Whitehead, Chairman 211 City and County Building Salt Lake City, Utah Dear Council Members: The Salt Lake City Council, at its meeting this day, passed Resolution No. 13 of 1980, recommending that the Mayor instruct the City Attorney to take whatever actions are necessary to protect the monetary interests of Salt Lake City and the taxpayers of Salt Lake City regarding pending lawsuits Starr vs. Salt Lake City Corporation et al, and Butler vs. Salt Lake City Corporation et al. It is the further opinion and position of the City Council that the City actively resist any claim that the City pay attorney's fees, costs, or any other payment to Messrs. SALT LAKE CITY CORPORATION ET. AL. AND BUTLER VS. SALT LAKE CITY CORPORATION ET. AL. BE IT KNOWN AND REMEMBERED: THAT, the City Council of Salt Lake City, Utah, met in regular session of the Council on the 7th day of February, 1980. WITNESSETH THAT: WHEREAS, Glen N. Greener and K. Ray Hammond were removed from elected office in the municipal government of Salt Lake City, Utah, by the adoption of a new form of municipal government which abolished the elected offices which they held; and WHEREAS, Glen N. Greener and K. Ray Hammond presently hold no municipal office in the government of Salt Lake City, Utah; and WHEREAS, Glen N. Greener and K. Ray Hammond intend to make claim for, receive, and accept payment of public monies from Salt Lake City Corporation; and WHEREAS, such claim for payment is made under the authority of Utah Code Ann. Section 10-3-1208, which statue is argued by some attorneys to constitute an unconstitutional infringement upon the autonomous taxing powers of municipal government in violation of the Utah Constitution, Article 13 Section 5; and WHEREAS, court suits have been instituted naming as defendants individual council members and disputing on numerous grounds the constitutionality of Utah Code Ann. Section 10-3-1208; NOW THEREFORE BE IT RESOLVED, that the City Council of Salt Lake City, Utah, do hereby recommend that the Mayor instruct the City Attorney to take whatever actions are necessary to protect the monetary interests of Salt Lake City, and the taxpayers of Salt Lake City. BE IT FURTHER RESOLVED, that it is the opinion and position of the Council that the City actively resist any claim that the City pay attorney's fees, costs, or any other payment to Messrs.
