96 of 1909 - Ordinance 96 of 1909 – Sidewalk Extension No. 108, Seventh Partial Estimate. AN ORDINANCE . An ordinance levying a tax and for the assessment of property o all streets within the district bounded on the west by the center li e of State Street, on the east by the center line of Thirteenth East Street, on the north by the south side of Ninth South Street, and on the south by the city limits, in Sidewalk Districts Nos. 29, 30, 32, 33, 34, 36, 37, 38, 40 and 43, for the construction of cement side- walks. Be it ordained by the City Council of Salt Lake City, Utah: SECTION 1. East and Fifth East Streets; on both sides of Roosevelt Avenue between Third East and Fourth East Streets; on the west side of Fifth East Street ;between Martin and Harrison Avenues; on the east side of Fifth East Street between Martin and Browning Avenues; on both sides of Denver Street between Harrison and Cleveland Avenues; on both sides of Emer- son Avenue between Fourth East and Fifth East Streets; on both sides of Sixth East Street between Martin and Browning Avenues; on both sides , Ij of Park Street between Sherman and Browning Avenues; on both sides of Green Street between Martin and Browning Avenues; and on both sides of Tyler Street between Martin and Browning Avenues. jl This tax is levied to defray the expense of constructing cement (sidewalks four (4) feet wide and four (4) inches thick upon the por- tioi,s of said streets opposite the property hereinbefore and herein- after described to be especially affected and benefited by said im- provement, and it is herohy adjudged, determined and e.tabliahed that said property will be especially benefited thereby to the full amount -3- II'I ,lof the tax hereby levied, and said parcels of land are hereby assessed let an equal and uniform rate in accordance with the linear foot front- 1age upon said portions of said streets fronting upon and to a depth o kwenty-five (25) feet bank therefrom, and the tax hereby levied and II Qto be assessed upon said parcels of land is twenty-one thousand three hundred seventy-one and 25/100 421371.28) dollars, or 6714549/10,000,000 ( 0.6714549) dollars per front or linear foot of abutting property for sidewalks upon the streets above mentioned in Sidewalk Districts Nos. 29, 30, 32, 33, 34, 36, 37, 38, 40 and 43, there being 31828.27 feet of abutting property within the boundaries of the lots, blocks and streets above mentioned in said districts, which is the total cost and cost per front foot of said sidewalks ac- cording to the contract entered into for the performance of said world and making said improvement, with James Kennedy, dated the 28th day o September, 1908, and the Treasurer is hereby authorized and directed 1 1 to assess in accordance with the provisions of this ordinance for the purpose herein mentioned: nThe north side of Lots 11 and 12, Block 1; the east 372 feet of the south side of Lot 13, Block 16-A, all in Five Aare Flat "A", Big Field Survey, as the same are shown upon the offi- cial plats of Salt Lake City to a depth of twenty-five (25) fe et bask from said streets, and to collect said tax. SECTION 2. Said tax shall become and be delinquent in five eq 1 installments, as follows, to-wit: Ono-fifth thereof one year after the approval of the ordinance confirming the levy of the tax for the payment for such improvement; one-fifth thereof in two years after such approval; one-fifth thereof in three years; after such approv4;, II -6- one-fifth thereof in four years after such approval; and one-fifth thereof in five years after such approval. One or more of said in- stallments or the whole tax may be paid on or before ten days after the approval of the ordinance confirming the levy of the tax. One orl! more installments, or the whole special tax may be paid on the day any;installment becomes due, by paying the amount thereof and interest ttelate of payment. Each of said installments shall bear interest at / ;,: therat.e of six (6) per cent per annum from the date of the.approvll `,• of iherOrdinance confirming the levy of said tax until the date of d94inquency, and eight (8) per cent per annum from del4inquenicy until peal d.
