Agraz Greener Oft tai4x.CaFspbell �J Phillips , ✓ Result AN(ORDINAN AN ORDINANCE VACATING interior alleys within Bloc of Folsom's Addition and that portion of Bertella Avenue (formerly Chestnut Street) west of Chicago Street (formerly Cleveland Avenue) as it is found in the area of approximately 1750 North and 940 West in Salt Lake City, Utah. WHEREAS, the Board of Commissioners finds that the interior alleys located in Block 5 of the Folsom,sAddition, together with that portion of Bertella Avenue west of Chicago Street, are not needed for the use of the public as a thoroughfare, that the vacation of such streets and alleys will not be adverse to the general public's interest, that City's interest in the right of way in Bertella Avenue, may be subject to some dispute as to allegations of abandon- ment and the Board finding that the improvements of fencing and hardsurfacing by abutting landowners to be made to the property, as a condition subsequent of the Board's action of vacating such street and alleys, are deemed comparable value for the City's interest to be vacated therein; THEREFORE, be it ordained by the Board of Commissioners of Salt Lake City, Utah; SECTION 1. The interior alleys presently situated in Block 5 of Folsom's Addition in Salt Lake City together with the portion of Bertella Avenue (formerly Chestnut Street) of said addition located west of Chicago Avenue (formerly Cleveland Avenue), located near 1750 North and 940 West in Salt Lake City, Utah, more parti- cularly described below, be, and the same hereby are, vacated and declared no longer to be public property for the use as streets, avenues, alleys or pedestrian ways: Beginning at the S.E. Corner of Lot I, Block 5, Folsom's Addition, a subdivision of Section 23, T.1N., R.1W. S.L.B.&M., and running thence South 66.00 feet to the N.E. Corner of Lot 20, Block 4, said subdivision; thence West 360.00 feet to the N.W. Corner of Lot 11, said Block 4; thence North- easterly to the S.W. Corner of Lot 9, said Block 5; thence East 213.50 feet to the westline of a 15-foot alley; thence North 125.00 feet; thence West to the N.W. corner of Lot 9, said Block 5, thence North- easterly to the S.W. corner of Lot 10, said Block 5; thence East to the S.E. corner of Lot 16, said Block 5; thence North 125.00 feet; thence East 15.00 feet; thence South 125.00 feet; thence East 125.00 feet; thence South 15.00 feet; thence West 125.00 feet; thence South 125.00 feet; thence East 125.00 feet to the point of beginning. Said vacation is expressly made SUBJECT to all right of ways and easements of all utilities of any and every kind and description, now located on, in, under or over the confines of the above-described property, and SUBJECT to the rights of entry thereon for the purpose of maintaining, altering, repairing, replacing, removing or rerouting said utilities and all of them. Said vacation is also expressly made SUBJECT to all existing rights of ways and easements of third parties. Said vacation is also expressly made SUBJECT to the conditions subsequent that the abutting property owners shall erect fences upon the property line west of Chicago Street to fence the property off, and shall be responsible for installing asphalt or other hard surface materials in front thereof. Said improvement shall be considered a condition subsequent, and no deed shall be issued to the property owners until such improvements have been installed and maintained. Furthermore, if said improvements are not installed within one year from the effective date of this ordinance the vacation action or any portion thereof may be rescinded by ordinance of the Board of City Commissioners. This ordinance shall take effect thirty (30) days after the date of its first publication. Passed by the Board of Commissioners this 5th day of July 1979.
