11 of 1979 - RESOLUTION IN OPPOSITION TO SENATE BILL 160 OF 1979 GENERAL LEGISLATIVE SESSION - for the creation o ROLL CALL VOTING Aye Nay Salt Lake City,Utah, 3$ ,19 79 Mr.Chairman' A 7 ✓ I mov thatthe Resolution be adopted. 9 �- Greener iil Campbell z Phillips R OLUTION INOPPOSITI TO Result SENATE BILL 160 OF 1979 GENERAL LEGISLATIVE SESSION WHEREAS, Senate Bill 160 has been introduced to the 1979 General Legislative Session which provides for the adoption of state-wide building codes, for the creation of a construction and appeals board, for the creation of a state building official office and for a system of code enforcement; and WHEREAS, said Senate Bill 160 would have the effect of establish- ing standards of construction for all buildings throughout every political subdivision of the state, in contravention of enabling authority currently existing in Title 10 delegating the regulation of building safety and standard to local municipalities; and WHEREAS, the uniform codes that are designated to be incorporated by reference do not exist, the latest edition of said codes being the 1976 editions, and in light of the fact that the International Conference of Building Officials ("ICBO") shall be forthwith promul- gating the 1979 editions that we believe will include substantial amendments which shall be available for review and adoption within the next six months, and which be the more current code to adopt, if one is to be adopted on a state-wide basis; and WHEREAS, said Senate Bill 160 would impose the state-wide code on all political subdivisions rather than only upon those political sub- divisions who have not enacted local building codes or who have failed to create local boards of appeals which will have the effect of taking authority away from those jurisdictions that have responsibility under- taken building code regulations and enforcement without ensuring any greater uniformity than currently exists because of the provision which would still allow political subdivisions to amend said codes; and WHEREAS, the scope and limitations of the jurisdiction and power of the state appeals board is ambiguous--particularly in terms of its -2- interrelationship with local appeal boards that should have sole jurisdiction within its boundaries as is currently provided in the uniform codes; and WHEREAS, said Senate Bill 160 fails to require that the state and its political subdivisions comply with said building code which should be included to satisfy the purposes stated in the Bill; and WHEREAS, the ability of said State Board to adopt without local review or input any proposed amendments or revisions; and WHEREAS, Senate Bill 160 would be able to accept alternate methods of construction that may contravene the uniform code standards or more restrictive local amendments; and WHEREAS, Senate Bill 160 would give the administrator powers to investigate local complaints would emasculate enforcement efforts by local jurisdictions, NOW, THEREFORE, BE IT RESOLVED by the Board of Salt Lake City Commissioners that it urges the 1979 General Session to oppose and reject Senate Bill 160 because it overreaches into the authority vested in local government to regulate building construction and will not achieve the stated purposes of uniformity. Further, the Bill places onerous burdens on local political subdivisions to enforcing standards imposed upon without an opportunity to review, give input or analyze in light of its impact upon development needs of its community. Enforce- ment powers would be emasculated. Further, its ambiguity would create confusion, misunderstanding and the state board to approve method less restrictive methods notwithstanding the adoption of higher standards in a community. IT IS FURTHER RESOLVED that this resolution is not intended as a criticism of any public official but rather as an expression of general principles of efficient governmental administration.
