HomeMy WebLinkAbout95 of 1980 - Amending section 25-5-10 clarifying overtime compensation benefits for City employees. / SALT LAKE CITY ORDINANCE No. 95 of 1980 (Employee Overtime Compensation) AN ORDINANCE AMENDING SECTION 25-5-10 OF THE REVISED ORDINANCES OF SALT LAKE CITY, UTAH, 1965, RELATING TO OVERTIME COMPENSATION FOR SALT LAKE CITY EMPLOYEES; CLARIFYING OVERTIME COMPENSATION BENEFITS FOR PERSONS EMPLOYED BY THE CITY. Be it enacted by the City Council of Salt Lake City, Utah: SECTION 1. Section 25-5-10 of the Revised Ordinances of Salt Lake City, Utah, 1965, is amended to read: Sec. 25-5-10. Overtime Compensation. Professional Pay or compensatory Straight-time Levels 315 time off basis at and above regular hourly rate All other Pay or compensatory One and one- classifications time off half times regular hourly rate Where pay is permitted for overtime work, the determination of whether to award pay or compensatory time off shall be at the absolute discretion of the City, except that employees may indicate a preference for form of overtime payment contingent upon approval by the department head, scheduling requirements and availability of funds. (b) Notwithstanding the provisions of this subsection, it is recognized that in certain instances, overtime work may be the I-,, most efficient means of accomplishing municipal duties under circumstances where budgetary constraints do not permit overtime compensation in excess of regular hourly rates. Under such circumstances, the Mayor may accept petitions from eligible employees, (other than persons employed within the Clerical Unit), on forms approved by the City Attorney, for overtime work on a straight-time, hourly basis. The acceptance of such petitions by the Mayor shall be deemed a waiver of the petitioning employees' rights to receive overtime compensation in excess of their regular hourly rates and shall render such employees ineligible for overtime compensation in excess of their regular hourly entitlements. (c) When time off from employment is allowed as compensation for overtime, such time off shall be granted within twelve (12) months from the performance of overtime work. (d) All paid time shall be defined as time worked for purposes of overtime computation; provided, however, that callback and standby pay premiums or unworked hourly guarantees shall be excluded from such computation. SECTION 2. This ordinance shall take effect upon its first publication. Passed by the City Council of Salt Lake City, Utah, this 16th day of September , 1980.
