Whitehead, Chairman 211 City and County Building Salt Lake City, Utah Dear Council Members: The Salt Lake City Council, at its meeting this day, dieousited the possibility of a lawsuit regarding the salary of former Commissioner Glen N. Greener and of former City Auditor K. Ray Hammond. Upon motion of Councilmember Davis, the City Council passed Resolution No. 12 of 1980, recommending that no public monies be paid from the public treasury of Salt Lake City, Utah, to Glen N. Greener or K. Ray Hammond under the authority of Utah Code Annotated e10-9-1t-8(1977). Upon motion of Councilmember Whitehead, the City Council adopted the srd option as recommended by the City Attorney that the lawsuit be resolved by the courts in cases filed by private citizens but that the money for the salaries be held in an escrow account by the City until the issue is resolved. After further discussion of the matter, the City Council approved the motion of Councilmember Shearer that the resolution and matters attendant thereto be discussed in the City Council's Thursday, February 7, 1980, Rieoutive Session at 4:50 p.m. Yours truly, ma CC: Attorney Mayor Wilson City Recorder Accounting Budget&Management Planning --Files RESOLUTION NO. 12 February5 , 1980 A RESOLUTION OF THE CITY COUNCIL OF SALT LAKE CITY, UTAH, DIRECTING THAT NO PUBLIC MONIES BE PAID FROM THE TREASURY OF SALT LAKE CITY, UTAH, TO GLEN N. GREENER OR K. RAY HAMMOND. BE IT KNOWN AND REMEMBERED: THAT, the City Council of Salt Lake City, Utah, met in regular session of the Council on the 5th day of February, 1980. WITNESSETH THAT: WHEREAS, Glen N. Greener and K. Ray Hammond were removed from elected office in the municipal government of Salt Lake City, Utah, by the adoption of a new form of municipal government which abolished the elected offices which they held; and WHEREAS, Glen N. Greener and K. Ray Hammond pre- sently hold no municipal office in the government of Salt Lake City, Utah, nor do they provide any other public service for which compensation is due and owing; and WHEREAS, Glen N. Greener and K. Ray Hammond intend to make claim for, receive, and accept payment of public monies from the treasury of Salt Lake City, Utah, for which payment they intend to provide no public service in compensation; and WHEREAS, such claim for payment is made under the authority of Utah Code Ann. §10-3-1208 (1977), which statute is an unconstitutional infringement upon the autonomous taxing powers of municipal government in violation of the Utah Consti- tution, Article 13 §5; NOW, THEREFORE, BE IT RESOLVED, that the City Council of Salt Lake City, Utah, do and hereby a-=^-t that no public monies be paid from the public treasury of Salt Lake City, Utah, to Glen N. Greener or K. Ray Hammond under the authority of Utah Code Ann. §10-3-1208 (1977) . Effective this 5th day of February, 1980.
