-- RESOLUTION
WHEREAS, Salt Lake City has accuired certain water rights
in Little Cottonwood Creek in Salt Lake County, State of Utah, and
by virtue of a contract heretofore made and entered into has agreed
to construct a pipeline to carry the creek water to Salt Lake City
through Big Cottonwood conduit to be distributed among its inhabitants;
and
his wife,
dHLRkkAS, Hyrum Covert and Covert/are the owners
of certain of the land in which it will be necessary to construct said
pipeline for the purpose of bringing said water to gig Cottonwood con—
duit; and
kHLid S, it is necessary in order to bring said water from
that a piuelitic be laid

distributing it to the inhabitants of said city; and
eHLhi;kS, it is and is hereby declared to be necessary for
said city to have a perpetual easement for a right of way over the
following described property through which said pipeline will run,
to—wit:
Beginning 715 ft. plus or minus south and 120 ft.
plus or minus east from the N.V . corner of Sec. 25, T. 2 S.,
1 T%, S. L. F3. & M., in the fence line between the Covert
and the Juliet C. Dunn properties, thence S. 45° 47t ti . 1C3
ft. plus or minus to the nest fence line of the Covert property.

to run have refused to accept the price tendered by the city for said

NM; THEREFORE, BE IT RLSOLVi_D that the City attorney be

owners of the property descrihed above for the purpose of acquiring
a serpetuel right of way easement to Big Cottonwood conduit by con-
idcmnation for the purpose of laying and cosetruoting said pipeline
from Little CottonwOOd creek to Big Cottonwood conduit.
BE IT FURTHER R'LSOLVLC that said City Lttorney be and he
(hereby is instructe to commence such aroceedinns at once.
It is necessary in the o.inion of the Board of Commission
ers for the peace, health and safety of the inhabitants of Salt Lak-
