B. 50 providing that retirement benefits shall be based only upon base salary, excluding overtime and other benefits; and WHEREAS, contributions to the fund as based upon "all salary, wage and overtime payments" paid to the employee [S 49-11-8(22), Utah Code Ann. 1953]; and WHEREAS, the language "nor shall the contributions paid by the employer and employee to the retirement systems be based upon any of the aforementioned special payments to the last year of service" is completely vague and ambig- uous. As such the bill raises, among others, the following questions and problems: 1. Is it only in the last year of a person's employment that contributions are not deducted and if so, does such a payment system violate the equal protection clause of the State and Federal con- stitutions? 2. It is not fair to require contributions on earnings of a worker when those contributions will not be used to compute his retirement pay. This formula hurts employee morale, undermines their efficiency, and takes money without giving the appropriate benefit to those who earned the money, contrary to the design and intent of the whole Retirement Act. 3. It is not possible for an employer or employee to completely anticipate which year of employment will be the last year, since there are so many unforeseeable circumstances; and WHEREAS, the bill is having a negative impact upon the morale of the employees of Salt Lake City. NOW, THEREFORE, the Board of Commissioners of Salt Lake City respectfully requires the Honorable Calvin L. Rampton to veto S.
