96 of 1911 - Ordinance 96 of 1911 – Franchise, O.S.L.R.R. Co., spur track at South Temple and 10th West Streets
AN ORDINANCE. • An Ordinance granting to the Oregon Short Line Railroad Company, and to its successors and assigns, a franchise to con- struct and operate a spur railroad track across Tenth West street and Glendale street. between South Temple and First South streets, in Salt Lake City, Utah. BE IT ORDAINRD BY THE CITY COUNCIL OF SALT LAKE CITY, I UTAH: Section 1. A franchise and right of way is hereby given and granted to the Oregon Short Line Railroad Company, and to its successors and assigns, to lay, construct and operate a spur stand 1. I and gauge railroad track across the streets hereinafter described i on the following location, to-wit: Commencing at a point in the center of main line of the Leamington Cut-Off of the Oregon Short Line Railroad, which point is 294.00 feet south and 100.56 feet east of the point of inter- section of the monument lines of South Temple and 10th West streets, at Engineer's station 851 plus 94.14; thence on a 60 05 4/ourve to the right a distance if 33.82feet consuming an angle of 2° 03' 30" to a point in the east property line of Tenth West street, which point is 234.5f feet south of the Northwest corner of Block 63, Plat "C", Salt Lake City Survey, and is the point of beginning for ) the franchise across 10th West street; ence continuing along said ,? 6° 05'i/'ourve to right a distance of 60I. feet consuming an angle of 3° 40' 30"; thence on a 9 00' curve to right a distance of 9001873.33 feet, consuming an angle of 6° 3&-©i" to a point in the east prop- erty line produced of Block No. 1 of Jones Subdivision of Block No. wh„, 54. Plat "C", Salt Lake City Survey; said point being the end point for the desired franchise across 10th West street; thence continuing "47 /4 on same 9° 00' curve to right a distance of 58.i6�5feet consuming 'r 43.94 an angle of 5° 14' W; thence on a tangent to said ou'$ve 1 .1' /°l.7 efS.o1h feet; thence on a 290 00' curve ,to right a distance of 1416,56"feet;/es.ag the feet, consuming an angle of 31°0I6'.k30" to a point in the west prop- dAkaed' erty line of said Blookj o. 1 of Jones Subdivision of Block 54, Plat .enero{ 'U", which point is 221. feet south of the N.W. corner of said aid81..kl,Block and being the point of beginning for franchise across Glendale street; thence continuing on same 29° 00' earve to right a distance of feet, consuming an angle of 24O.1 t '; thence northwesterly on tangent at this point a distance of 14.00feet to a point in the 8 ,93 east line of Block No. 2 of Jones Subdivision of Block No. 54, Plat "C", Salt Lake City Survey, which point is 149.54 feet south of the Northeast corner of said Block No. 2, and being the point of ending for franchise across Glendale street. Section 2. During the terms of said franchise, the gran- tee shall be subject to the following conditions, viz: (a) That said spur track shall be laid upon and conform to the established grade of said street, and if said grade is after- s 96 -2- ward changed by ordinance of the city council, the grantee shall at its own expense, change the elevation of the tracks so as to con- form to the same. (b) Whenever said street where such track is constructed shall be paved. then said grantee, its successors and assigns, shall pave between the rails and for a space of two feet outside each rail. with the same material as that used in the street pavement, and all ties shall be laid upon a cement base of such thickness as shall be directed by the city engineer. (c) Said grantee shall put in and maintain such crossings over said spur track as shall from time to time be required by the city council, and cars shall not be permitted to stand on said-Perart ir" 41e otikt street5longer than five minutes. (d) The said spur track shall be laid, and the road operated, so as to cause no unnecessary impediment to the common and ordinary use of said street upon which it is laid. (e) Good and sufficient conduits to convey water shall be laid and maintained in good condition at the expense of said grantee in all the water ditches crossed by said spur track, so as to admit of free passage of water. (f) Said grantee, its successors or assigns, shall gravel and maintain in good condition, at the established grade, the streets along which the track runs to within one and one-half inches of the top rails and for a distance of twenty-five feet on each side of the outer rail, subject to the approval of the supervisor of streets. (g) Salt Lake City reserves the right to regulate and con- trol the speed of all trains, engines and cars operated by the grantee, its successors or assigns, within the city. Section 3. Nothing ih this grant shall be so construed as to prevent Salt Lake City or its authorized agents, contractors, or person or corporation to whom a franchise may have been or may hereafter be granted from paving. sewering, laying gas or water mains, pipes or conduits, altering, repairing or in any manner -3- improving said streets. Section 4. The said grantee herein, its successors and assigns, shall, and by the acceptance of tie privileges and fran- chises herein granted, aid in consideration of the same does bind. itself, its successors and assigns, upon its acceptance of this franchise, to save said city harmless from all- suits, claims, demands and judgment whatsoever, whether in law or in equity, mhiclr shall be asserted, found or rendered in any manner whatsoever, against said city for injury or damages to abutting property or otherwise, by reason of the granting of this franchise, or by reason of the operation of said spur track; and that the grantee herein, its successors and assigns, will pay the amount of any judgment, deter- mination or adjudication which, in anysuit or j proceedings may be or shall be found against Salt.Lake City; provided, however, that said grantee, its successors and assigns, shall have had notice of any such suits, and an opportunity to appear and defend the same; and said grantee, its successors and assigns, shall appear in and defend all actions brought against Salt Lake City for any injury or damage by reason of the construction, operation, or maintenance of said spur track. Section 5. This franchise is granted for the period of 14/ years from and after the approval of this or dinance. Section 6. Unless this grant and all the terms and con- ditions thereof shall be accepted in writing by the grantee herein within thirty days from the approval of this ordinance, and unless said track be constructed within pne year from the date of such approval, then this ordinance shall be null and void. Section 7. This ordinance shall take effect upon approval. Passed by the city council of Salt Lake City, Utah, October 16th 1911, and. referred to the mayor for his I( approval.
