Green _ �yII Neslen it Mr. Chairman Y;— Result RESOLUTION WHEREAS, Salt Lake City has acquired certain water rights in the Tanner Ditch leading from Big Cottonwood Creek in Salt Lake County, and by virtue of a contract heretofore made and entered into with the Big Cottonwood Tanner Ditch Company, Salt Lake City has agreed to deliver to said company certain waters from Utah Lake in exchange for water from Big Cottonwood Creek, and WHEREAS, Salt Lake City contemplates and is now negotiating other contracts of a similar nature for other waters of Big Cotton- wood Creek and Little Cottonwood Creek, and •1."HE:r':EAS, it is necessary in order to make said exchange of waters to extend the East Jordan Cana'_, in which canal Salt Lake has an interest, for the purpose of delivering water from Utah Lake to the said Tanner Ditch Company and to such other persons as said City may contract with for the exchange of waters, and VHEPRAS, it is and is hereby declared to be necessary for said City to own the following described property through which said East Jordan Canal, as extended, will run. NOW THEREFORE BE IT RESOLVED, That the City Attorney he, and he is hereby instructed and directed to bring suit against the owners of the property hereinafter described, for the purpose of ac- quiring title to said lands for Salt Lake City by condemnation for said extension of the East Jordan Canal, said lands being the follow- ing to-wit: Beginning N. 0° 40' W. 198 feet from the Southwest corner of the Union Corporation of the Church of Jesus Christ of Latter-Day Saint's property, which point bears S. 46° 38' E. '2361.0 feet from the Northwest corner of Section 29, T. 2 S. R. I E., Salt Lake Base & ItIeridian; thence S. 89° 21' E. 161.8 feet; thence along a 30° 40' Ilt curve to the left 2.8 feet; thence S. 0° 04' W. 66.1 feet; thence along a 22° 35' curve to the right; 4.0 feet; thence N. 89 21' W. 161.4 feet; thence N. 0° 40' W. 66 feet to the point of beginning and containing .250 acres more or less. and, BE IT FURTHER RESOLVED, That said City Attorney be, and he is hereby instructed to commence such proceedings at once. In the opinion of the Board of Commissioners, it is necessary to the peace, health and safety of the inhabitants of Salt Lake City that this resolution become effective at once.
