Greener Hogensen Phillips Result ;' AN ("R INANCE AN ORDINANCE AMENDING Chapters 7, 8, 9, 11-and 12 of Title 5, of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to the adoption of the Uniform Building Code, Uniform Housing Code and Uniform Code for the Abatement of Dangerous Buildings, 1976 Edition and exceptions thereto. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION 1. That Chapter 7 of Title 5 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to Building Regulations be and Sections 5-7-2, 5-7-3, 5-7-13, 5-7-14, 5-7-16, 5-7-17, 5-7-18 and 5-7-20 of the same relating to the Uniform Building Code, 1976 Edition, hereby are amended to read as follows: "Sec. 5-7-2. Building code adopted. The uniform building code and the uniform building code standards, 1976 edition, are hereby adopted by Salt Lake City as the ordinances, rules, and regulations of said city subject to the amendments and exceptions thereto as hereinafter set out; three copies of which codes shall be filed for use and examination of the public in the office of the recorder of Salt Lake City. The said codes deal with and establish rules and regulations for the erection, repair, con- struction, enlargement, alteration, equipment, use, height, area, and maintenance of buildings and/or structures in Salt Lake City after the date hereof; they provide for the issuance of permits and the collection of fees therefore; and provide penalties for the violation of the provisions thereof. Hereafter, all refer- ences in the revised ordinances of Salt Lake City, Utah, 1965, to the uniform building code and uniform building code standards, 1973 edition adopted by section 5-7-2 are amended to read the uniform building code and uniform building code standard, 1976 edition. Sec. 5-7-3. Exemptions. Expressly exempted, deleted, and omitted from the uniform building code, 1976 edition, adopted by reference in section 5-7-2 of this chapter are chapters 23, 35, 38, and 48 of the appendix to that code. * * * Sec. 5-7-13. Certificate of occupancy. Section 306(a) of the uniform building code, 1976 edition, adopted by section 5-7-2 of this chapter is amended to read as follows: Sec. 306. (a) Use or Occupancy. No building or structure of Groups A, E, I, H, B or R Occupancy shall be used or occupied, and no change in the existing occupancy classification of a build- ing or structure or portion thereof shall be made until the build- ing official has issued a certificate of occupancy therefor as provided herein. 0/11' .�,d -2- * * * Sec. 5-7-14. Toilet facilities. Section 1711(b) of the uniform building code, 1976 edition, adopted by section 5-7-2 of this chapter is amended by adding thereto a new paragraph as follows: Sec. 306(b) Change in use. * * * The building official may waive the requirements of Sec. 1711(b) in cases of repairs, alterations, and additions. * * * Sec. 5-7-16. Definitions. Section 3301(c) of the uniform building code, 1976 edition, adopted by section 5-7-2 of this chapter is amended by adding the definition of "floor," as follows: Sec. 3301(c) Definitions. * * * "Floor" is the horizontal structural plane immediately below a story, basement, or cellar. Sec. 5-7-17. Lighting fixtures. Lighting fixtures mounted in suspended ceiling systems shall be required to have approved earthquake clips in addition to the wires. Sec. 5-7-18. Self-closing doors. Section 503(d) (4) of the uniform building code, 1976 edition, adopted by section 5-7-2 of this chapter is amended to read as follows: Sec. 503(d) Fire Ratings for Occupancy Separations. * * * (4) In the one-hour occupancy separation between a Group R, Division 3 and M Occupancy, the separation may be limited to the installation of materials approved for one-hour fire-resistive construction on the garage side and a tight fitting solid wood door 1-3/8 inches in thickness will be permitted in lieu of a one-hour fire assembly. Fire dampers shall not be required in ducts piercing this separation for ducts constructed of not less than No. 26 galvanized steel. * * * Sec. 5-7-20. High lift grouted construction. Section 2413(d)7 of the uniform building code, 1976 edition, adopted by section 5-7-2 of this chapter is amended to read as follows: Sec. 2413(d) High-lift Grouted Construction. * * * 7. Grouting shall be done in a continuous pour, in lifts not exceeding 8 feet. It shall be consolidated by puddling or mechanical vibrating during placing and reconsolidated after excess moisture has been absorbed but before plasticity is lost. The grouting