The effective sound pressure shall be the root-mean-square of the instantaneous sound pressure. The reference pressure shall be 20 micro-Neutons per meter squared. (d) A Scale. The "A Scale" level (dB(A), (dBA), is expressed in decibels and shall be the sound pressure level which is fre- quency weighted in accordance with an A weighting network. (e) Sound level meter. "Sound level meter" shall mean an instrument including a.microphone, an amplifier, an output meter, and frequency weighting networks for the neasure of noise and sound pressure levels in a specified manner. Sec. 291. Motor vehicle noise. No person shall operate either a motor vehicle or combination of vehicles at any time or under 92 any condition of grade load, acceleration or deacceleration in such manner as to exceed the following noise limits for the category of motor vehicle, based on a distance of not less than 50 feet from the center line of travel under test procedures establish- ed by Section 291. (a) (1) Any motor vehicle with 35 miles per Over 35 miles a manufacturer's GVW hour or less per hour rating of 6,000 lbs. or more, and any combina- tion of vehicles towed by such motor vehicles Before Jan. 1, 1973 88 dB(A) 90 dB(A) After Jan. 1, 1973 86 dB(A) 90 dB(A) (2) Any motorcycle Before Jan. 1, 1973 88 dB(A) 92 dB(A) After Jan. 1, 1973 86 dB(A) 90 dB(A) (3) Any other motor vehicle including passenger cars, and any combination of motor vehicles towed by such motor vehicle Before Jan. 1, 1973 82 dB(A) 86 dB(A) After Jan. 1, 1973 78 dB(A) 84 dB(A) (b) This section applies to the total noise from a vehicle or combination of vehicles and shall not be construed as limiting or precluding the enforcement of any other provisions of this title relating to motor vehicle mufflers for noise control. (c) For the purpose of this section, a motor truck, truck tractor, or bus that is not equipped with an identification plate or marking bearing the manufacturer's name and manufacturer's gross vehicle weight rating shall be considered as having a manufacturer's gross vehicle weight rating of 6,000 pounds or more if the unladen weight is more than 5,000 pounds. (d) No person shall sell or lease, or offer for sale or lease any motor vehicle of a type described above which exceeds the maximum decibel levels set forth above and whose date of manufacture cor- responds with the dates set forth therein. (e) Any vehicle which is found not to be in conformity with this Article and which is manufactured prior to January 1, 1974, may be exempted from the noise levels specified herein provided a good and sufficient showing can be made: (1) That it is mechanically impossible without major construction to modify such equipment so as to be in compliance; or, (2) That to comply would cause irrepairable harm or injury to the engine of said vehicle. An exemption may be granted if the Board of Commissioners or its authorized representative shall be satisfied that a condition as pro- vided above exists rendering compliance impossible,that the vehicle is equipped in all other respects so as to minimize to the maximum degree, possible the objectional noise,and that the noise thus emitted shall not be of such a nature as to necessitate its total prohibition. This provision shall not apply to new equipment which, as manu- factured, could have complied with the noise levels specified above, but which has been modified so as to no longer be in compliance. 92 Sec. 292. Sound level measurement. Sound level measurement shall be made with a sound level meter using the "A" weighting scale in accordance with those standards promulgated by The Society of Automotive Engineers, The American National Standards Institute, or any other procedure adopted and tested by the city departments charged with enforcing this article. Sec. 293. Enforcement. The Salt Lake City Police Department, with cooperation from the Salt Lake City-County Health Department, shall enforce the provisions of this article. Said departments shall be equipped with the appropriate equipment for measuring sound levels as provided in Sec. 292 for purposes of enforcing this article. Where a motor vehicle is deemed to be in violation of this article, the owner may transport it to a central testing location for further evaluation. If said vehicle is re-evaluated and found not to be in violation of the decible standards outlined above, no further pro- ceedings shall be instituted and any citation issued shall be dismissed. SECTION 2. In the opinion of the Board of Commissioners it is necessary to the peace, health, safety and welfare of the inhabitants of Salt Lake City that this ordinance become effective immediately.
