Matheson Romney n Tedesco Mr.Chairman . /' AN ORDINANCE Result AN OINANCE AMENDING AN ORDINANCE passed by the Board of Commissioners of Salt Lake City, Utah, on the 12th day of Novem- ber, 1947, and designated as bill No. 95, levying a tax and for the assessment of property in Lighting District No. 11-C, for the purpose of providing for the operation, maintenance and patrolling of arc lamps and the furnishing of electrical energy therefor. Be it ordained by the Board of Commissioners of Salt Lake City, Utah: SECTION I. That an ordinance passed by the Board of Com- missioners of Salt Lake City, Utah, on the 12th day of November, 1947, and designates as bill No. 95, levying a tax and for the assessment of property in Lighting District No. it-C, for the pur- pose of providing for the operation, maintenance and patrolling of arc lamps and the furnishing of electrical energy therefor, be and the same is hereby amended to read as follows: "SECTION I. That the Board of Commissioners of Salt Lake ^ City does hereby levy the tax and provide for the assessment of the same upon the property hereinafter described in Light- ing District No. 11-C, for the purpose of providing for the operation, maintenance and patrolling of arc lamps and the furnishing of electrical energy therefor, to-wit: In Lots 5 and 6 of Blk. 75, and Lots 5, 6, 7 and S, of Blk. 76, Plat IA!, Salt Lake City Survey, abutting on the south side of South Temple Street from West Temple Street to State Street, in Salt Lake City. This tax is levied to defray the expense of providing for the operation, maintenance and patrolling of arc lamps and fur- nishing with electrical energx ,for a period of ten years frog j -2- November 14, 1947, to November 14, 1957, fourteen (14) orna- mental standards, each equipped with three 6.6 ampere luminou. arc lamps, or forty-two (42) arc lamps; thirty-seven (37) of said arc lamps to be supplied with electric current for the illumination of the same each night from fifteen minutes be- fore dark until midnight, and the remaining five (5) arc lamp•. in said district, however, to be lighted all night, and it is hereby adjudged, determined and established that said propert will be especially benefited thereby to the full amount of the tax levied, and said parcels of land are hereby assessed at a equal and uniform rate in accordance with the linear foot fro t- age upon and to the entire depth of the same ownership back therefrom not exceeding 330 feet and the tax hereby levied a ,• . to be assessed upon said parcels of land is Seventeen Thousan., Four Hundred Sixty-two and 52/100 ($17,462.52) Dollars or Fog - I teen and. 082677/1000000 ($p14.082677) Dollars per front or linear foot of abutting property, there being 1240 feet abut- ting said portion of said improvement, and the cost of which operation, maintenance, patrolling and furnishing of electric al energy and the property benefited thereby is hereinafter set out, and all within the boundaries of the lots, blocks an• streets above mentioned in said district, which is the total abutters' cost and cost per front foot of said improvement for a period of ten years, according to the contract entered into for the performance of said work and making said improve- ment with Utah Power & Light Company, dated the 14th day of November, 1947, said levy to date and be effective from Novem- ber, 1947, which is the date service began, and the city trea- surer is hereby authorized and directed to assess in accord- ance with the provisions of this ordinance for the purpose herein mentioned: :Fronting on the south side of South Temple 'Street: All of Lots 5 and 6 of Blk. 75; all of Lots 5 and 6 the east 99.0 ft. of Lot 7, and the east 110.0 ft. and the west 41.0 ft. of Lot 8, of Blk. 76; Plat 'A', Salt Lake City Survey; -3- as the same are shown upon the official plats of said city to the entire depth of the same ownership back from said street not exceeding 330 feet, and collect said tax. ji II SECTION II. That the assessment list made by the City Treasurer, as corrected, approved and completed by the Board of Equalization and. Review of the property described in Secti n I of this ordinance in Lighting District No. 11-C of Salt Lak City for the purpose of providing for the operation, mainte- nance and patrolling of arc lamps and furnishing with elec- trical energy, is hereby confirmed, and the assessments made and returned in said completed lists and the report of the Board of Equalization and Review to the Board of Commission- ers of Salt Lake City are hereby ratified, approved and con- firmed. SECTION III. Said tax shall be payable in ten equal year- ! ly installments, with interest on any delinquent installment j 4 unpaid at the rate of ten per cent per annum, which interest shall be charged from and after the due date of each install- ment, to-wit: One-tenth thereof fifteen days after the ordi- nance levying the tax for the payment of the improvement be- comes effective; one-tenth thereof in one year thereafter; on - tenth thereof in two years thereafter; one-tenth thereof in three years thereafter; one-tenth thereof in four years there after; one-tenth thereof in five years thereafter; one-tenth thereof in six years thereafter; one-tenth thereof in seven years thereafter; one tenth thereof in eight years thereafter; one-tenth thereof in nine years thereafter; provided, however, that one or more of such installments in the order payable, o the whole tax, may be paid without interest within fifteen (1 ) days from the date this ordinance becomes effective. Default in the payment of any such installment of princi- pal when due shall cause the whole of the unpaid principal to become due and payable immediately, and the whole amount of the unpaid principal shall thereafter draw interest at the rate of ten per cent per annum until paid, but at any time prior -4- to the date of sale or foreclosure the owner may pay the amou t of all unpaid installments past due, with interest at the rat 1 of ten per cent per annum to date of payment on the delinquent installments, and all accrued costs, and shall thereupon be restored to the right thereafter to pay in installments in th same manner as if default had not occurred. n SECTION 2. In the opinion of the Board of Commissioners, it is necessary to the peace, health and safety of the inhabitants of Salt Lake City ,that this ordinance become effective immediately SECTION 3.