of any section of a wall between control barriers shall be completed in one day with no interruptions greater than one hour. SECTION 2. That Chapter 7 of Title 5 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to Building Regulations be, and the same hereby is amended by ADDING thereto new Sections 5-7-22, 5-7-23 and 5-7-24, to read as follows: Sec. 5-7-22. Earthquake regulation. Section 2312 of the uniform building code, 1976 edition, adopted by section 5-7-2 of this chapter is amended by deleting subsection (1) thereof. Sec. 5-7-23. Fees. Section 303 of the uniform building code, 1976 edition, adopted by section 5-7-2 of this chapter is amended by adding thereto aI additional subsection (e) to read as follows: . k,, -3- Sec. 303(a) * * * * * * (e) Misrepresentation. It shall be unlawful for any person acting in the capacity of a contractor to misrepresent permit fees to his client. Sec. 5-7-24. Carports. Section 1412 of the uniform building code, 1976 edition, adopted by Section 5-7-2 of this chapter is amended to read as follows: Sec. 1412. A one-story carport entirely open on two or more sides need not have a fire separation between the carport and the dwelling. Windows between the carport and the dwelling shall not be openable. Doors may be of any type, provided that any sash used in a door be fixed. SECTION 3. That Section 5-8-4(a) of Chapter 8 of Title —of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to Demoli- tion Review Procedures be and the same hereby is amended to provide for appeal to the Housing Advisory and Appeals Board which shall read as follows: Sec. 5-8-4. Demolition review procedures. (a) When an occupant of a dwelling unit has received formal notice of eviction and has reason to believe that notice was issued because of a proposed demolition of the dwelling unit which he occupies, he may initiate an appeal to the housing advisory and appeals board, on a form provided in the office of the depart- ment of building and housing services. The filing of said appeal shall stay the issuance of any permit for the renovation or demolition of the occupied structure in question for a period not to exceed 30 days. Subsequent appeals shall not act to further stay said issuance and no stay shall be granted if the director of building and housing services certifies to the housing advisory and appeals board that a stay would, in his opinion, cause imminent peril to life or property. In such cases permit issuance shall not be stayed otherwise than by order issued by district court on application and notice and due cause shown. * * * SECTION 4. That Section 5-9-17 of the Revised Ordinances of Salt Lake City, Utah, relating to maximum fees chargeable, be, and the same hereby is REPEALED. SECTION 5. That Chapter 9 of Title 5 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to Electrical Regulations be, and Section 5-9-14 of the same hereby is amended to read as follows: Chapter 9 ELECTRICAL REGULATIONS Sections: 5-9-1. National electrical code adopted. 5-9-2. Emergency lighting. 5-9-3. "Reasonably safe" defined. 92 -4- 5-9-4. Service entrance requirements. 5-9-5. Service entrance ratings. 5-9-6. Branch circuits for future use. 5-9-7. Compliance with applicable standards. 5-9-8. Wiring standards. 5-9-9. Electrical equipment standards. 5-9-10. That Sections 5-11-1, 5-11-3 and 5-11-4 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to Housing be and the same hereby are amended to read as follows: Sec. 5-11-1. Uniform housing code and uniform code for the abatement of dangerous buildings adopted. The uniform housing code, 1976 edition, and the uniform code for the abatement of dangerous buildings, 1976 edition, are hereby adopted by Salt Lake City as the ordinances, rules, and regulations of said city, subject to the amendments and exceptions thereto as hereinafter set out; three copies of which codes shall be filed for use and examination by the public in the office of the City Recorder of Salt Lake City. The purpose of these codes are to provide minimum requirements for the protection of life, limb, health, property, safety, and welfare of the general public and the owners and occupants of buildings within Salt Lake City and providing for violation thereof. Hereafter all references in the revised ordinances of Salt Lake City, Utah, 1965 to the uniform housing code and uniform code for the abatement of dangerous buildings 1973 edition adopted by section 5-11-1 are amended and deemed to read the uniform housing code and uniform