WHEREAS, it is necessary for the completion of the Redwood
Road Sewer Trunk Line, as proposed, that a portion thereof be located
over, across and through that certain real property hereinafter
described; and
WHEREAS, said land is included within Tenth North Street
between Block 11 and Block 12 of Jordan Plan "A" which is a dedicated
public street; and
WHEREAS, said public street has not been opened or improved
and certain owners of land adjacent to said public street claim an inter-
est in said land contrary to that of the public therein; and
WHEREAS, the public interest and necessity require the acquisi-
tion, construction and completion of the above named public improvement;
and
WHEREAS, the public interest and necessity require the immediate
acquisition of any interest in said land which is repugnant to the right
of Salt Lake City to occupy and use the real property hereinafter described
for the above named public improvement; and
WHEREAS, the public interest and necessity require the immediate
occupancy of said real property for the construction of the above named
public improvement;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF
SALT LAKE CITY, UTAH:
1. That it is necessary and in the public interest of said city
and its inhabitants that the real property hereinafter described be avail-
able to the city for the location and construction of part of the approved
Redwood Road Sewer Trunk Line over, across and through said land.
2. That the location and construction of the approved Redwood
Road Sewer Trunk Line over, across and through the land hereinafter
described is hereby authorized.

3. That said land hereinafter described and the whole thereof
is hereby determined to be necessary and the most suitable for the loca-
tion and construction of the approved Redwood Road Sewer Trunk Line, and
the acquisition of outstanding interests in said land, if any, by Salt
Lake City for such purposes is hereby declared to be a public necessity
and for the health, welfare and protection of the inhabitants of said city.
4. That condemnation proceedings including therein the right of
immediate occupancy be, and the same hereby are, authorized to be brought
in the name of Salt Lake City by the Law Department thereof to acquire all
outstanding interest adverse to that of the public, if any, in the land
hereinafter described for the necessary location and construction of sewer
trunk line facilities as hereinabove set forth.
5. The parcel of land hereinabove referred to and hereby author-
ized to be acquired by condemnation proceedings in accordance with the
provisions of the statutes and the constitution of the State of Utah re-
lating to eminent domain is situated in the County of Salt Lake, State
of Utah, and is more particularly described as follows:
Beginning at a point 107.25 feet west and 759 feet north
of the South West Corner of the North East Quarter of Section
27, Township 1 North, Range 1 West; thence North 89° 51' 50"
West 1248.4 feet; North 0° 15' 07" East 66 feet; South 89° 51'
50" East 1248.4 feet; South 0° 15' 07" West to point of begin-
ning, containing 1.89 acres more or less.
Passed by the Board of Commissioners of Salt Lake City, Utah,
this 8th day of January, 1962. _
