12 of 1981 - Joint resolution that the Council and Mayor oppose any State legislation which creates specific zoni i RESOLUTION WHEREAS, heretofore, the power to regulate the health, safety, and general welfare of citizenry through zoning law is a power that has been delegated to municipalities, and WHEREAS, no petition has been filed with the City and Salt Lake for addressing any possible zoning problem with respect to homes for handicapped persons, even though the City has a process whereby any existing zoning ordinance may be amended, and whereby new zoning ordinances may be proposed by any interested person, and WHEREAS, powers of government generally are best exercised at a level closest to the citizenry, and WHEREAS, this principal of keeping government closest to the people is one which has received much recent public attention as many citizens have been highly critical of Federal intervention in the power of states to control their lands, and WHEREAS, if this principal is valid in its application from federal to state government, it should be equally valid in its application from state to city government, NOW, THEREFORE BE IT RESOLVED BY THE SALT LAKE CITY COUNCIL AND MAYOR, that the Council and Mayor go on record as opposing any State legislation which creates specific zoning law for municipalities, and that the Council and Mayor go on record specifically as opposing the enactment of H.B. No. 126 concerning Residential Facility Zoning Limitation.