code for the abatement of dangerous buildings, 1976 edition. * * * Sec. 5-11-3. Housing inspection fees. The fee for an exist- 92 -5- ing single family dwelling housing unit inspection shall not exceed fifteen dollars. An additional fee of five dollars shall be charged for every additional dwelling unit on the premises. Sec. 5-11-4. Housing advisory and appeals board. Section 203 of the uniform housing code, 1976 edition, adopted by section 5-11-1 of this chapter, is amended to read as follows: Sec. 203(a) * * * * * * (d) * * * SECTION 8. That Chapter 11 of Title 5 of the Revised Ordinances of Salt Lake City, Utah, 1965, be, and the same hereby is amended by ADDING Section 5-11-5 thereto to read as follows: Sec. 5-11-5. Repair and demolition fund. Sec. 1502(a) of the uniform housing code, 1976 edition, adopted by Sec. 5-11-1 of this chapter is amended to read as follows: Sec. 1502 (a) General. The board of city commissioners shall establish a special revolving fund to be designated as the repair and demolition fund and shall oversee its administration. Recom- mendations to the board of city commissioners for the use of the fund shall be made by the members of the housing advisory and appeals board after a public hearing. Payments shall be made out of said fund upon the demand of the building official to defray the costs and expenses which may be incurred by the city in doing or causing to be done the necessary work of repair or demolition of dangerous buildings. SECTION 9. That Chapter 12 of Title 5 of the Revised Ordinances of Salt Lake City, Utah, 1965, relating to mechanical regulations be and the same hereby is amended by amending Sections 5-12-1, 5-12-2, 5-12-3, 5-12-4 and 5-12-5 to read as follows: Sec. 5-12-1. Uniform mechanical code adopted. The uniform mechanical code, 1976 edition, is hereby adopted by Salt Lake City as an ordinance, rules, and regulations of Salt Lake City subject to the amendments and exceptions thereto as hereinafter set out; three copies of which code have been filed for use and examination by the public in the office of the city recorder. Hereafter all references in the Revised Ordinances of Salt Lake City, Utah, 1965, to the uniform mechanical code, adopted by section 5-12-1 are amended and deemed to read the uniform mechanical code, 1976 edition. Sec. 5-12-2. Recommended good practices for gas piping appliance installation and venting adopted. Recommended good practices for gas piping appliance installation and venting, Mountain Fuel Supply Company, revision of January 1976, is hereby adopted by Salt Lake City as an ordinance, rules, and regulations of Salt Lake City, subject to the amendments and exceptions thereto as hereinafter set out; three copies of which code have been filed for use and examination by the public in the office of the city recorder. Sec. 5-12-3. Definition of "mechanical system". For the pur- pose of this title, the mechanical system shall include but not be limited to any heating, comfort cooling, ventilation, and re- frigeration systems, or energy using equipment, Energy using equipment is that which is designed, constructed, erected or altered to operate by the use of fuel and/or power and shall include any devices and appurtenances or appliances, materials, ducts, pipes, piping, venting, gas piping, valves, fittings, fans, blowers, and burners necessary to the performance of 90 -6- such functions that shall create comfort heating and/or cooling or power for work services. Section 5-12-4. Mechanical refrigeration, air conditioning, and cooling towers. The uniform mechanical code, 1976, adopted by section 5-12-1 of this chapter, is hereby amended by adding thereto new sections to chapter 17 to read as follows: Sec. 1702. Equipment required. All systems having total capacities exceeding one and one-half tons per hour shall be equipped with evaporative condensers, cooling towers, spray ponds, or other approved water conservation equipment. Section 1703. Effective date. (a) For new installations these regulations shall be effective immediately. (b) In the event that a critical condition develops in the public water supply system, all installations not equipped to conserve water as herein pro- vided shall be subject to immediate discontinuance on orders of this department. Sec. 5-12-5. Mechanical permit fees. Any person desiring a permit required by this code shall at the time of filing an application therefor pay a fee as required by this section to the city treasurer before permit is valid.
